Elizabeth Shaughnessy Presents:
Maverick Engineering has submitted a request for initial zoning for a proposed
annexation, scheduled to be reviewed by the City Council on February 25th.
The annexation process involves the Planning and Zoning Commission
approving the zoning request, in this case, the area to be zoned as R, Retail
Zoning District. This proposal includes the development of commercial spaces,
consistent with the surrounding area's retail and commercial use. The proposal
has been circulated to various internal and external agencies and has received
no objections, subject to conditions A through D. Staff is now available for any
questions.
The chairman asks members for questions regarding the annexation request.
Mr. Arzate clarifies the case number and notes a correction. Chairman Peacock
inquired about the condition preventing Field Lane from being used for offsite,
oil field, and ranch traffic. Staff confirms this must be resolved before
annexation. Joe Tucker, Director of Public Works, states that discussions have
resolved the issue. The chairman asks for additional questions from staff.
Hearing none, he opens the public portion of the meeting for discussion or
concerns. Seeing no one come forward, the Chairman closes the public portion
of the meeting and asks members for a motion or further discussion.

questions. The chairman asks members for questions regarding the
annexation request. Hearing none, he opens the public portion of the meeting
for discussion or concerns. Chris Berry, representing Betenbough, discusses
the commercial project and the agreement with the county to split tax
revenues. Betenbough seeks zoning for this commercial property, suitable for
a gas station. They are also seeking additional land for future city use,
including the Windmill Crossing Addition, nearing completion. The Chairman
asks members if they have any further questions for Mr. Berry. Hearing none,
he invites anyone in the audience to speak in support of or opposition to the
proposal. With no one coming forward, he closes the public portion of the
meeting and turns to the members for a motion.

seeking a Final plat to create one (1) lot for ownership purposes.

This request has been routed to all respective departments for internal review. The
comments are below:
PLANNING:
Tax certificates required prior to P&Z appearance. Failure to submit may in denial
recommendation.
PUBLIC WORKS:
Water and sewer are available. Sewer needs to be extended down Murphy to the northeast
corner of the property. Submit plans for review and acceptance. No pro rate is due.
Drainage report has been submitted but calculations are missing. Submit calculations. This
tract is not in a special flood hazard area.
Curb & Gutter is needed on Murphy. Submit design plans for review and acceptance.
Dedicate a 20’ cutback at the corner of Bankhead and Murphy.
An Improvements Agreement will be required (Ordinance, §10-3-3).

C. Submit drainage report calculations.
D. Curb & Gutter is needed on Murphy. Submit design plans for review
and acceptance.

The applicant, Maverick Engineering, who is representing Headlee Estates, LLC and
Covington Brothers Properties, LLC, owners, is requesting approval the original zoning of
R, Retail District for commercial development.
Using the City’s identified priorities contained in the City of Odessa’s Comprehensive Plan
to evaluate zoning amendments the following comments are offered:
Comprehensiveness: The proposed original zone request is not contrary to the established
land uses in the general area or the land use plan of the City of Odessa’s Master Plan.
Livability: The proposed original zoning would not have a negative impact on this site or
surrounding properties. The proposed retail development is not out of line with the existing
retail development in the area.

WHEREAS, Chapter 43 of the Texas Local Government Code and the Home-Rule
Charter of the City of Odessa authorizes the City to annex territory in accordance with the
procedures provided for therein; and
WHEREAS, the property owner, Headlee Estates LLC. submitted to the City a Petition
for Annexation of a 12.83-acre tract located in Section 5, Block 41, T-1-S, T&P RR Co. Survey,
Ector County Texas, which is attached hereto as Exhibit “A”;
WHEREAS, this property lies within the exclusive extraterritorial jurisdiction of the City
of Odessa;
WHEREAS, having considered the petition and hearing the recommendation from city
staff, the City Council finds it to be in the public interest to accept said petition and to initiate
the annexation process, which includes the preparation of an ordinance annexing the subject
property and an annexation services agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

CRMWD:
The District has reviewed the preliminary plat for Dorado Center 8th filing. As noted by
LCA, the plat shows our 33” water transmission pipeline and 30’ pipeline right of way
running thru both portions of this plat. Prior to finalizing the plat, the developer shall
determine the locations of the CRMWD pipelines. If needed, the existing CRMWD
easement shall be adjusted on the new plat so that the existing pipelines are within the
easement. District personnel shall be notified prior to excavation of pipelines.
Our pipelines and easements carry certain restrictions prohibiting the construction of
habitable structures as well as other features designed to protect the pipelines. It is also
worth noting that the pipelines may be relatively shallow, which may impact streets,
drainage ways, pipelines or other improvements planned to cross the District’s line. The
developer shall determine the amount of cover existing over the pipelines to determine
their potential impact on planned improvements. All proposed crossing utilities must
cross under the pipeline with a minimum clearance of two feet and be encased
throughout the easement. District personnel shall be notified prior to excavation of
pipelines or any work on the easement.
In order to help ensure the integrity of these pipelines, CRMWD requests that a copy of
the proposed construction plans be provided for review. This review will allow CRMWD
the opportunity to provide comments prior to issuance of the final construction plans and
will help to make the construction process go smoother. Electronic copies of the plans
can be provided via e-mail.
