The site is currently designated SF-3, Single-Family Residence District – 3, and is currently vacant and undeveloped. The applicant, Edgar Rodriguez, with agent N3 Brito, is seeking a zone change to create residential development in the area. The proposed development will be a maximum of two-story buildings, with one unit consisting of two residences per lot. Each building will have one-car carport, with an additional parking space to the side. Carports will be accessible from the front only. The proposed buildings will be built and sold off, not being units for rent. For the proposed PD, Planned Development District, the following standards apply: - Shall adherence to setbacks as recorded on the property’s plat. - Shall require a minimum of five-feet (5’) rear yard setback. - Administrative Site Plan approval shall be required prior to submittal of a building permit application. - Shall comply with all Fire and Building Inspections codes and ordinances. - Shall comply with all Planned Development District standards and regulations. Using the City’s identified priorities contained in the City of Odessa’s Comprehensive Plan to evaluate zoning amendments the following comments are offered: Comprehensiveness: This request is not out of line with the City of Odessa’s Comprehensive Plan. The property is located near to SF3, Single-Family Residence District-3 zoning. Livability: The proposed zoning would not have a negative impact on this site or surrounding properties. The proposed development is not out of line with development in the area. Reasonableness: The proposed zoning district will facilitate a reasonable transition between land uses of varying intensities and would not create a conflict to the existing land uses in the area. If approved, Planning recommends the following conditions A – E: Chairman Jimmy Peacock calls for questions from the members regarding the staff's report. The staff emphasized the importance of meeting site plan requirements before submitting permit applications. The rezoning process is set to be completed today, given that the plat has already been approved with the appropriate zoning information. The rezoning aims to adjust the zoning designation to accommodate the proposed housing types, which include a mix of Single-Family homes and Townhomes. Notices were sent to twenty-five surrounding property owners, resulting in four denials and no approvals. During the meeting, Connie Coots inquired whether the location would be designated as a Trailer Park, as referenced in the denial. The staff clarified that Townhomes will be constructed at the location, with N3Brito serving as the consultant and representative for the case. Chairman Jimmy Peacock calls for any additional questions from the members. Hearing none, he opens a public hearing for comments. Norberto Brito, III, from N3Brito, consultant for Edgar Rodriguez, presents the project concept. He explains the rezoning aligns with the approved plat and client’s vision, and they are working with city departments for utilities access. Mr. Rodriguez plans to construct duplexes along Conover Avenue and single-family homes on the other end. The project is located near the SPD, Special Dwelling District, and Crockett School. Ms. Prieto from staff noted that the consultant did not submit a site plan. Mr. Brito indicated submitting the site plan now would impose a financial hardship. If PD zoning is approved, a site plan will be submitted for review. She distributed copies to members. Each town-home will have on-site parking, as off-site parking is not an option. The homes, approximately 1,000 sq ft each, will have garages and face Conover Avenue. The PD zoning provides flexibility for more than the seven lots, which are intended for sale, not rent, with low- maintenance yards and cost assistance. As of April 2022, the project was approved with the concept of single-family homes. A homeowner from the north end raised concerns that smaller homes could cause issues, especially with school parking. Since 1977, the homeowner noted that while development is good, two homes on one lot could cause problems as families grow. There's also an abandoned well at the site, raising concerns about duplex suitability. Chairman Jimmy Peacock asked if anyone else wished to speak in support or opposition. Hearing none, he closed the public portion and turned to the members for discussion or motion. Members discussed parking, noting each dwelling would have one garage and two spaces. Questions arose about restrictions on lots related to the Townhome issue. Ms. Prieto stated any modifications would need resubmission. Reasonableness: The proposed zoning district will facilitate a reasonable transition between land uses of varying intensities and would not create a conflict to the existing land uses in the area. If approved, Planning recommends the following conditions A – C: Chairman Jimmy Peacock invited questions from the members about the staff report. Member Melissa Prieto asked whether the homes would be one-story or two-story, noting that staff member Maria Prieto had indicated they would be one-story. Maria responded that while the zoning district allows for two-story homes, the final site plan will be determined during the staff review process. Chairman Peacock also questioned why the proposed lot frontages are less than fifty feet, contrary to previous cases. Staff will verify this information by reviewing the ordinance. Chairman Jimmy Peacock calls for any additional questions from the members. Hearing none, he opens a public hearing for comments. Levi Bryant, an LCA consultant representing D.R. Horton, explained that the attached housing will have twenty-foot-wide lots, with customers given thirty-foot-wide lots and one-story floor plans for review. He stated that the thirty-five-foot lots meet SPD (Special Dwelling District) Zoning requirements, and alternative zoning would have been chosen if necessary. Chairman Peacock addressed comments from surrounding property owners regarding safety and infrastructure concerns. One comment mentioned the access from Yukon Road, which Mr. Bryant confirmed would be closed off, necessitating exits east or west on Deer Creek Ranch Road. The homes along Yukon Road will have their rears facing the existing road, with two-car garages and parking pads for visitors. Additional right-of-way and a screening wall along Yukon Road will improve visibility and traffic flow. Staff member Maria Prieto confirmed Bryant's response regarding the lot width requirements. Chris McDal, residing at 7203 La Escalara Ranch, raised concerns about traffic in the neighborhood, noting that it aligns with Deer Creek Ranch Road. He emphasized that the area has a poor traffic structure, with residents owning both work and personal vehicles. There have already been two accidents involving children, indicating that the new development's rear entry access will exacerbate the traffic issues and negatively impact the cohesion of the neighborhood. McDal also expressed that the value of homes might decrease as a result. Kevin Kenyan, of 7207 La Escolar Ranch Road, expressed concerns about the new development. He noted that initial promises suggested the empty region would remain unchanged. The new platting, oriented east to west, differs from existing streets and could potentially impact his home. Kenyan emphasized that children frequently play outside, and recent accidents have heightened safety concerns. The development's access via the two-lane highway off Yukon Road, with its dense brush and difficult intersections, further complicates traffic. Additionally, a nearby school has already caused significant traffic increases during drop-off and pick-up times. Kenyan stated that the entire neighborhood shares these concerns about the new development. Chairman Jimmy Peacock asked if anyone else wished to speak in support or opposition. Hearing none, he closed the public portion and turned to the members for discussion or motion.
