Protection & Welfare Committee Meeting Minutes June 5, 2018 Chairman Rosek called the meeting to order at 7:05 PM. Members Present: Aldermen Rosek, Shaw and Miller Staff Present: Mayor Nold, Kitsembel, Freber, Pickart, Gallo, Kelliher, Buerger, Duffy, Frye, Bleck and Coenen Others Present: Alds. Zwart, Kowieski, Ellis, and Strey, and Atty. Riffle 2. Consider/recommend Creating §12.05 of the Municipal Code Regulating Public Possession of Open Intoxicants: Kelliher reported Council asked staff to develop an ordinance to allow public possession of open intoxicants for special events. Protection & Welfare met on May 1st and May 15th with direction to staff to update the map showing the boundaries in the downtown where public possession of open intoxicants would be allowed. The City will provide signage (no alcohol beyond this point), barricades and garbage receptacles at key locations around the perimeter for each event. The Committee requested two changes to the ordinance: 1) Add language to the title of the ordinance “for permitted special events” and 2) add “during time periods of the special event only” in the body of the code. Motion by Shaw to recommend the two code amendments; second by Rosek. Motion carried 3-0. Motion by Shaw to recommend the code as amended and map as presented regulating public possession of open intoxicants; second by Miller. Motion carried 3-0. 3. Consider/recommend Amending §21.03 of the Municipal Code Regarding Public Entertainment Restricted: Kelliher reported with the increased use of the Village Green for public events, a minor language change to address adding Village Green and identifying where to get the permit for the use of the Village Green are needed. The Parks and Recreation Board approved the amendments on May 7th. Motion by Rosek to recommend amending the code regarding public entertainment restricted as presented; second by Miller. Motion carried 3-0. 4. Consider/recommend Amending §21.051 of the Municipal Code Regarding Fowler Lake Boardwalk, Pier and Gazebo Use Controlled: Kelliher reported now that the Fowler Waterfront Project is complete, staff identified the need to amend the Fowler Lake Boardwalk, Pier and Gazebo Use Controlled ordinance. The minor language changes include the removal of the term “gazebo”, addresses the boat launch pier parking restrictions and addresses music on the boardwalk. The Parks and Recreation Board approved on May 7th. Motion by Shaw to recommend amending the code regarding the boardwalk, pier and gazebo use controlled as presented; second by Miller. Consider/recommend Amending §21.09 of the Municipal Code Regarding Dogs in Parks Prohibited: Kelliher reported the City has received many requests from residents regarding our ordinance that does not allow dogs in our parks. The theme of the concerns is that our park system is not dog friendly and limits the opportunity to utilize the park system while walking a dog. The amendment addresses these concerns and our ability to enforce the ongoing use of parks by dog owners. The Parks and Recreation Board approved on May 7th. The Committee discussed not allowing dogs in Veteran’s Park or Village Green and the feasibility of a dog park. Motion by Shaw to add dogs are not allowed in Veteran’s Park; second by Rosek. Motion carried 3-0. Motion by Shaw to recommend amending the code regarding dogs in parks prohibited as presented. No second was received. 6. Consider/recommend Granting Renewal 2018-2019 Alcohol Beverage Licenses: Coenen stated the licensees are in complete compliance with all codes and regulations, therefore she recommends granting renewal of the alcohol licenses for the July 1, 2018 – June 30, 2019 licensing period. Motion by Shaw to recommend granting renewal 2018-2019 alcohol beverage licenses as presented; second by Rosek. Motion carried 3-0. 7. Consider/recommend Intent Not to Renew 2018-2019 Alcohol Beverage Licenses & Direct City Clerk to Send Notice of Intent to Each Licensee & Set Hearing Date: Coenen reported the licensees listed on the resolution have outstanding issues due to non-compliance with City licensing codes. The resolution is the first step for the Clerk to notify the licensees that Council may not renew their license. She recommends scheduling hearings for each licensee before Council on June 19, 2018 at 7:30 pm. Coenen noted due to timing, the list could change and hearings may not be necessary on June 19th. If the licensee becomes compliant, a resolution granting renewal will be presented. Motion by Miller to recommend expressing intent not to renew 2018-2019 alcohol beverage licenses as presented and direct the City Clerk to send notice of such intent to each licensee and set the hearing date for June 19, 2018; second by Shaw.
