CITY COUNCIL MINUTES CITY OF ODESSA, TEXAS January 12, 2021 On January 12, 2021, a regular meeting of the Odessa City Council was held at 6:00 p.m. at First Baptist Church, Commons area, 709 N. Lee, Odessa, Texas. City Council present: Mayor Javier Joven; Council members: Mark Matta, District One; Detra White, District Three; Tom Sprawls, District Four; Mari Willis, District Five; and Denise Swanner, At-Large. City Council absent: Council member Steven Thompson; District Two. Others present: Michael Marrero, City Manager; Norma Aguilar-Grimaldo, City Secretary; Robert Carroll, Senior Assistant City Attorney; Phillip Urrutia, Assistant City Manager; Cindy Muncy, Assistant City Manager; and other members of City staff. A quorum being present, Mayor Joven called the meeting to order and the following proceedings were held: The invocation was given by Mayor Joven and followed by the Pledge of Allegiance and Texas flags. Mayor Joven presented the ECISD School Board proclamation and recognized the ECISD Board members. Mayor Joven presented the outgoing Council members Michael Shelton, Dewey Bryant, Peggy Dean and outgoing Mayor David Turner with a plaque and street sign for their service. The outgoing elected officials expressed appreciation to the Council that they served with and city staff. CONSENT AGENDA ITEMS A. City Council minutes, December 8, 2020; B. City Council special council minutes, December 22, 2020; C. City Council work session minutes, January 5, 2021; D. Ordinance No. 2021-01 - Request by City of Odessa, owner, Newton Engineering, agent, to rezone from Single-Family-Three- Drill Reservation (SF-3-DR) to Retail (R) on Gulf Park Drill Site No. 8, Block 21, Fleetwood Addition, 2nd Filing (southwest of the intersection of Penbrook St. and Grandview Ave.); E. Ordinance No. 2021-02 – Request by Wilson Stephen Paul Trust, owner, for a specific use permit to allow a body shop use in a Light Commercial (LC) zoning district on Lots 1-4, Block 6, Hartzog Addition of Block 73, Original Town (720 E. 8th St.); F. Resolution No. 2020R-01 – Necessary signatures in connection with City Funds; G. Resolution No. 2021R-02 – Necessary signatures in connection with Municipal Court Cash Bond Account Funds; H. Resolution No. 2021R-06 – Bid to Vanco Insulation for the removal of three unsafe commercial structures for $127,965; L. Purchase 35 sets of personal protective equipment from Casco Industries for $79,893.10; M. Renew contract with DPC Industries for the purchase of sodium hydroxide for $205,000; N. Bid award to Roll-Offs USA for side loading refuse containers for $51,500; O. Reject bids for the Memorial Gardens Park embankment stabilization project. Motion was made by Council member Sprawls seconded by Council member Willis to approve the consent agenda. The motion was approved by the following vote: Aye: Joven, Matta, White, Sprawls, Willis, and Swanner Nay: None OTHER COUNCIL ACTION Bid award to construct various sport courts at Floyd Gwin Park. Steve Patton, Director of Parks and Recreation, stated that Floyd Gwin Park improvements was in the Parks Master Plan. The improvements were divided up for construction. The first phase was the construction of the sport courts. He recommended the bid award to Onyx Contractors for $707,720. The construction would be completed in the Spring. The youth baseball would utilize the McKinney fields. Council member Willis complimented the staff for their work. Motion was made by Council member Willis seconded by Council member White to approve the bid award to Onyx Contractors. The motion was approved by the following vote: Aye: Joven, Matta, White, Sprawls, Willis, and Swanner Nay: None PUBLIC HEARING Open a public hearing to consider approval of the request by Betenbough Homes, owner, to rezone from Special Dwelling District (SPD) to Special Dwelling District- Surface Drainage (SPDSD) on 2.49 ac. of land in Sec. 35, Blk. 42, T-1-S, T&P RR Co. Survey, City of Odessa, Ector Co., TX (in proposed Ratliff Ridge, 8th Filing) (SE of the intersection of E. 91st & Wagon Way). Randy Brinlee, Director of Development Services, reviewed the location. The rezoning was to allow for development of a detention basin. The Planning and Zoning Commission recommended for approval. No one came forward and the public hearing was closed. Motion was made by Council member White and seconded by Council member Swanner to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, White, Sprawls, Willis, and Swanner Nay: None Council Minutes January 12, 2021 Page 3 Open a public hearing to consider approval of the request by 155 SE Loop 338, LLC, owner, for original zoning of Light Industrial (LI) on Lots 9-27, Block 2, Industrial Sites Addition (southeast of the intersection of Business Interstate 20 and Loop 