The Scouts are working on their Citizenship in the Community badge. A moment of silence was observed. Joint Proclamation Proclaiming September 15, 2015 to October 15, 2015 as “Hispanic Heritage Month” in Ogden City A joint proclamation regarding Hispanic Heritage Month came before the Council for consideration. Council member Garner introduced Jose Marquez and indicated Mr. Marquez would be reading the Spanish translation of the joint proclamation. Council member Garner and Mr. Marquez read the joint proclamation after which COUNCIL MEMBER GARNER MOVED TO APPROVE THE JOINT PROCLAMATION. MOTION WAS SECONDED BY COUNCIL MEMBER STEPHENS, ALL VOTING AYE. Weber State University (WSU) President Charles A. Wight thanked the City Council members, Council Executive Director Cook, Mayor Caldwell, Chief Administrative Officer Johnson, Ogden-Weber Applied Technology College (OWATC), Latinos United Promoting Education and Civic Engagement (LUPEC), fellow Weber State Wildcats and everyone else who helped to make this possible. He stated our cultural heritage is what makes us who we are and WSU is proud to embrace diversity. The deepest learning occurs when people gather to discuss their differences and we have the privilege of not just discussing our differences but celebrating them. OWATC President Colette Mercier said it is a pleasure to be here tonight. Ogden is a wonderful community and being here as part of a group that comes together to embrace diversity is the place she wants to be. We gain so much from living here and contributing. She explained that she grew up in Michigan which has a rich history of diversity and she is pleased that Ogden does too. She looks forward to this event and continuing to work with the City and the other local organizations. David Utrilla, Honorary Consul of Peru, thanked the Council for the invitation to speak tonight and expressed his gratitude for this joint proclamation. He stated he is a citizen of Ogden; all four of his children were born in Ogden and he has wonderful memories. He started college life at WSU when he came from Peru and later started a business in Ogden. He commented that Ogden is a special place for many people. The city is growing and people want to know what the secret is; he believes it is the diversity. Mr. Utrilla shared that he recently addressed the Federal Bureau of Investigation and indicated that Hispanics currently make up 17.4% of the U.S. population and 19% of the population in the State of Utah. Hispanics are the largest and fastest growing demographic in the state. He indicated they come to Utah to live the American dream. First generation Hispanics in Utah are typically not English speaking but their children are bilingual. English is their primary language and English will remain the language in their communities. He talked about taxes and the workforce as they relate to Hispanics. Mr. Utrilla stated this is a huge step in recognizing the importance of diversity and the Hispanic community feels gratitude. Renato Olmedo, representing Eduarduo Arnal Palomera from the Mexican Consulate, thanked the Council and the community. He explained he has lived in Utah for the last 10 years and the first 9.5 years he was undocumented. He stated these people are a beautiful part of the community and many of these immigrants want to continue their dreams. He asked everyone to consider each day Hispanic Heritage Day.  Jesse Garcia, former Ogden City Council member, said it is a pleasure to address the City Council. He mentioned a historic settlement in Ogden called Fort Buenaventura and pointed out that is a Spanish name. During the 1900s the Hispanic community came here to make a life; some came as migrant farm workers but many started Hispanic businesses as well. He listed some of those business leaders who have given a lot to the community including educators, car dealers, and restauranteurs, bar owners, Council members, and School Board members. He mentioned several organizations for Latinos in Ogden over the years. He thanked the City for this joint proclamation. Chief Administrative Officer Johnson spoke on behalf of Mayor Caldwell. Mr. Johnson explained the outdoor industry asked the Mayor to give a keynote address at an event scheduled for this evening but he will be at the event on Saturday at Union Station. Ogden City was recently on the cover of Newsweek. During the interview, the Mayor was asked what Ogden’s “secret sauce” is and the Mayor replied the “secret sauce” of Ogden is the people. The railroad started things off many years ago and now we have diversity in religion, in politics and in cultural backgrounds. Ogden is frequently complemented on the way it capitalizes on the diversity and this is a significant piece. Mr. Johnson indicated it is important to acknowledge other cultures and he and the Mayor look forward to the event on Saturday. He thanked Mr. Cook, WSU, OWATC, LUPEC, and others and thanked the Council for passing this joint proclamation. Council member Stephens thanked Jesse Garcia for his service on the City Council and the knowledge he brought. He stated we are