Oak Harbor City Council Regular Meeting Minutes October 3, 2023 This was both a physical meeting location and a virtual meeting. Meeting was viewable live via YouTube at www,youtube.com/cityofoakharbor, on Facebook, and on Cable Channel 10/HD 1090 following the meeting CALL TO ORDER Mayor Severns called the meeting to order at 6:00 p.m. Invocation – Father Kyle Logan, Grace by the Sea Anglican Church. He noted Councilmember Woessner was attending virtually and Councilmembers Munns had asked to be excused. Councilmember Hoffmire moved to excuse Councilmember Munns, seconded by Councilmember Wiegenstein. The vote on the motion carried unanimously. 1. APPROVAL OF AGENDA Mayor Severns called for any changes to the agenda. Hearing none, the agenda was approved as pre- sented. 2. PRESENTATIONS Regular Meeting Minutes October 3, 2023 Page 1 of 5 a. Proclamations – i. Proclaiming October 2023 as Oak Harbor Garden Club Month Mayor Severns noted in celebration of their Centennial, it was his honor to proclaim October 2023 as Oak Harbor Garden Club Month. He called on Mayor Pro Tem Hizon to read the proclamation, which highlighted many of the significant contributions of the Garden Club over the past 100 years. Mayor Severns noted it was fitting that next on the agenda was a presentation by the Oak Harbor Garden Club. b. Honors & Recognitions – None c. Community Presentations – i. Oak Harbor Garden Club Centennial Presentation Kathy Chalfant of the Oak Harbor Garden Club provided a presentation highlighting the accomplish- ments of the Club during its 100-year existence, noting that today, October 3rd, 2023 was the exact 100 year anniversary of the Garden Club. Many members of the Garden Club were in attendance. Mayor Severns thanked the Garden Club for their many contributions to the Oak Harbor community. 3. CITIZEN COMMENT PERIOD Mayor Severns noted citizens may comment on Consent Agenda items or subjects of interest not listed on the agenda at this time and that citizens would have the opportunity to comment on the remaining Agenda items during the meeting as appropriate. Citizens can also visit the City’s website prior to meetings for methods to submit public comment, or contact the City Clerk, Julie Nester by phone or email. When submitting comments, please include your name and address. Public comments sent anonymously will be shared with the Mayor and Council but will not be displayed. The City received no new public comments since the last regular meeting. Mayor Severns opened the floor for public comment from any other audience member present. 1. Cheryl Graham, Events and Logistics Manager for the Greater Oak Harbor Chamber of Commerce, requested the City consider adding holes to make it possible for the Lion’s Club and other City event flagpoles to be placed along the sidewalks guiding people to Windjammer Park. Hearing no one else with a desire to address the Council, the public comment period was closed. 4. CONSENT AGENDA Consent Items a. Resolution 23-15: Amending the Master Fee Schedule b. Approval of Minutes of the September 19, 2023 Council Meeting and September 27, 2023 Council Workshop c. Approval of Payroll and Accounts Payable Vouchers d. Janitorial Services Contract Renewal: All Pro Building Maintenance e. Appointment: Planning Commission, Position 7 – Kelly Beedle Regular Meeting Minutes October 3, 2023 Page 2 of 5 f. Appointment: Historia Preservation Commission, Position 1 – Gideon Cauffman, Position 2 – Greg Lanza, Position 3 – Nick Hamden, and Position 4 – Kelly Bugg Mayor Severns called for any changes to the consent agenda. Hearing none, he noted the items were approved as presented. 5. MAYOR, COUNCIL & STAFF COMMENTS a. Mayor - Mayor Severns provided the following comments and updates: • Federal Emergency Management Agency Integrated Public Alert & Warning System National Test: in coordination with the Federal Communications Commission (FCC), FEMA will conduct a national test of the Integrated Public Alert and Warning System tomorrow, Oct. 4, 2023. All major U.S. wireless provid- ers will transmit the national test to their subscribers. The test will help ensure that Wireless Emergency Alerts and the Emergency Alert System continue to be effective ways to warn the public about emer- gencies, particularly those on the national level. If your mobile phone is on and within range of an active cell tower from a participating wireless provider, you should receive the national test at 11:20 a.m. • Paving of West Whidbey Avenue: Paving of West Whidbey Avenue is nearly complete. All that remains to this major project is paving the northern half, which will take place tomorrow, weather permitting, and then the roadway striping. Thank you to City engineering and public works staff. • Garden Club Centennial: Mayor Severns noted it was his privilege to attend and speak at the placing of the Garden Club plaque in Smith Park. • Councilmember Advisory Board Duties: Councilmember Woessner has indicated that he wishes to pass along his ex-officio duties for both the Park Board and the Joint Tourism Advisory Board. Mayor Severns asked Councilmember Marshall to serve on the Park Board and Councilmember Stucky to serve on the Joint Tourism Advisory Board and both have accepted. • City Administrator Oborn at ICMA Conference: City Administrator Blaine Oborn is attending the Inter- national City/County Management Association (ICMA) Annual Conference for local government man- agement professionals. This 4-day conference focuses on providing attendees with the tools and sup- port they need to make their communities a better place to live, work, and play. • October is Anti-Bullying Month: The Pacers National Bullying Prevention Center will be placing orange banners along Highway 20 to commemorate Unity Day, from October 7th to October 15th. • Upcoming Events: Additional