The minutes of the of the October 20, 2022, Planning and Zoning Commission meeting
were approved, motion for approval being made by Member, Russell seconded by
Member Earls, with the vote being a unanimous “aye”

Consider approval of the short form plat of Parkway Rv-1 Extension, a
subdivision of 3.40 acres situated in Section 31, Block 41, T-2-S, T & P RY Co.
Survey, Ector County, Texas (southwest of the intersection of Navasota Dr. and
S. John Ben Shepperd Parkway Blvd.)
Ms. Quimiro gave the following presentation: The site is located in the City of Odessa
Extra-Territorial Jurisdiction (ETJ), does not have a zoning designation and is vacant.
At their October 25, 2022, meeting Odessa City Council approved a resolution
authorizing an amendment to the existing Parkway RV Group LLC industrial
agreement. Under the terms of the industrial agreement, the property is subject to
some city oversight and the property is treated as if under Light Industrial (LI) zoning.
Land use in the area consists of the Parkway Rv Park to the east, vacant land to the
south, utilities to the north, and west.
The applicant is Parkway RV Group, LLC, owner, S. W. Howell, agent, and the purpose
of the request is to create one (1) lot to allow for the amendment of an existing
Industrial Agreement and expansion of the abutting RV park.
Platting conference agenda and comments were sent to the consultant on October
25, 2022.
Staff Comments:
-- Original ownership and tax certificates are needed prior to filing the plat.
-- An amended Site Plan Approval is required for the existing site plan.
-- This tract is outside the City limits and is in the ETJ.
-- Water will be available through a separate Industrial District Water Service
Contract and after the amendment. Sewer is not available.

Commission action is requested on the following items:
1. This property has no access. Provide access easement through Parkway RV-

Staff recommended approval of the request and offered the opportunity to ask any
questions of staff.

There being no questions or comments for City Staff Chairman Peacock opened the
public hearing for anyone wishing to speak in favor of or against the request. Having
no one come forward Chairman Peacock closed the public hearing and asked for a
discussion or motion, Member Earls moved the zoning plat be approved with a 10 ft.
easement.
Member Russell seconded the motion, with the vote being a unanimous "aye".

There were no conditions on this request and staff asked the board if there were any
questions. Chairman Peacock pointed out two of the staff comments. One comment
states all lots are of sufficient size for a water well and septic system. The very next
comment states that: Both lots must connect to ECUD water and disconnect any
water wells from potable use. The proposed lots are half acre lots. Joe Tucker
approached the podium to point out that first statement should read “All lots are of
sufficient size for public water and septic system. Half acre ok for septic as long as
they have public water.
Chairman Peacock opened the public hearing and invited anyone wishing to speak in
favor or against the request to come forward. With no one coming forward Chairman
Peacock closed the public portion of the meeting. He then asked the Commission for
discussion or a motion. Member Russell moved that the request be approved as
presented.

Ms. Quimiro gave the following presentation: The site is located in the City of Odessa
Extra-Territorial Jurisdiction (ETJ), does not have a zoning designation and is currently
vacant. Land use in the general area consists of residential development to the north,
and west, and a mix of vacant land and residential development to the south and east.
The applicant is Custom Homes by O. Franco, LLC, owner, and S W Howell, Inc.,
consultant, and the purpose of the replat is to create four (4) lots for ownership and
development purposes.
The Planning and Zoning Commission gave preliminary approval to this request on
May 5, 2022. Staff recommends approval of this request.
Ms. Quimiro asked if there were questions or comments for City Staff. Hearing none
Chairman Peacock opened the floor for discussion or a motion from the Commission.
Member Earls moved for the plat be approved as presented.
Member Coots seconded the motion, with the vote being a unanimous "aye".

development to the south and vacant land to the west.
The applicant is Betenbough Homes, Inc., owner, Maverick Engineering, agent, and
the purpose of the preliminary plat request is to create sixty-nine (69) single family

of the replat request is to create twelve (12) lots (between 3.31 AC. – 6.0 AC.) for
ownership and development purposes.
A platting conference was held October 11, 2022, with applicant’s consultant and
staff.
Commission action is requested on the following items:
1. ECUD had requested 20’ ECUD WL Easements. Some were reduced to 10’. ECUD is
requesting 20’ ECUD WL Easements. (ECUD.)
Chairman Peacock asked if there was a pushback on the 20 ft. Mr. Sam Howell
approached the podium and stated that the owners wanted to give 10 ft., and the
adjacent owner to the north could also give 10 ft. for the waterline easement since
there is nothing projected for any length of time, owners felt they should give the
entire 20 ft. Chairman Peacock what the stance would be for the Planning & Zoning
Commission. Mr. Brinlee indicated it is up to the Commission to approve or deny with
only 10 ft. easement instead of the 20 ft. Member Earls stated that sounded like a
good compromise. Member Marker asked Mr. Howell if the adjacent property owner
has agreed, to which Mr. Howell responded that the owner is Johnson Ranch and at
this time they do not have a need for water, in the future they will need the easement
as they start to develop. Member Simms inquired if there is jurisdiction to enforce an
easement or a legal recourse? Mr. Peacock responded, stating he doesn’t know if they
have a right of condemnation, to which Mr. Brinlee responded from the audience
stating they don’t have a right of condemnation. Mr. Peacock did state that both
owners will need to work out what they can in regard to the 10 ft. easement.
Chairman Peacock closed the public portion. There being no questions or comments
for City Staff, Member Earls moved the zoning plat be approved with a 10 ft.
easement.

The applicants are Leeco Energy & Investment, Inc, owner, LCA, consultant, and the