coming as partners in association to develop the City of Ogden so we can learn, work and have fun here. That’s what we’re going to do on Saturday but we need to do it all year long. Diversity is an opportunity to come together to share common goals. He stated Ogden is a stable, organized, well rounded community and the Hispanics are part of that. Council member Stephens said he is proud to have them here to share and to give us strength. Council member Garner thanked everyone for the opportunity to work on this together, to share meals together, and to talk about their families. He said he looks forward to Saturday and the celebration, as well as continuing to celebrate throughout the year. Council member Gochnour saluted everyone for taking time to come tonight to celebrate the passage of this joint proclamation. Vice Chair White said trust does not come without respect. The partners that we continue to work with bring that and she looks forward to trust between all of our organizations. Council member Blair thanked everyone for their work to bring this to fruition. He appreciates the diversity and the different cultures in our community. The opportunities he had growing up to experience other cultures and the experiences his children have makes our community special. We have diversity here in an abundance and he is thankful. Council member Wicks suggested the “special sauce” is spice. Diversity is the spice. She mentioned she grew up in Bountiful which is not as ethnically diverse as Ogden, and therefore a little more “bland”; Ogden is vibrant, interesting and moving forward because of the diversity. Chair Hyer said Hispanics are very family oriented, hardworking, and ethical; great examples for the rest of us. He was born and raised in Ogden and he thought this is how it was everywhere. Some of his closest friends are Hispanic and he appreciates them. He expressed his appreciation to everyone for being here. Joint Proclamation Proclaiming October 2015 as “Community Planning Month” in Ogden City A joint proclamation regarding Community Planning Month came before the Council for consideration. Vice Chair White read the joint proclamation after which VICE CHAIR WHITE MOVED TO APPROVE THE JOINT PROCLAMATION. MOTION WAS SECONDED BY COUNCIL MEMBER WICKS, ALL VOTING AYE. Council Policy Analyst Symes thanked the Council for putting this item on the agenda again this year. He explained the American Planning Association has declared October ‘Community Planning Month’ and this year’s theme is healthy communities and healthy people. He mentioned the transit study, the bicycle master plan study, and the work the City is doing with the Wasatch Front Regional Council to create a complete streets study. We do great planning here in Ogden and this is a wonderful opportunity to recognize that. Planning Manager Montgomery said this afternoon he was doing a tour with a group of students from Utah State University and taking about design concepts. They ran into a woman and her three children and she said this is the best place to live in. He stated he appreciates Mr. Symes’ efforts in spearheading this and commented that having a place for people to live where they feel proud and comfortable is what it is all about. Planning Commission Chair Wright mentioned she was born and raised here but she has had the opportunity to visit different cities around the Country and their downtowns are ghost towns. We have a vibrant downtown and we are proud of it. She and her children all went to high school in downtown Ogden and she is so glad. Ms. Wright stated she appreciates all they are doing with planning and the opportunity to serve on the Planning Commission. Planning Commissioner Holman stated she appreciates the opportunity to serve on the Planning Commission. It has been a joy to see Ogden transform and transition into what it is today; great things are happening here. There are activities for all people. There is potential here that she does not see anywhere else. Ms. Holman explained she has traveled quite a bit and there is just something unique about Ogden. We are growing together with diversity and going forward together in unity. We are all on one accord and she is excited about it. She is thankful for the work and service that is done here and for Mr. Montgomery and the Planning Staff that make their job easier.  