Protection & Welfare Committee Meeting Minutes May 1, 2018 Chairman Rosek called the meeting to order at 6:55 PM. Members Present: Aldermen Rosek and Shaw Staff Present: Mayor Nold, Kitsembel, Kelliher, Freber, Gallo, Buerger, Duffy, Frye, Osborn and Coenen Others Present: Alds. Zwart, Kowieski, Ellis, Strey and Miller, and Atty. Riffle 2. Discussion on Creating §12.05 of the Municipal Code Regarding Public Possession of Open Intoxicants: Kelliher reported currently our special event permit process is reviewed by Parks & Rec and the Clerk issues the beer and/or wine license. The permit allows alcohol beverage consumption in the downtown and Village Green, in areas identified by the applicant specifically for the event. These areas are typically identified with a tent or within a fenced area. What we are seeing in the downtown is that the public brings coolers containing alcoholic beverages to parades and uses outside tables to consume their beverages. To address this situation, Council directed staff to develop an ordinance to allow public possession of open intoxicants during special events within the downtown, by identifying specific boundaries. Staff worked with Riffle and the draft ordinance includes that the City would provide signage (no alcohol beyond this point), barricades and garbage receptacles at key locations around the perimeter of the boundary areas identified in the downtown for special permit events. The Committee asked about the impact on events with people walking around and Buerger stated it is happening now and by setting boundaries it would make it easier for the Police to enforce. Currently, the Police Dept communicates with Park & Rec after an event and makes note of anything to look at for the next year. The Committee discussed the boundaries and would like to include the area north of Wisconsin Ave up to the tracks to Collins St, over to Silver Lake Plaza and S. Main St, to Veterans Park, to Eagles Landing, to City Beach and the Boardwalk. A map will be brought back to Committee. No action was taken. 3. Consider/recommend Repealing and Recreating Ordinance §12.03(7A)(b)4.b. of the Municipal Code Pertaining to Restraint of Pit Bull Dogs: Buerger reported previously staff received a request from Ellis to review the code pertaining to the restraint of pit bull dogs and staff has worked to create language to amend our code to address the restraint requirements for pit bulls. The language would remove muzzling for pit bulls but includes that Police can invoke muzzling if an event happens. It also includes that the dog owner has the right to appeal the muzzling requirement. Motion by Shaw to recommend repealing and recreating Ordinance §12.03(7A)(b)4.b. pertaining to restraint of pit bull dogs; second by Rosek. Motion carried 2-0.