upcoming events were displayed on screen. b. Councilmembers Council Comments – Mayor Pro Tem Hizon encouraged all residents to visit the Island County Emer- gency Management website and to download the “Island Ready” APP to sign up for alerts. She also noted she would like to have Eric Brooks from Emergency Management give a presentation at a future Council workshop. Mayor Severns asked Chief Merrill to reach out to Mr. Brooks. i. Consideration of Joint Meeting with the Planning Commission – October 24, 2023 at 6:00 p.m. Mayor Severns noted the item for Council consideration on the agenda, to determine a quorum for hold- ing the next Joint Meeting with the Planning Commission. Staff has received three confirmations of availability and one response of inability to attend from the Council. Mayor Severns noted staff would Regular Meeting Minutes October 3, 2023 Page 3 of 5 like to to determine the availability of a quorum and receive Council approval to add this meeting to their calendar, if they so desired. This date is a regularly scheduled Planning Commission meeting. Mayor Severns confirmed there had been no input from the public on this item. He called upon the Council for comments and hearing none, Motion: Councilmember Hoffmire moved to hold a joint meeting – special Council workshop - with the Planning Commission on Tuesday, October 24, 2023 at 6:00 p.m. Seconded by Councilmember Mar- shall. The vote on the motion carried unanimously. 6. PUBLIC HEARINGS & MEETINGS a. Brewer Request for Annexation, 860 Quail Lane, Parcel R13327-01604469. 2.5 Acres Development Services Director Kuhl reviewed the item. Carl and Laura Brewer, owners of parcel R13327-016-4460, have requested that the parcel not be annexed into Oak Harbor city limits. The prop- erty is within the city’s urban growth area (UGA) and is 2.5 acres of land located at 860 Quail Lane contiguous to the city limits. The property is located north of NE 16th Street. The property’s assessed value is $110,000. Director Kuhl explained the City does not allow housing north of NE 16th, within the UGA, therefore, the County is the only agency that can approve a house in that location. The applicant has requested denial of the annexation in order to pursue action with the County. This parcel is the last undeveloped lot of 16 in the subdivision. Without county approval, the lot would be unbuildable for residential use. RCW 35A.14.120 requires the City Council to convene a meeting with the initiating party within 60 days after the filing of the notice of intent. The City Council must decide at this meeting: 1) whether it will accept, reject, or geographically modify the proposed annexation; 2) whether it will require adoption of zoning simultaneously with annexation; and 3) whether it will require annexed properties to share City indebtedness. Mayor Severns opened the Public Hearing. He confirmed the City had received no comments. Mr. Carl Brewer addressed the Council to explain that his application to the County prompted a neces- sary review for annexation by the City. He requested the City reject any annexation so that he and his family can pursue action for a building permit with the County. Hearing no one with a desire to address the Council, the public hearing was closed. Mayor Severns called upon the Council for their comments. Mayor Pro Tem Hizon provided her respective comments. Motion: Councilmember Stucky moved to deny the annexation of 2.5 acres of property located at 860 Quail Lane, seconded by Councilmember Wiegenstein. The vote on the motion carried unanimously. 7. ORDINANCES & RESOLUTIONS None 8. CONTRACTS & AGREEMENTS None Regular Meeting Minutes October 3, 2023 Page 4 of 5 9. OTHER ITEMS FOR CONSIDERATION a. Approval for the Mayor to sign a Letter of Submittal for a Law Enforcement Pursuit Technology Grant Police Slowik reviewed the item, which provided an opportunity to apply for a Washington State Depart- ment of Commerce Law Enforcement Pursuit Technology Grant. The Department of Commerce has released a Request for Proposal to law enforcement agencies to offer funding to purchase modern ve- hicle pursuit technology, provide training for officer to use the technology, and enhance data sharing between agencies and other third parties. Up to $50,000 is available for agencies with 1-50 law enforce- ment officers. The Oak Harbor Police Department currently has 28 sworn officers, with a 29th just ap- proved by council at the September 5, 2023 meeting. Captain Slowik explained the Department would like to request funding to purchase vehicle pursuit tech- nology that is not currently included in its budget. Training for officers to safely and appropriately use the technology will be included in the grant request. The purpose of using modern technology is to provide tools and alternatives to high-speed pursuits, thus enhancing the safety for all involved in pur- suits, including bystanders. The Oak Harbor Police Department would receive up to $50,000 in funding from the Department of Commerce for technology and training currently not in the department's budget. There is no matching requirement for this grant. Mayor Severns confirmed there had been no input from the public on this item. He called upon the Council for comments. Councilmembers Stucky, Hoffmire and Mayor Pro Tem Hizon provided their respective questions and comments. Motion: Councilmember Wiegenstein moved to approve authorizing the Mayor to sign a Letter of Sub- mittal to the Washington State Department of Commerce for the Law Enforcement Pursuit Technology Grant Program. The motion was seconded by Mayor Pro Tempore Hizon and passed unanimously. 10. REPORTS & DISCUSSION ITEMS None 11. EXECUTIVE SESSION None. Adjourn Motion: There being no further business, Councilmember Wiegenstein moved to adjourn, seconded by Councilmember Stucky.
