Oak Harbor City Council Regular Meeting Minutes December 7, 2021 Due to COVID-19, there was both a physical meeting location and a virtual meeting per WA Proclamation 20-28. Evans of Kenyon Disend, PLLC Mayor Severns welcomed Councilmember Bryan Stucky to his first meeting, representing Position 7 on the Council. Councilmember Stucky was elected to the seat previously held by Councilmember Larsen, who vacated the position when he moved outside the city limits. Position 7 was subsequently filled by the appointment of Councilmember Goebel. On behalf of the City, Mayor Severns thanked Councilmem- ber Goebel for her service noted she continues to do great things for the Oak Harbor School District. Councilmember Stucky’s election was certified by the Canvassing Board for Island County on November 23, 2021, and he was sworn in at City Hall that same day. As the person elected to Position 7, Coun- cilmember Stucky fills both the remainder of the term as well as the term that begins in January. 1. APPROVAL OF AGENDA Hearing no changes, the agenda was approved as presented. Regular Meeting Minutes- December 7, 2021 Page 1 of 7 2. PRESENTATIONS a. Proclamations None. b. Honors & Recognitions None. c. Community Presentations i. Boy Scout Troop 4059 – Wreath Presentation. Troop 4059 led by Troop Master Mat- thew Erickson, presented the City with an annual holiday wreath. The wreath will be displayed in the lobby of City Hall. Mayor Severns announced a brief recess for Councilmembers to thank the Troop for their service to the community. The meeting resumed at 6:11 p.m. 3. CITIZEN COMMENT PERIOD Mayor Severns explained citizens could comment on subjects of interest. Public comment could be submitted via the online webform, electronically to the City Clerk at jlindsey@oakharbor.org or by calling 360-279-4571 after 5 p.m. on the Friday preceding the meeting and prior to the meeting. To ensure comments are recorded properly, please state your name clearly when leaving a message. Please limit your comments to three minutes. The City Council received one new public comment in the Mayor’s comment box at City Hall and no employee comments since the November 16, 2021 meeting. The citizen comment was provided to Council and displayed as part of the meeting record. Mayor Severns opened the floor for public comment from any audience member present. Mr. Eric Marshall, SE Ebee Street, Oak Harbor, addressed the Council regarding the access road at Fakkema Road. Hearing no others, the public comment period was closed. 4. CONSENT AGENDA Consent Items a. Approval of Minutes of November 16, 2021 Council Meeting, November 17, 2021 Council Workshop, November 19, 2021 Special Council Meeting, and November 22, 2021 Special Council Meeting b. Approval of Payroll and Accounts Payable Vouchers c. Professional Services Agreement: Gray & Osborne – Limited Water System Update – Con- tract Amendment No. 1 d. Purchase Authorization: Detective Truck Replacement e. Professional Services Agreement: Harmsen Engineering – Fakkema Access Road – Con- tract Amendment No. 2 f. Consultant Agreement: Carollo Engineers – Clean Water Facility On-Call Services – Amendment No. 2 Regular Meeting Minutes- December 7, 2021 Page 2 of 7 Councilmember Woessner requested to pull Item 4.e. Professional Services Agreement: Harmsen En- gineering – Fakkema Access Road – Contract Amendment No. 2 for discussion. Hearing no others, Mayor Severns announced items 4.a. through 4.d and item 4.f were approved as presented. Mayor Severns called on Project Manager Arvidson, who provided additional information on the project and contract amendment. Councilmembers Woessner, Stucky, Servatius, Hizon and Mayor Pro Tem Munns provided their respec- tive questions and comments regarding the item. Motion: Following discussion, Mayor Pro Tem Munns moved to move item 4.e Professional Services Agreement: Harmsen Engineering – Fakkema Access Road – Contract Amendment No.2 to the Decem- ber 14, 2021 Council meeting. The motion was seconded by Councilmember Hizon and carried unani- mously. 5. MAYOR, COUNCIL & STAFF COMMENTS a. Mayor Mayor Severns provided his respective comments and announcements. Announcements and Upcoming Events – Remembrance of Pearl Harbor Day. Thank you to the Oak Harbor Lyons Club for placement of flags along our city streets on this 80th Anniversary of Pearl Harbor Day. Local Events: • Shop Local Oak Harbor – Consider shopping locally this holiday season for gifts and holiday meals and treats. • The Green Ticket Cash Giveaway, Vote for Your Favorite Toy Soldier, and Snowflake Hunt are going now through December 17th • New Year’s Eve Fireworks will be displayed on Friday, December 31 at 9pm Student Shout-Outs - Congratulations to all these students! • The Oak Harbor High School Sailing Team finished 7th in the Northwest ISA Fall Championships in Portland. • The Oak Harbor Track and Field Team is sending 9 of its members to the state cross-country meet. • Oak Harbor High School Cheerleader Melany Alanis has been selected to participate in the Walt Disney World Holiday Parade. Upcoming City Council Meetings – The second regular monthly meeting of City Council will be held on Tuesday, December 14 at 6 p.m. The monthly workshop is currently scheduled for Wednesday, Decem- ber 15 at 2 p.m.; however, Mayor Severns noted he wished to discuss the potential cancellation of that workshop in just a few moments. Councilmembers Councilmembers Mack, Hizon, Woessner, Wasinger and Mayor Pro Tem Munns provided their respec- tive comments and questions. a. Cancellation of December City Council workshop Mayor Severns noted he and staff had placed this item on the agenda as there were no agenda items or presentations for the December 15, 2021 Workshop meeting. That being the case, staff requested Council consideration for cancellation of that Workshop. Motion: Councilmember Servatius moved to cancel the December 15, 2021 Workshop for lack of press- ing business. The motion was seconded by Councilmember Woessner and carried unanimously. 