CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS December 8, 2020 On December 8, 2020, a regular meeting of the Odessa City Council was held at 6:00 p.m., Odessa, Texas. Due to the COVID-19, the meeting was teleconferenced, as allowed by Governor Abbott’s executive order. The City Council was present through teleconference. City Council present: Mayor David R. Turner; Council members: Michael Shelton, District One; Steven Thompson, District Two; Detra White, District Three; Tom Sprawls, District Four; Mari Willis, District Five; and Peggy Dean, At-Large. Others present: Michael Marrero, City Manager; Norma Aguilar-Grimaldo, City Secretary; Natasha Brooks, City Attorney; Phillip Urrutia, Assistant City Manager; Cindy Muncy, Assistant City Manager; and other members of City staff. A quorum being present, Mayor Turner called the meeting to order and the following proceedings were held: The invocation was given by Mayor Turner and followed by the Pledge of Allegiance and Texas flags. Coronavirus Relief Fund wrap up – Mr. Marrero reported that the City provided programs to help those impacted by the COVID-19 from the Coronavirus Relief Funds (CRF). The CRF taskforce was created and allocated funds for businesses. He reported the assistance provided on the eligible activities for the use of the funds. The eligible activities included medical expenses, public healthcare expenses, public health measures and economic support measures. He thanked Council for their support. Council member Sprawls thanked the Council members who served on the task force. Council member Dean stated that help was provided to the citizens in many ways. She thanked the Council. Incident Command report – Rodd Huber, Assistant Fire Chief, identified the Incident Command team. Goals and objectives were identified as it was to protect the community and employees. The command was working with the hospitals. There would be free State COVID-19 testing beginning on December 11 at Floyd Gwyn Park. The results would be received between 48 to 72 hours. Council member Willis thanked the team for their hard work. CONSENT AGENDA ITEMS A. City Council minutes, November 24, 2020; B. City Council work session minutes, December 1, 2020; C. Ordinance No. 2020-42 – Request by Alfonso Leal, owner, to rezone Galindo Estates Addition, 1st Filing, Block 2, Lots 37-43, from Single Family-Four District (SF-4) to Special Dwelling District Council Minutes December 8, 2020 Page 2 (SPD) approximately 1.161 acres, Odessa, Ector County, Texas (southwest of the intersection of Martines Pl. and S. Crane Ave.); E. Ordinance No. 2020-43 – Request by C5H Investment Group, owners, to rezone Lot 9, Block 22, Harrisdale Addition, 4th Filing, from Single Family-Three District-Drill Reservation (SF-3-DR) to Single Family-Three (SF-3) approximately 0.5142 ac. Odessa, Ector County Texas (northwest of the intersection of Tennessee Dr. and Santa Monica Ave.); F. Renew contract with TML Intergovernmental Risk Pool for property insurance for $532,711; G. Renew public entity liability insurance with States Retention Group for $322,358.00; H. Renew excess worker’s comp insurance with Safety National Casualty for $182,192; I. Adopt The Family Health Project, revision January 1, 2021; J. Group Life Insurance, AD&D coverage, and retiree life insurance for 2021 with Standard Insurance Company through STA Benefits Consultants for $155,000; K. Renew medical stop-loss insurance with Berkshire Hathaway through Risk Strategies for $474,000; L. AmeriBen contract for benefits claims administration for $80,000. Motion was made by Council member Dean seconded by Council member Sprawls to approve the consent agenda. Council member Thompson reported that Item J, STA Benefits Consultants was owned by his son; but he had no interest in the company. The motion was approved by the following vote: Aye: Turner, Shelton, Thompson, White, Sprawls, Willis, and Dean Nay: None Abstain: Thompson (on item J only) OTHER COUNCIL ACTION PUBLIC HEARING Open a public hearing to consider approval of the request by Wilson Stephen Paul Trust, owner, for a specific use permit to allow a body shop use in a Light Commercial (LC) district on Lots 1-4, Block 6, Hartzog Addition of Block 73, Original Town (720 E. 8th St.). Randy Brinlee, Director of Development Services, reviewed the location. The specific use permit was for a body shop. The site plan was submitted. The Planning and Zoning Commission recommended for approval with conditions. The Council has the authority to review at any time upon complaints. No one came forward and the public hearing was closed. Motion was made by Council member Thompson and seconded by Council member Sprawls to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Turner, Shelton, Thompson, White, Sprawls, Willis, and Dean Nay: None Open a public hearing to consider approval of the request by City of Odessa, owner, Newton Engineering, agent, to rezone from Single-Family-Three-Drill Reservation (SF- Council Minutes December 8, 2020 Page 3 3-DR) to Retail (R) on Gulf Park Drill Site No. 8, Block 21, Fleetwood Addition, 2nd Filing (southwest of the intersection of Penbrook St. and Grandview Ave.) Mr. Brinlee reported that there were protests and the concerns were traffic and noise. He stated that those were addressed in policies. He reviewed the location, which was vacant. The purpose was for a new fire station to replace an outdated station. The Planning and Zoning Commission recommended for approval. The sirens would not be activated until the Grandview intersection. There were no entrances facing any residents. No one came forward and the public hearing was closed. Motion was made by Council member White and seconded by Council member Thompson to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Turner, Shelton, Thompson, White, Sprawls, Willis, and Dean Nay: None MISCELLANEOUS Tabled - Discuss group housing in residential neighborhoods. Gary Wynne, neighborhood citizen on Esmond, stated that there were activities at 5101 Esmond. The Police Department was called on two occasions but failed to respond. Darlene Hahn has lived next to the home. There was marijuana smoke smell and trash from the home. She has not seen any supervision, no masks were worn and there were too many cars that would block the emergency vehicles. Matt Coday stated that the home has a house manager. The people living there were tested often. The cars in the alley could be rectified if it was an issue. He stated the cars could be parked in front of other houses. He thanked the Council for its leadership and service. Motion was made by Council member Sprawls and seconded by Council member Shelton to table the item. The motion was approved by the following vote: Aye: Turner, Shelton, White, Sprawls, Willis, and Dean Nay: Thompson Appointment of Boards: Animal Shelter Advisory Committee, Odessa Housing Finance Corporation, Zoning Board of Adjustment, and Midland Odessa Urban Transit District.
