Mayor Magnus called the Committee-Of-The-Whole Meeting to order at 6:00 PM.
Committee Business
a. Closed Session - Convened in Conference Room 3
Motion to convene into Closed Session Per Wis Stats 19.85 (1)(c) Considering employment,
promotion, compensation or performance evaluation data of any public employee over which the
governmental body has jurisdiction or exercises responsibility regarding Interim Utility Manager
Appointment made by Schellpeper and seconded by Aultman Kloth. Motion carried 8-0-0.
Closed Session convened at 6:03 PM.
Motion to adjourn Closed Session and reconvene into Open Session made by Spiegelberg and
seconded by Aultman Kloth. Motion carried 8-0-0. Closed Session adjourned at 6:35 PM.
Open Session reconvened in Council Chambers at 6:40 PM.
b. Discussion on Maintenance Options for Concord Road
Herzog gave a PowerPoint presentation on potential reconstruction options for Concord Road that are not
included in the proposed 2024 Budget. Council had questions on the ten-year road plan and Herzog will send it to
the Aldermen.
c. Review/Discuss "Class B" Liquor Licenses
Coenen suggested allowing approval for “Class B” licenses conditioned upon receiving occupancy within ninety
days instead of the thirty days we have been giving. The last three “Class B” licensees were new builds and
faced delays to open their business because of delivery issues, out-of-stock issues, contractor issues, etc. By
allowing additional time, it would avoid the licensee from returning monthly if they were not ready to open. As has
been our policy, the Clerk would not issue the license until occupancy was approved by the City Building
Inspector, which means the licensee can open at any time.
d. Discussion/Overview of the 2024 Budget Proposal
Sullivan-Murray gave a PowerPoin presentation and handed out 2024 Budget Workbooks, her
PowerPoint presentation and a memo providing a high-level overview of the budget. Our first
budget workshop will be on Thursday, October 5th at 6:00 PM and she will address Council’s
questions including the topic of having annual property revaluations, the benefits and reasons why
we do it this way. Magnus asked her to provide a few examples of how it works.

Re: Concord Rd Maintenance Options
RELATES TO THE STRATEGIC PLAN
Strategic Goal-II Improve and Maintain Our Infrastructure/Facilities; B Maintain our Existing Infrastructure
BACKGROUND
A short description of the road improvements for Concord Rd were presented at the last committee of the
whole meeting on September 5th. This will provide additional information for discussion.
Due to the failing pavement condition, the 1.25 mile stretch of Concord Rd is in need of replacing. There
are a few options to review and due to the large cost involved, further discussion is needed for providing staff
direction.
The stretch of pavement under consideration is a mixture of cross sections and results in different rehab
options. For reference, it is broken down into 3 different sections, please also see Exhibit A for map locations.
Section 1 – Second St to the Lincoln St Bridge
Rehab recommended – remove & replace existing pavement.
Option – none
Section 2 – Lincoln St Bridge to Allen Rd
Rehab recommended – remove & replace existing pavement with minor improvements directly
West of Bridge.
Option – Reconstruct (remove pavement and base) to add in curb and storm.
This could be installed to provide additional protection to the existing trail adjacent to the
road. Additional storm sewer would need to be added.
Section 3 – Allen Rd to South side of Riverdale Dr
Rehab recommended – remove & replace with minor improvements outside of the pavement area.
Option – add an off the street trail.
Extreme challenges to install a trail outside of the street area. There are serve grading
needs that will require long stretches of retaining walls, adjustments to private retaining walls,
utility relocations, and private property obstructions.

Below is a table to summarize each of the sections and options.

The main recommended project scope would be to improve Concord Rd from Second St to Riverdale Rd
by replacing existing pavement, improving area West of Lincoln St Bridge, fixing existing storm sewer and other
existing surface infrastructure. The cost of this work is estimated to be $1,500,000.00. There will be other utility
improvements funded separately.
There are two options identified as potential for including in the scope of work if agreed on. Funding
would have to be added to the 2024 budget on the options.

Re: Issuance of “Class B” Liquor Licenses

BACKGROUND
At the August 1, 2023 Common Council meeting, Council requested to have a future meeting to discuss the
issuance of “Class B” Intoxicating Liquor/Fermented Malt Beverage licenses.
There are no State Statutes requiring a license be issued within a certain timeframe once applied for, however we
developed an internal procedure and a Best Use Criteria guideline years ago because the City had one or no
“Class B” licenses available and many that were issued but not in use.
The past practice of granting a “Class B” license has been on the condition the Clerk not-issue the license until
occupancy is granted, but no later than thirty days. If occupancy is not granted, the applicant would need to
come back to Council for reapproval.
ADDITIONAL ANALYSIS
The last three licenses granted were for new-builds and due to contractor scheduling issues, delivery delays,
damaged items and out-of-stock items, I had requested forty-five or more days to allow the business to get
occupancy and have an opening date.
Rethinking the issues businesses are having since Covid, and their investment in a new-build and in our
community, it is reasonable to allow for 60 – 90 days for a business to open. By allowing additional time, the City
still maintains control of the license because the Clerk would not issue it until they were ready and if not ready,
they would have to come back to Council for reapproval.

RECOMMENDATION
When a business owner invests in a liquor licensed establishment, it is reasonable for them to look for a
guarantee from the City that a license is available. My recommendation as stated above is reasonable to give
them the confidence that a license will be granted if they meet all Chapter 12 and State Statute requirements.
