Recommended Planning and Zoning Commission Action: Case File 2023-41-P __X__ Approved _____ Deny Current Zoning: Extra-Territorial Jurisdiction (ETJ) PLANNING:(Approved)  Original tax certificates are needed prior to filing the plat.  Indicated Size of lot(s) in square feet on plat. Public Works:(Approved)  This tract is outside of city limits and part of it is in the ETJ.  City water and sewer are not available.  All lots are of sufficient size for water well & Septic Systems.  Drainage reports needs to be submitted. This tract is in a special flood hazard area, Zone A. Current Zoning: Future Development District (FD) Surrounding Land Use: Properties located to the north, east, and south, are zoned Future Development District (FD) Properties to the west are zoned Special Dwelling Districts (SP-D). Analysis: The property involved in this request is located southeast of the intersection of Legacy Road and P Bar Ranch Rd. The site is currently designated Future Development (FD) and is currently vacant and undeveloped. The applicant is 2015 Cross B, LLC, owner, Parkhill, agent, and the purpose of the original zoning request is to create Retail (R) development in the area. Comprehensiveness: The proposed zoning is not contrary to the established land uses in the general area or the land use plan of the City of Odessa’s Master Plan. Livability: The proposed zoning would not have a negative impact on this site or surrounding properties. The proposed retail development would not be out of line with use to the surrounding neighborhood. Reasonableness: The rezone will facilitate a reasonable transition between land uses in the area. Based upon the proceeding analysis, Staff recommends approval of the request. The proposed zoning would not have an impact on surrounding properties. Analysis: The property involved in this request is located southwest of the intersection of Parks Legado Rd. and San Machell Dr. The site is currently designated Future Development (FD) and is currently vacant and undeveloped. The applicant is Peregrine Productions, LLC, owner, Newton Engineering, agent, and the purpose of the original zoning request is to create Planned Development-Light Commercial (PD-LC) development in the area. Using the City’s identified priorities contained in the City of Odessa’s Comprehensive Plan to evaluate zoning amendments the following comments are offered: Comprehensiveness: This request is not out of line with the City of Odessa’s Comprehensive Plan. The property is located near to Office (O) and Retail (R) zoning which allows for Planned Development-Light Commercial (PD-LC) and the associated less intense uses. Livability: The proposed zoning would not have a negative impact on this site or surrounding properties. The proposed light commercial development is not out of line with development in the area. Reasonableness: The proposed zoning district will facilitate a reasonable transition between land uses of varying intensities and would not create a conflict to the existing land uses in the area. Based upon the proceeding analysis, Staff recommends approval of the request. Recommended Planning and Zoning Commission Action: Case File 2023-03-SUP __X__ Approved _____ Deny Detail of the Request: The applicant is Charles Mark Jones, owner, and the purpose of the Specific Use Permit request is to allow Workforce Housing in an Industrial Contract District. The site is located in the City of Odessa Extra-Territorial Jurisdiction (ETJ), does not have a zoning designation and is undeveloped. Current Zoning: Extra-Territorial Jurisdiction (ETJ) PLANNING:(Approved)  Access and parking for the site will need to be provided.  Five (5) vehicle parking spaces are required for the workforce housing (1 paved parking per unit). Required parking spaces needed to be paved (9’x18’).  Vehicles in inoperable condition may not be stored onsite.  Operating of a home occupation or home business by occupants of Workforce Housing shall not be allowed.  Access to proposed workforce housing will be provided on OIDC Dr.  All portions of the building(s) must be within 150 feet of an approved fire apparatus road.  There must be a fire hydrant within 400 feet of building(s).  All applicable building codes need to be met.  Review of the permit upon receiving neighborhood complaints. This is a temporary permit, and the City Council shall have the right of termination for violation of the terms and conditions of the permit or because of the negative effect of the use on the neighborhood after a public hearing.  That the workforce housing should be allowed from July 25, 2023, to January 1, 2024, upon the termination of the commercial lease agreement for the property. Applicant will need to resubmit a Specific Use Permit request one the lease is renewed.  A building permit will be required from the City of Odessa’s Building Inspections requirements. Applicant is requested to comply with the City of Odessa’s City codes and Ordinances. Public Works:(Approved) No Comment Fire: (Approved)  Site plan showing fire apparatus access road with dimensions.  Location of nearest hydrant  Staff Recommend approval of use of this employee workforce housing project is a reasonable use and will not conflict with adjacent land uses. Vice Chairman Wayne Russell opened a public Hearing for question or concern, Gary Sims ask if this is going to be a temporary use for this operation for this company, are they leasing this property, to have their own employees living here. M. Prieto stated they are currently leasing this property. The workforce housing will be the same property as the other buildings, and next door they own the lot, which they will place the workforce housing on that other lot. Ryan Jones-reprehensive for Charles Jones, West Texas Boring has been around for 45 years, and plans to continue with years. What we are trying to do, we were located 1201 OIDC and two years ago we moved over to 1300 OIDC Dr., one of the things we struggle with (small Mom and Pops Shop) 43 employees strong, great company and people. All we need is a place to house employees who come from other cities and states to work, since its such late hours and crazy schedules. Hoping for the housing to be on our property, a lot of land (inside our fence) with all the property equipment such as fire hydrant, parking, septic. Hoping to get that approved through you all. Mr. Russell ask, “So you’re going to use for more than just 6 months”. Jones, states “absolutely full length we are here, been around for 45 years and hoping for 45 more”. Commissioner Tercero ask, so what about the other property, you own or are you leasing that one. Jones comments, so our building West Texas Boring business is at 1300 OIDC Dr., Mark Charles Jones, owner of the lot. He built this building for the main business use. Hearing no more questions or concerns, Vice Chairman Wayne Russell turned to commission and asked for motion, Member Steve Tercero moved the item be approved as presented. Commissioner J. Peacock questioned water lines, available through ECUD district. J. Tucker stated was a mistype then Commissioner J. Peacock stated, Traffic Impact Analysis, if we approve this, what if the analysis comes out differently. J. Tucker stated we are going to get this investigated to ensure the traffic for the new school is not heavily impacted. However, the plat could move forward with the conditions, and what new traffic of this new school. J. Peacock commented if we approve the preliminary plat, we are not giving permission to move forward without knowing the impact. J. Tucker responded with any approval will need to be contingent with subjected requirements of the analysis. E. Shaughnessy approached the podium with comments, if you wanted to approve the plat, you could include a condition, or roads impact. Vice Chairman Wayne Russell asking if any other requestions for staff, or public comments, J. Peacock stated approve and move on however, he has received multiple complaints from other development and would like to approve this with the subjected conditions of Traffic Impact Analysis. Vice Chairman Russel turned to commission and asked for discussion or a motion, Commissioner J. Peacock moved the item be approved, with condition Traffic Analysis be completed. Coots seconded the motion, with the vote being a unanimous "aye".
