February 21, 2017
Chairman Rosek called the meeting to order at 6:30 PM.
Members Present: Aldermen Rosek, Schmidt and Strey
Staff Present: Mayor Nold, Kitsembel, Gallo, Frye, Pickart, Buerger, Sullivan, Duffy, Kelliher and
Coenen
Others Present: Alds. Zwart, Shaw, Gross and Miller; and Atty. Riffle
2. Discussion on “Class B” Liquor Licensing:
As a continuation of the last several meetings the Committee had on licensing issues, Coenen distributed
two draft documents; “Class B” Intoxicating Liquor/Fermented Malt Beverage Establishments Best and
Highest License Use Criteria” that outlined criteria for types of businesses where a license would be used,
seating capacity, food served, premise, code compliance, percentage of intoxicating liquor sales and
number of employees; and sections of 12.04 of the Municipal Code regarding Numbers (4) and (5) that
highlighted potential changes and a new section for discussion purposes.
The Committee discussed best use criteria for issuing a liquor license as well as code revisions.
Discussion included non-use or minimal use of a license, revocation, non-renewal, factors to consider as
part of revocation such as economic investment by a license holder, changing commencement of business
to 180 days with the option to extend another 90, having an automatic review for revocation if a business
ceases for a period of 90 days, procedures for licenses that have been granted but are not to be issued
until the business has a definite opening date, and during licensing renewal requiring a licensee to provide
their liquor sales percentage of their total sales. The Committee decided not to have a formal policy on
best use criteria but did decide to revise the code to allow businesses 180 days to commence.
Motion by Strey to adjourn; second by Schmidt. Motion carried 3-0. The meeting adjourned a 7:06 PM.

noticed as such, although the Common Council will not take any formal action at this
meeting.