338). Mr. Brinlee reviewed the location. The purpose was for transitional housing which met requirements and standards. The Planning and Zoning Commission recommended for approval. George Satterfield, Dennis, Texas, stated that the facility would be a transitional home to help young men reestablish in the community and be self-supportive. Most of the men were first time offenders. Accredited training would be provided that included auto mechanic, truck driving and welding. Mr. Satterfield stated that there would be random drug testing, it was a structured program with daily oversight. There would be drug counseling and anger management classes. The application process was extensive. If any of the regulations were violated, then the individual would be removed from the program. He reported that less than 15% go back to prison. No one else came forward and the public hearing was closed. Motion was made by Council member White and seconded by Council member Matta to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, White, Sprawls, Willis, and Swanner Nay: None Open a public hearing to consider approval of the original zoning request by Champs Trucking, owner, SW Howell, agent, of Light Commercial (LC) on an approx. 2.7 ac. tract in Section 45, Block 42, T-2-S, T&P Ry. Co., Odessa, Ector County, Texas (south of the intersection of Crane Ave. and US Hwy. 385). Mr. Brinlee reviewed the location, which was vacant. The zoning would be for Light Commercial to facilitate commercial development. The Planning and Zoning Commission recommended for approval. No one came forward and the public hearing was closed. Motion was made by Council member Sprawls and seconded by Council member Swanner to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, White, Sprawls, Willis, and Swanner Nay: None Open a public hearing to consider approval of the request by Marco Davis, owner, Motley Capitol, LLC, agent, to rezone from Office (O) to Retail (R) on Lot 11, Block 8, Permian Plaza, Odessa, Ector County, Texas (southwest of the intersection of 52nd St. and Twin Towers Blvd.) Mr. Brinlee reviewed the location, which was vacant. The purpose was to expand development. The Planning and Zoning Commission recommended for approval. No one came forward and the public hearing was closed. Motion was made by Council member Matta and seconded by Council member Sprawls to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, White, Sprawls, Willis, and Swanner Nay: None Council Minutes January 12, 2021 Page 4 MISCELLANEOUS To consider, discuss and take any necessary action regarding any and all issues related to COVID-19. Mayor Joven thanked Russell Tippin, Medical Center Health System CEO, and all the medical staff for the work with staff shortage and handling the vaccination process. Mr. Tippin recognized Chief Nursing Officer Christin Timmons. He reported that 25,000 vaccinations were requested. The first set of vaccinations were provided to first responders, nurses, and teachers. The positivity rate was down. Rodd Huber, Assistant Fire Chief, reported that a paramedic assisted during the vaccination. There were two or three reactions. John Alvarez, Fire Chief, provided a history of the first responders and staffs’ involvement during the pandemic. The department was proactive. He stated that the City had a working relationship with partners and stakeholders in the community that included UTPB, ORMC, ECISD and Medical Center Hospital. Chief Alvarez reported that the number one objective was to get people vaccinated if they want the vaccination. Council member Wills stated that as elected officials the chief duty was to serve and must lead by example. She stated the citizens must be safe and continue with the social distancing, masking, and washing hands. She thanked the Medical Center Health System staff. Mr. Tippin explained the acceptance of patients from outside the area. There was no transferring of patients. Mayor Joven commended the work and was optimistic with the end to the pandemic. Citizen’s comments on non-agenda items. No action. Recess for Executive Session - Personnel matters - Deliberate the employment, evaluation, duties, discipline, complaint, or dismissal of the Interim Municipal Court Judge – Carlos Rodriguez. (Texas Government Code 551.074) Reconvene in open session for possible action. Motion was made by Council member Sprawls and seconded by Council member Willis to go into executive session under 551.074. The motion was approved by the following vote: Aye: Joven, Matta, White, Sprawls, Willis, and Swanner Nay: None The Council reconvened from executive session. No action was taken in executive session. Motion was made by Council member Sprawls and seconded by Council member Willis to return from executive session.
