REGULAR MEETING MINUTES OAKDALE CITY COUNCIL July 11, 2023 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on July 11, 2023, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Kevin Zabel at 7:00 PM. Mayor Zabel invited comments from the audience. Michelle Sensburg, 3748 Gershwin Ave N, noted a goose population problem in her backyard and referenced City Policy MIS-002: Canada Goose Management Plan. She requested the City obtain a permit from the MN DNR to take measures to curb the goose population, and volunteered her time to help with her request. Mayor Zabel read comments from an online submission of the City Council Open Forum Request to Speak Form, submitted by Cody Bolinkse, 3816 Hallmark Ave N., regarding an interest in an automated camera system that can detect loud vehicles and issue tickets to the owners. Mayor Zabel noted that all comments made during Open Forum are referred to City staff for further research and follow up. CONSENSUS MOTIONS a) Request that the City Council approve an amendment to the previously approved motion, correcting the contract amount for the official record from $1,562,000 to $1,588,000, as reflected in the signed and executed agreement for Design Construction Documents, and Construction Administration for City Project B2024-01; Public Works New Facility, with Hagen, Christensen & Mcllwain Architects. b) Request per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Nate Burlingame as a probationary full-time Engineering Technician at a rate of pay consistent with the City base pay schedule, conditioned on successful completion of all preemployment screening. c) Request per City Code, Chapter 2, Article IV, Sec.2-36 (c) and per City Personnel Policy PE-031, Section 5.0, that the City Council appoint Lisa Roth as full-time probationary Police Records Technician at a rate of pay consistent with the City base pay schedule, conditioned on successful completion of all preemployment screening. d) Request that the City Council approve the renewal and issuance of a Secondhand Goods Dealer License to Best Buy for the license period of August 10, 2023 to August 10, 2024, conditioned on passing their background check from the Police Department. 2  e) Request that the City Council waive reading and adopt Resolution 2023-71, authorizing the disbursement of Charitable Gambling contributions to Oakdale Summerfest Community Organization in the amount of $8,500 and approving the associated budget amendment. f) Request that the City Council approve the noise variance, temporary on-sale liquor license, and charitable gambling application for Guardian Angels Catholic Church’s event to be held on the dates of September 15 and 16, 2023 at their location, 8260 4th Street North. g) Request that the City Council approve the temporary on-sale liquor license and noise variance for Transfiguration Church event to be held on August 6, 2023 at their location, 6133 15th Street N. A MOTION WAS MADE BY COUNCIL MEMBER MORCOMB, SECONDED BY COUNCIL MEMBER HER TO APPROVE CONSENSUS MOTIONS A-G, AS PRESENTED. 4 AYES ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (no meeting, Council Liaison Her) Environmental Management Commission (no meeting, Council Liaison Zabel) Planning Commission (met on 7/6/23, Council Liaison Ingebrigtson) Mayor Zabel noted that due to Council Member Ingebrigtson’s absence, he will report on the 7/6/23 Planning Commission meeting at the next City Council Regular meeting. Parks and Recreation Commission (no meeting, Council Liaison Morcomb) Tree Board (no meeting, Council Liaison Willenbring) AWARD OF BID None STAFF REPORTS COMMUNITY DEVELOPMENT a) Amendment to the Willowbrooke Planned Unit Development to Allow Accessory Dwelling Units as Accessory Uses on Certain Single-Family Lots Community Development Director Andrew Gitzlaff addressed the Council by stating this is a request from the Lennar Corporation to allow their “NextGen” model on certain single-family residential lots located within the Willowbrooke PUD. He noted the Planning Commission’s recommendation, and the public hearing that took place at the June 27, 2023 City Council meeting. 3  In response to Council Member Morcomb’s question about the rental restriction remaining in place even if the property is sold in the future, Mr. Gitzlaff confirmed that the rental restriction applies to the identified single-family residential lots, not individual homeowners. Mayor Zabel explained that he will be voting ‘no’ on this request due to a concern he expressed during the June 13, 2023 City Council workshop meeting. His objection relates to how these specific homes are treated differently than other accessory dwelling units within the City, in terms of the rental licensing ordinance. A MOTION WAS MADE BY COUNCIL MEMBER WILLENBRING, SECONDED BY COUNCIL MEMBER HER TO WAIVE READING AND ADOPT ORDINANCE 902, APPROVING AN AMENDMENT TO THE WILLOWBROOKE PUD TO ALLOW ACCESSORY DWELLING UNITS AS ACCESSORY USES ON CERTAIN SINGLE-FAMILY RESIDENTIAL LOTS. 3 AYES 1 NAY – ZABEL ENGINEERING a) Accept the Petition for Turn Lane Improvements, Amend the Assessment Roll for City Project R2023- 01; 2023 Street Reconstruction, and Amend the 2023 Budget to include the Additional Assessment City Engineer Jesse Farrell explained that the developer has submitted a petition for turn lane improvements which requires the City to amend the assessment roll for City Project R2023-01: 2023 Street Improvements, and amend the 2023 budget. A MOTION WAS MADE BY COUNCIL MEMBER MORCOMB, SECONDED BY COUNCIL MEMBER WILLENBRING TO WAIVE READING AND ADOPT RESOLUTION 2023-69, ACCEPTING THE PETITION TO INCLUDE THE TURN LANE IMPROVEMENTS, AMENDING THE ASSESSMENT TO PARCEL 170292142003 (LOT 4 BLOCK 1 OF THE OAKDALE FARM 3RD ADDITION) FROM $110,104 TO $168,104, AND AMENDING THE 2023 BUDGET TO INCLUDE THE ADDITIONAL ASSESSMENT. 4 AYES CITY ATTORNEY No report ADMINISTRATOR'S REPORT No report COUNCIL PRESENTATIONS Mayor Zabel made announcements about the following: • Thank you to everyone who helped with Summerfest this year, especially the Oakdale Summerfest Community Organization (OSCO). • Ladders and Squads will take place this Thursday, July 13th from 5:30 – 8:00 PM at the North Fire Station. The event features vehicles and equipment used by Oakdale Firefighters and Police Officers. • The Oakdale Farmers Market continues every Wednesday from 2:00 – 6:00 PM in the City Hall parking lot through mid-October. 4  • On select Wednesdays throughout the summer, residents are invited to bring lawn chairs to the Walton Park Bandshell for the Summer Concert Series. This Wednesday, July 19th at 7 PM, The Capri Big Band will be performing live music. • Friday, July 21st is the City’s first Movie in the Park of the season. Puss in Boots: The Last Wish will be shown at the Walton Park Bandshell at dusk. Residents can bring lawn chairs and blankets to enjoy this free movie under the stars on the big screen. This event is sponsored by Oakdale Recreation and the Police Department. • Night to Unite is three weeks away on Tuesday, August 1st. Residents should register on the City’s website by Friday, July 21st, if they plan to host an event.
