REGULAR MEETING MINUTES OAKDALE CITY COUNCIL June 13, 2023 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on June 13, 2023, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Kevin Zabel at 7:00 PM. No comments were heard. Mayor Zabel closed the public hearing. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER HER TO APPROVE ISSUANCE OF SECONDHAND GOODS DEALER LICENSES TO THE FOLLOWING BUSINESSES; GOLF CARTS OF MN LLC, A RISING STAR, AND GAMERELATED UPON BACKGROUND CHECK CLEARANCE FOR ALL APPLICANTS. 5 AYES OPEN FORUM a) Proclamation: Parkview Chiropractic Day Mayor Zabel proclaimed June 3rd as “Parkview Chiropractic Day”. b) Proclamation: Oak Meadows Senior Living Day Mayor Zabel proclaimed June 15th as “Oak Meadows Senior Living Day”. Mayor Zabel invited comments from the audience. No comments were heard. CONSENSUS MOTIONS a) Request that the City Council waive reading and adopt Ordinance No. 899, amending the Code of Ordinances for the City of Oakdale, Chapter 9, Article 15, relating to licensing for ice cream vendors. b) Request that the City Council waive reading and adopt Resolution 2023-58, authorizing publication of Ordinance No. 899, by title and summary. c) Request that the City Council waive reading and adopt Ordinance No. 898, amending the Code of Ordinances for the City of Oakdale, Chapter 10, Article 2, relating to regulations of certain licenses. d) Request that the City Council waive reading and adopt Resolution 2023-38, authorizing publication of Ordinance No. 898, by title and summary. e) Request per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Brody Laska and Christian Darwin as Public Works Seasonal Workers with an effective date of June 14, 2023, at a rate of pay equal to $16.00/hour. 2  f) Request that the City Council approve the issuance of a Tobacco Sales License for the current term to expire on December 31, 2023, and a THC Product Sales License for the current term to expire on June 30, 2024, upon clearance of the background check by the Police Department and all conditions/requirements of the licenses are met. g) Request that the City Council approve the noise variance requested by MSS (Midwest Special Services, Inc.) for the date of August 17, 2023 with the condition that MSS abides by City Code, Chapter 19, Sec 19-04 (a) and the NAC 1 classification that is set forth from the Minnesota Pollution Control Agency. h) Request that the City Council approve the noise variance requested by Shekinah Church for the date of July 8, 2023 with the condition that Shekinah Church abides by City Code, Chapter 19, Sec 19-04 (a) and the NAC 1 classification that is set forth from the Minnesota Pollution Control Agency. i) Request that the City Council authorize the Mayor and City Administrator to approve and execute a revised agreement with Hugo’s Tree Care for tree stump removal services in the amount of $41,568.75. j) Request that the City Council authorize the Mayor and City Administrator to sign the Development Agreement for Oakdale Commons/Tartan Crossing 5th Addition. k) Request that the City Council acknowledge receipt of the 2022 Annual Comprehensive Financial Report. l) Request that the City Council waive reading and adopt resolutions 2023-62, 2023-63, and 2023- 64, declaring the intent to reimburse certain expenditures from the proceeds of bonds to be issued by the City for the 2023 Street Reconstruction Project, Willowbrooke Trail Project, and Willowbrooke Open Space Project. m) Request that the City Council waive reading and adopt Resolution 2023-61, Approving the Memorandum of Agreement between the City of Oakdale and the Law Enforcement Labor Services (LELS) Employee’s Union, Local 197 (Patrol Officers), Relating to Health Care Savings Plan (HCSP) Participation, for the period through December 31, 2024. n) Request that the City Council approve the renewal of the Secondhand Goods Dealer license to Guitar Center Stores, Inc. dba Guitar Center Store #394, 8316 3rd Street North, for the license period of one year from the issuance date. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER MORCOMB, TO APPROVE CONSENSUS MOTIONS A-N, AS PRESENTED. 5 AYES ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (6/7/23 meeting cancelled, Council Liaison Her) Environmental Management Commission (no meeting, Council Liaison Zabel) Planning Commission (met on 6/1/23, Council Liaison Ingebrigtson) 3  Council Member Ingebrigtson reported that the Planning Commission voted on a conditional use permit for an additional accessory structure; amending the Willowbrooke PUD to allow accessory apartments as accessory uses on certain single-family homes; and provided a recommendation for the Glenbrook Small Area Plan Alternates. Parks and Recreation Commission (no meeting, Council Liaison Morcomb) Tree Board (no meeting, Council Liaison Olson) AWARD OF BID None STAFF REPORTS POLICE a) Donation to the City – Police Department, from Hyundai Motor America Police Chief Nick Newton explained that due to increased targeted car thefts in the City, specifically Kia’s and Hyundai’s, the Police Department reached out to both companies to find out details about the steering wheel lock program. Hyundai Motor America generously donated 120 steering wheel locks to be distributed to Hyundai owners living in the City. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER WILLENBRING TO WAIVE READING AND ADOPT RESOLUTION 2023-65, ACCEPTING A DONATION FROM HYUNDAI MOTOR AMERICA FOR 120 STEERING WHEEL LOCKS. 5 AYES CITY ATTORNEY No report ADMINISTRATOR'S REPORT a) Amend City Policy MIS-011: Training and Education Reimbursement for Elected Officials City Administrator Chris Volkers explained the reasoning for the proposed changes to City Policy MIS-011. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER HER TO APPROVE THE PROPOSED CHANGES TO CITY POLICY MIS-011: TRAINING AND EDUCATION REIMBURSEMENT FOR ELECTED OFFICIALS. 5 AYES COUNCIL PRESENTATIONS Council Member Morcomb noted that ice cream trucks are now able to operate in the City. 4 Mayor Zabel made announcements about the following: • City offices will be closed on Monday, June 19th, in observance of Juneteenth. • Voting for the six Oakdale Spring Photo Contest finalists is now taking place on the City’s Facebook page through June 30th. • Residents can submit nominations for the Acorn Award through the City’s website until June 30th. • Summerfest kicks off on Monday, June 19th at 8 AM with the Medallion Hunt. Clues will be posted on www.oakdalesummerfest.com each day at 8 AM. • Summerfest events will be June 22nd – 26th. More information and the full schedule can be found at www.oakdalesummerfest.com.