6. PUBLIC HEARINGS & PUBLIC MEETINGS a. Ordinance No. 1941 Budget Amendment No. 4 – Departmental Requests. An ordinance of the City of Oak Harbor amending the biennial budget for 2021-2022; adopting an updated wage and salary schedule and plan of classification; providing for severability; and establish- ing an effective date. He confirmed no comments had been received regarding the ordinance. Hearing no comments, the public hearing was closed. Mayor Severns requested any com- ments or questions from City Council. Councilmembers Woessner, Wasinger, Mack, and Hizon provided their respective questions and com- ments. Motion: Councilmember Hizon moved to adopt Ordinance No. 1941 Budget Amendment #$ amending the 2021-2022 Biennial Budget and adopting an updated wage and salary schedule and plan of classi- fication. Motion was seconded by Mayor Pro Tem Munns and passed unanimously. b. Ordinance No. 1942 Budget Amendment No. 5 – Amending the 2021-2022 Biennial Budget; adopting an updated wage and salary schedule and plan of classification; providing for sev- erability; and establishing an effective date. Finance Director David Goldman presented the ordinance and budget amendment, noting per Revised Code of Washington (RCW 35.A.34.130 and Oak Harbor Municipal Code 3.80.020, the Mayor shall prepare a mid-biennial budget amendment for Council review and approval. Director Goldman reviewed all operating funds, capital projects funds and revenue expectations. He also provided a REET report overview as noted in the prior budget ordinance, Mayor Severns opened the public hearing. He confirmed no comments had been received regarding the ordinance. Hearing no comments, the public hearing was closed. Mayor Severns requested any com- ments or questions from City Council. Motion: Hearing no discussion, Councilmember Hizon moved to adopt Ordinance No. 1942 Budget Amendment #5 amending the 2021-2022 Biennial Budget. The motion was seconded by Mayor Pro Tem Munns and passed unanimously. 7. ORDINANCES & RESOLUTIONS a. Resolution No. – 21-28: Approval of Meditation Sculpture Budget Interim Public Works Director Monken provided the background regarding the Meditation sculpture, part of the Joseph Kinnebrew collection, scheduled to be installed at the Oak Harbor Boys & Girls Club. Director Monken reviewed the budget for cleaning, repainting and installation of the sculpture, totaling $12,000 from the Creative Arts Fund. Mayor Severns confirmed no public comment was received on this item. Councilmembers Woessner, Servatius and Stucky provided their respective questions and comments. Motion: Councilmember Servatius moved to approve Resolution 21-28, allocating $12,000 from the Creative Arts Fund be used for the repair, painting, transportation and installation of the Joseph Kinne- brew sculpture “Meditation” and authorize the Mayor to sign the Agreement for Placement for the sculp- ture known as “Meditation”. The motion was seconded by Mayor Pro Tem Munns and passed unani- mously. Regular Meeting Minutes- December 7, 2021 Page 5 of 7 b. Resolution 21-30 – Lodging Tax Advisory Committee Awards for the 2% Grant Applications Finance Director Goldman introduced Finance & Performance Analyst Chas Webster who reviewed this item for the Council. Analyst Webster included background information and the recommended awards as voted upon by the LTAC Committee. On October 5, 2021, the Oak Harbor City Council approved additional funding of Lodging Tax Funds in the amount of $123,000 to be made available for 2022 grant applications. On October 29, 2021, the Lodging Tax Advisory Committee met to review the applications received for the 2022 grant round. A total of twelve applications were received. Nine applications were selected for recommendation. Mayor Pro Tem Munns and Councilmember Servatius provided their respective questions and com- ments. Motion: Following discussion, Councilmember Servatius moved to adopt Resolution 21-30 approving the Lodging Tax Advisory Committee (LTAC) recommended awards for the 2% Grant annual single year applications for grant year 2022 and authorize the Finance Director to sign the professional ser- vice contracts. Mayor Pro Tem Munns seconded the motion, which carried 5-2 with Councilmembers Servatius and Woessner abstaining. Councilmember Hizon extended thanks to Councilmember Serva- tius for his years of service as Chair of the LTAC Committee. c. Resolution 21-32: Authorizing public sale of abandoned vessel by authorized personnel to the highest bidder – Harbormaster Sublet presented the item noting the vessel had been abandoned by the owner. The owner was notified in accordance to RCW r3.08.320(5) and OHMC 6.36.040(5). Mayor Severns confirmed no public comment was received on this item. Mayor Pro Tem Munns provided her respective questions and comments. Regular Meeting Minutes- December 7, 2021 Page 6 of 7 Motion: Mayor Pro Tem Munns moved to approve Resolution 21-32 authorizing the public sale of an abandoned vessel by authorized personnel to the highest bidder. Councilmember Stucky seconded the item, which carried unanimously. 8. CONTRACTS & AGREEMENTS None 9. OTHER ITEMS FOR CONSIDERATION None 10. REPORTS & ITEMS FOR DISCUSSION a. City Council Calendar for 2022 Mayor Severns noted staff had prepared the City Council Calendar for 2022. A draft was provided for Council comments and questions. Councilmember Hizon provided her respective comments. The Council calendar will be on the December 14th meeting agenda for approval. Councilmembers in- quired about dates for an annual Council retreat meeting. This meeting is at different times each year and is not placed on the annual calendar. Planning is in the works for early 2022. 11.
