Comments/Other Departments, Boards, Commissions or Agencies Supporting Documents 4O-15 Canvassing Returns Run off Election 2020.pdf,  ORDINANCE NO. 2020-__ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ODESSA, TEXAS, CANVASSING RETURNS AND DECLARING THE RESULTS OF THE RUNOFF ELECTION FOR THE ELECTION OF MAYOR, COUNCIL MEMBER FOR DISTRICT ONE, AND COUNCIL MEMBER AT LARGE OF THE CITY OF ODESSA, HELD ON THE 15TH DAY OF DECEMBER 2020; DECLARING THAT JAVIER JOVEN IS ELECTED AS MAYOR; DECLARING THAT MARK MATTA IS ELECTED AS CITY COUNCIL MEMBER FOR DISTRICT 1; AND DECLARING THAT DENISE SWANNER IS ELECTED COUNCIL MEMBER AT LARGE; AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the city of Odessa caused to be published a notice announcing the runoff election to be held on the 15th day of December, 2020; and WHEREAS, notice of said election was actually given as required by law and as directed by the election order on file in the office of the City Secretary; and WHEREAS, said election was duly and legally held on the 15th day of December, 2020, in conformity with the election laws of the State of Texas, and the result of said election have been certified and returned by the proper judges and clerks thereof; and WHEREAS, this Council has today considered the returns of said election held on the 15th day of December, 2020; and WHEREAS, it appears to the Council, and the Council so finds, that the Election Officers have tabulated the results of said election and certified such tabulation to the Council, and that such tabulation is correct; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ODESSA, TEXAS: NE: \Ordinances\4O-15 Canvassing Returns Run off Election 2020 Page 1 of 3  Section 1. That the tabulation of votes cast in the runoff election held on the 15th day of December, 2020, made and certified to by the Election Officers of the City of Odessa, a copy of which is on file in the office of the city secretary, be and the same is hereby adopted as the official tabulation of the votes cast at said election and that said tabulation to be filed and recorded in the official records of the City of Odessa as the official canvass of said election. Section 2. That the said official canvass of the returns of said election for the election of officers shows the following: Mayor Javier Joven was elected for a four- year term. Council Member District 1 Mark Matta was elected for a four- year term. Council Member At Large Denise Swanner was elected for a four- year term. Section 3. That the necessity of making an official canvass of votes cast in the aforesaid election and declaring the said results of said election within a certain period of time creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance shall be passed finally on the date of its introduction but that such ordinance shall be approved with at least on two separate approvals of the City Council, and the Council having declared such emergency and necessity to exist, and having waived the Charter rule requiring two separate approvals so that this ordinance shall take effect and be in full force and effect from and after its passage. The foregoing ordinance was first approved on the 22nd day of December, A.D., 2020, by the following vote: Michael K.
