REGULAR MEETING MINUTES OAKDALE CITY COUNCIL August 8, 2023 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on August 8, 2023, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Kevin Zabel at 7:02 PM. Mayor Zabel invited comments from the audience. No comments were heard. CONSENSUS MOTIONS a) Request that the City Council repeal City Policy EPB-022: Oakdale First. b) Request that the City Council waive reading and adopt Resolution 2023-78, accepting the Auto Theft Prevention Grant funds in the amount of $56,917 from the Minnesota Department of Commerce, and authorizing the City Administrator to execute the Minnesota Auto Theft Prevention Grant agreement. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER HER TO APPROVE CONSENSUS MOTIONS A & B, AS PRESENTED. 5 AYES ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (met on 8/2/23, Council Liaison Her) Council Member Her reported that the Economic Development Commission provided updates on the Gold Line Bus Rapid Transit project construction timeline. Also, the City has a map of the current development projects on its website. Lastly, the City has put together a business resources page on its website for Oakdale businesses to use to get started, save on costs, and operate more efficiently. Environmental Management Commission (no meeting, Council Liaison Zabel) Planning Commission (met on 8/3/23, Council Liaison Ingebrigtson) Council Member Ingebrigtson reported that three items were discussed. The first was a conditional use permit for a home occupation (sales of hatching eggs/chicks). The second was a conditional use permit for an additional accessory structure. The last item was a planned unit development amendment, preliminary plat, final plat, and site plan approval. Parks and Recreation Commission (no meeting, Council Liaison Morcomb) Tree Board (no meeting, Council Liaison Willenbring) 2 AWARD OF BID None STAFF REPORTS ENGINEERING a) Authorizing a noise variance to allow Miller Excavating Inc. to work from 7:00 p.m. to 7:00 a.m. from Monday, August 14, 2023 through Friday, September 1, 2023 for City Project R2023-01; Street Reconstruction City Engineer Jesse Farrell explained that the contractor for City Project R2023-01, Miller Excavating Inc., has requested a noise variance to allow work between the hours of 7:00 p.m. to 7.00. a.m., August 14, 2023 through September 1, 2023. The request is to allow night work on 56th Street near Fleet Farm to complete the reclaiming, sanitary utilities, and paving operations. Night work is necessary to avoid negative impacts to the public and Fleet Farm. Even though the request is for three weeks, Miller anticipates completing the work in approximately four to five overnight shifts, weather dependent. The duration of the request is to accommodate inherent uncertainty due to weather. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER WILLENBRING TO APPROVE THE NOISE VARIANCE REQUESTED BY MILLER EXCAVATING INC. TO ALLOW CONSTRUCTION ACTIVITIES FROM 7:00 P.M. TO 7:00 A.M., AUGUST 14, 2023 THROUGH SEPTEMBER 1, 2023 FOR CITY PROJECT R2023-01 AT 56TH STREET NEAR FLEET FARM. 5 AYES CITY ATTORNEY No report ADMINISTRATOR'S REPORT a) Amend City Policy MIS-019: Donations to Parks; Memorials in Parks; Installation, and Maintenance; Naming of Parks, Facilities, and Events City Administrator Chris Volkers addressed the Council stating that the addition to this policy will document the statutorily-required procedure, that the City has already been following, when accepting donations. A MOTION WAS MADE BY COUNCIL MEMBER HER, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO APPROVE THE PROPOSED CHANGES TO CITY POLICY MIS-019: DONATIONS TO PARKS; MEMORIALS IN PARKS; INSTALLATION, AND MAINTENANCE; NAMING OF PARKS, FACILITIES, AND EVENTS. 5 AYES b) Amend City Policy PE-008: Dress Code and rename as City Policy PE-008: Appearance Ms. Volkers addressed the Council stating that the edits to this policy will update it to align with current business casual standards. Additionally, she noted that the proposed and final versions in the uploaded packet have been slightly changed and were provided to the Council on the dais. She read the updated language in Section 2.4. 3 A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER HER TO AMEND CITY POLICY PE-008: DRESS CODE AND RENAME IT PE-008: APPEARANCE. 5 AYES COUNCIL PRESENTATIONS Council Member Her expressed his enjoyment in participating in his first Night to Unite event in the City. He thanked all the neighbors who hosted a party, and he thanked the public safety staff who visited the parties as well. Mayor Zabel made announcements about the following: • Thank you to the residents and City staff who participated in the Night to Unite event. • The Oakdale Police Department has announced a new partnership with Foundrop, a free service that helps owners recover lost and stolen property. More information can be found on the City’s website. • The City’s first ever Pop-Up Splash Pad is taking place on Friday, August 11th from 1:00 – 3:00 PM at the Oakdale Athletic Association parking lot at Walton Park. • On Sunday, August 13th from 1:00 – 3:00 PM, the Oakdale Wellness 50+ group is hosting a Summer Social at the Oakdale Nature Preserve Pavilion. • The next movie in the park will feature Minions: The Rise of Gru on Friday, August 18th at dusk at the Walton Park Bandshell. • Summer photo submissions are being accepted until August 31st for the Oakdale Summer Photo Contest. More information can be found on the City’s website. CLAIMS A MOTION WAS MADE BY COUNCIL MEMBER HER, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO APPROVE CLAIMS FOR THE PERIOD JULY 26, 2023 TO AUGUST 8, 2023, IN THE AMOUNT OF $1,464,294.91. 5 AYES CLOSED SESSION A MOTION WAS MADE BY MAYOR ZABEL, SECONDED BY COUNCIL MEMBER INGEBRIGTSON TO GO INTO CLOSED EXECUTIVE SESSION WITH THE CITY ATTORNEY PURSUANT TO MINN. STAT. 13D.05 SUBD. 3(B) TO DISCUSS MATTERS PROTECTED BY THE ATTORNEY-CLIENT PRIVILEGE RELATING TO THE CONTESTED CASE MATTER PENDING BEFORE THE OFFICE OF ADMINISTRATIVE HEARINGS ENTITLED “IN THE MATTER OF AMENDMENTS TO VARIOUS APPROPRIATION PERMITS, OAH MASTER DOCKET NO. OAH 8-2002-3773. 5 AYES City Attorney Jim Thomson noted that the closed session would be held in the Hadley Conference Room, and the Regular City Council meeting would be adjourned from there after the closed session. The City Council went into closed session at 7:22 PM.
