Committee-Of-The-Whole Meeting Minutes August 21, 2018 Mayor Nold called the Committee-of-the-Whole meeting to order at 6:24 PM. Members Present: Aldermen Rosek, Shaw, Ellis, Spiegelberg, Zwart, Strey (arrived 6:45 PM), Kowieski and Miller Staff Present: Mayor Nold, Kitsembel, Freber, Pickart, Sullivan, Golz, Gallo, Kelliher, Buerger, Duffy, Frye, Osborn, Schuh and Coenen Others Present: Atty Riffle 2. Discussion on Reclassifying Uses that Require a Conditional Use Permit in the Zoning Code Gallo gave a Power Point Presentation explaining that Legislative Act 67 was recently adopted on the process of reviewing and approving Conditional Use Permits (CUP.) What this means is the City must create measurable standards for each CUP in our zoning code to be used during the public hearing by Council to determine if substantial evidence was presented by the applicant to permit the use. To comply with this new law, Council needs to determine first which uses should remain CUP’s; and then create the measurable standards for those uses. Next Gallo went over each of our zoning districts and the forty uses that currently require a CUP. There was discussion on which CUP’s should be reclassified to permitted-by- right uses or removed, and it was determined to eliminate twenty-eight uses as requiring a CUP. The C-O- T-W requested Gallo provide a revised list of the remaining twelve uses requiring a CUP along with suggested measurable standards at the next meeting. Motion by Miller to adjourn the Committee-of-the-Whole meeting; second by Kowieski. Motion carried 8-0. The meeting adjourned at 7:04 PM.