Planning Commissioner Schade, the longest tenured Planning Commissioner in Ogden, reported that he appreciates the opportunity to serve the community. He stated he appreciates the support of the City Council and the City as well as the Planning Staff. They do their best as a Planning Commission to make the correct and proper decisions for the City. As he has visited other communities he noticed they do not have support staff for their Planning Commission and you can tell. Chair Hyer said he is a former Planning Commission member and enjoyed his fifteen years serving. It is a labor of love; there is no paycheck. The Commissioners do a lot of study to make sure they make sound decisions. He indicated he appreciates those good people. Council member Stephens said they make the City Council’s job so much easier because they field a lot of projects that come through and their service is very valuable. Council member Wicks said the Planning Commission works late nights and the City Council appreciates the time commitment and careful consideration. Council member Garner mentioned the recent cover of Newsweek and said the Planning Commission has a lot to do with that. Mr. Johnson said the Planning Staff needs to be thanked as well. They do a lot of work behind the scenes and he appreciates their hard work. Approval of Minutes Council member Blair stated he had reviewed the minutes of the Closed Session of June 9, 2015, Study Session of August 18, 2015 and Regular Meeting of August 18, 2015 and found them to be accurate to the best of his recollection. Council member Wicks stated she had reviewed the minutes of the Work Session of August 18, 2015 and found them to be accurate to the best of her recollection. Council member Garner stated he had reviewed the minutes of the Joint Work Session of August 19, 2015, Board of Canvass of August 25, 2015, and Work Session of August 25, 2015 and found them to be accurate to the best of his recollection. Council member Stephens stated he had reviewed the minutes of the Study Session of September 1, 2015 and Work Session of September 1, 2015 and found them to be accurate to the best of his recollection. Council member Gochnour stated she had reviewed the minutes of the Regular Meeting of September 1, 2015 and found them to be accurate to the best of her recollection. COUNCIL MEMBER GOCHNOUR THEN MOVED TO APPROVE THE MINUTES AS PRESENTED. MOTION WAS SECONDED BY COUNCIL MEMBER GARNER, ALL VOTING AYE. Proposed Ordinance 2015-42 amending the FY2016 Budget in the amount of $1,072,954 A memo from the Administration regarding a Fiscal Year (FY) 2016 Budget Amendment came before the Council for consideration. The memo stated the Council is being asked to consider a proposed budget amendment to the FY2016 budget in the amount of $1,072,954. The budget amendment recognizes and appropriates various grant funds to the General Fund in the amount of $42,248 and Medical Services Fund in the amount of $93,706, transfers funds within the Capital Improvement Project (CIP) Fund for Percent for Arts and various CIP projects in the amount of $103,750, and appropriates funds from the Water Utility fund balance to CIP Project CD076 in the amount of $833,250 to cover additional costs needed for the Trackline water line project. Comptroller Stout summarized the memo and stated this budget opening affects four different funds in the total amount of $1,072,954. She briefly reviewed the affected funds. The Chair then called for a public hearing on proposed Ordinance 2015-42, entitled: “An ordinance of Ogden City amending the budget for the Fiscal Year July 1, 2015 to June 30, 2016 by increasing the anticipated revenues for a gross increase of $1,072,954 from sources as detailed in the body of this ordinance; and increasing the appropriations for a gross increase of $1,072,954 as detailed in the body of this ordinance; and providing that this ordinance shall become effective immediately upon posting after final passage.” The Deputy City Recorder presented written notice of said hearing and affidavit of the publication in the Standard- Examiner on the 27th day of September, 2015, specifying the time and place of this meeting as the time and place when and where the proposed ordinance would be given a public hearing and be considered for final passage. The proof of publication was accepted and filed. The proposed ordinance was read by long title and all persons interested were given full and fair opportunity to be heard. No persons came forward to be heard. COUNCIL MEMBER GOCHNOUR MOVED THE PUBLIC HEARING BE CLOSED. MOTION WAS SECONDED BY COUNCIL MEMBER GARNER, ALL VOTING AYE. ON A MOTION BY COUNCIL MEMBER GOCHNOUR AND SECONDED BY COUNCIL MEMBER GARNER, ORDINANCE WAS PASSED AND ADOPTED AS OGDEN CITY ORDINANCE 2015-42 AND ORDERED POSTED AS REQUIRED BY LAW UPON THE FOLLOWING ROLL CALL VOTE: VOTING AYE – COUNCIL MEMBERS BLAIR, GARNER, GOCHNOUR, STEPHENS, WICKS, VICE CHAIR WHITE AND CHAIR HYER. VOTING NO – NONE.  The Chair signed the ordinance as passed and adopted and the Chair’s signature was attested by the City Recorder. The authenticated ordinance was then filed with the City Recorder for transmittal to the Mayor for review and consideration. Council member Comments Council member Stephens mentioned he had been asked about the speed limit on 22nd Street above Harrison Boulevard. Mr. Johnson replied it has been studied and the City feels it is the correct speed limit. The City will continue studying different streets and prioritizing those. Vice Chair White reminded those present that ballots came out today. She said in her two years on the Council this has been a very interesting agenda with some amazing recognitions. She is glad to be part of this. There being no further business to come before the Council, COUNCIL MEMBER GOCHNOUR MOVED THE MEETING ADJOURN AT 7:06 P.M.
