Page 2 of 6 MINUTES Ocean Shores Planning Commission Regular Meeting Tuesday, 1/11/2022 – 2:00 p.m. Ocean Shores Library and On-line meeting using Zoom meeting software Minutes taken by Commissioner Cox 1. Call to Order Chair Dan Bricker called the meeting to order at 2:00 p.m. 2. Roll Call Planning Commissioners present: Dan Bricker, Greg Cox, Eleanor Dorman, Richard Wills, Pat Brunstad (via Zoom), and Gary Pease Planning Commissioners absent: • None. City Staff present: City Clerk, Sara Logan 3. Approval of Meeting Agenda Commissioner Wills moved to amend agenda after Chair Bricker asked to amend the meeting agenda, regarding election of Officers. Commissioner Brunstad seconded the motion. The motion passed unanimously. Commissioner Wills moved to amend agenda regarding PC meeting location during tax season. Commissioner Dormanseconded the motion. The motion passed unanimously. Commissioner Dorman moved to approve amended agenda. Commissioner Brunstad seconded the motion. The motion passed unanimously. 4. Approval of Minutes Commissioner Wills moved to approve the amended meeting minutes from Thursday, 12/16/2021. Commissioner Pease seconded the motion. The motion passed unanimously. Commissioner Wills volunteered he had revised the new PC Minutes template for other Commissioner’s use. 5. Public Comments No public comments 6. Reports: No reports 7. Commissioner Dorman recommended Commissioner Cox as Chair. Commissioner Wills recommended retaining Commissioner Bricker. Commissioner Brunstad seconded. Commissioner Bricker selected as Chair 3 to 2. 3. Commissioner Dorman recommended Commissioner Cox as Vice-Chair. Commissioner Wills recommended Commissioner Brunstad. Commissioner Brunstad selected Vice-Chair 3 to 2. 4. Chair Bricker informed the PC that the new priority was to answer the question about whether permanent membrane structures should be permitted in Ocean Shores, based on the distributed pre- work? 5. Commissioner Dorman moved to discourage permitting permanent tent-like structures in OS, but to continue to support the Executive Order regarding such during the pandemic. Commissioner Cox seconded. Motion passed unanimously. 6. Chair Bricker suggested PC itemize rationale. Commissioner Wills motioned such. Commissioner Pease seconded. Motion passed unanimously. 7. PC itemized the following reasons for prohibiting permanent tent-like structures in OS: • Aesthetics • Does not conform to vision for B-zoning in Comp Plan • May create an unequitable/unfair situation for other brick and mortar establishments 8. Commissioner Wills volunteered to produce the draft recommendation to the Council for discussion at next PC meeting. 9. The library meeting room is unavailable from February 4th through April 30, 2022 as the library meeting room is reserved for income tax filing assistance. City Clerk is looking for alternative meeting sites on behalf of the Planning Commission. 9. Members of the Commission Reports • None 10. Secretary for Next Meeting Chair Dan Bricker appointed Commissioner Wills as secretary for the 1/25/2022 Meeting. 11. Future Meetings Next meeting is at 2:00 p.m. on 1/25/2022. 12. Dear Mayor Martin, During our regular meeting on 11 January 2022 the Planning Commission addressed the feasibility of allowing tents / membrane structures in any of the business districts in the city of Ocean Shores. Unanimously, the Planning Commission recommends that permanent tents / membrane structures not be allowed anywhere in any business district in the city of Ocean Shores. Also, unanimously, Planning Commissioners agree that Mayor Dingler’s executive order to temporarily allow restaurants and taverns the opportunity to use tents / membrane structures during the Covid 19 pandemic was and continues to be an excellent decision. The members of the Planning Commission are pleased that you have indicated that you are in no hurry to rescind that executive order. We do feel that these structures can be appropriate during specific events or holidays which current code already addresses. The following reasons are submitted in support of the Planning Commission’s recommendation to not allow permanent use of tents / membrane structures anywhere in any B-1, B-2, or B-3 business zone: • Appearance: o Although the existing membrane structure on Ocean Shores Blvd is a good-looking structure as far as tents go, in general, tents or membrane structures do not fit any downtown vision expressed during any city council meeting over the previous several years. o Both visitors and residents deserve a more aesthetically pleasing impression than provided by permanent tents / membrane structures scattered anywhere in our business districts. • Allowing permanent use of tents / membrane structures would give an unfair competitive advantage to those establishments and would not be fair to existing brick and mortar businesses. Page 5 of 6 made significant infrastructure investments whenever permanent occupancy capacity has been increased. I think we should stop after investments. • The Planning Commission has concerns regarding whether or not the increased occupancy provided by using a tent or membrane structure can meet minimum ADA compliant parking regulations. Note: Concerns have been raised during city council discussions about the construction standards of tents / membrane structures. No new code needs to be written to address standards for membrane structures or tents. Ocean Shores Municipal Code Title 15 Buildings and Construction has adopted elements of both the International Building Regulations and International Fire Regulations by reference. Chapter 31 of the International Fire regulations specifically establish standards for membrane structures / tents to be used for periods of 180 days or less. Chapter 31 of the International Building Regulations establish specific standards for membrane structures / tents intended to be use for more than 180 days.
