Journal of Proceedings OF THE COMMON COUNCIL OF THE CITY OF OLEAN, N.Y. January 27, 2026 COUNCIL CHAMBERS COUNTY OF CATTARAUGUS STATE OF NEW YORK A Regular Meeting of the Olean Common Council of the City of Olean was held on Tuesday, January 27, 2026 at 6:00 p.m. PRESENT: Aldermen Robinson, Bennion, Keary, Forney, McCall, Crawford, and Anastasia ABSENT: None OFFICIALS: Mayor Amy Sherburne; Frank Caputo, City Clerk; Lens Martial, City Auditor; Michael Morgan, City Attorney; James Sprague, Director of Public Works; Brad Camp, Water and Sewer Superintendent, and Tiffany Taylor, Managerial Confidential Administrative Secretary At this time a prayer was given by Mr. Caputo, followed by a salute to the flag. READING, CORRECTING, AND APPROVAL OF THE MINUTES OF THE PREVIOUS REGULAR MEETING A motion to approve the minutes of the January 13, 2026 Regular Meeting was made by Alderman Robinson, seconded by Alderman Bennion. Voice vote, ayes all. Motion carried. COMMITTEE REPORTS & UNFINISHED COUNCIL BUSINESS Report from Public Safety Committee on PL #04-26, to amend the City of Olean Code of Ordinances Section 24-135 to prohibit parking on the southeast corner of North 9th Street at its intersection with Washington Street for a distance of 20 feet south. Committee recommends approval. Referred to City Attorney for Resolution. Report from Committee of the whole on PL #05-26, to authorize the transfer of $3,545 from line item 3120.100 to 3120.462 for costs associated with police academy tuition for a new hire. Committee recommends approval. Referred to City Attorney for Resolution. COMMUNICATIONS FROM THE MAYOR Special Proclamation for International Holocaust Remembrance Day MISCELLANEOUS COMMUNICATIONS None CITY OFFICIAL REPORTS None PROPOSED LEGISLATION AND REFERRALS PL #05-26: (Sherburne) To authorize the transfer of $3,545 from line item 3120.100 to 3120.462 for costs associated with police academy tuition for a new hire. Referred to Committee of the Whole Tuesday, January 27, 2026 by Council President. PL #06-26: (Sherburne) To confirm the Mayoral appointment of Jaye Beattie and Journal of Proceedings OF THE COMMON COUNCIL OF THE CITY OF OLEAN, N.Y. January 27, 2026 Reed McElfresh to the Planning Board. Referred to Regular Meeting Tuesday, January 27, 2026 for Resolution by Council President. PL #07-26: (Sherburne) To confirm the Mayoral appointment of James Dwaileebe, William Eaton, Steven Rogers, James Rucinski, Kelly Sweet, and Otto Tertinek to the Zoning Board of Appeals. Referred to Regular Meeting Tuesday, January 27, 2026 for Resolution by Council President. FINANCE / BILLS By Alderman McCall, Seconded by Alderman Anastasia The Auditor has processed bills and claims against the City of Olean as per list submitted to each Alderman and recommends payment thereof. WHEREAS, the Auditor has presented to the Common Council, bills and claims against the City of Olean totaling $919,523.69 for the budget and recommends payment thereof. NOW, THEREFORE, BE IT RESOLVED, that the same be and are hereby audited and allowed, and the Auditor is hereby authorized and directed to draw warrants for the payment thereof at the amounts set opposite each respective claim. ROLL CALL, AYES ALL. MOTION CARRIED. PUBLIC COMMENT/INPUT Alderman Anastasia explained he had received a few phone calls about snow plowing and a s a retired DOT worker, he thinks the City did a great job with the amount of snow we had and the amount of streets we have. He commended DPW and the work they did cleaning up from the storm. Alderman McCall agreed and explained our streets were comparable or better than others in the county. Robert Kennedy of 917 Seneca Avenue explained he was speaking to a City employee after the last meeting when another employee approached him to disrupt the conversation. He asked who the employee’s supervisor was and explained he is very upset about what he did and said to him. John Maeser of 1611 Avenue A explained he would like no parking signs in his neighborhood because the streets are so narrow. He explained he doesn’t think the plows do a good job on his street. He thanked Mayor Sherburne and Alderman Anastasia for their help with the situation when he reached out. RESOLUTIONS RESOLUTION #06-26 PL #05-26 By Alderman Bennion, Seconded by Alderman McCall RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FROM LINE ITEM 3120.100 TO LINE ITEM 3120.462 FOR COSTS ASSOCIATED WITH POLICE ACADEMY TUITION FOR A NEW HIRE RESOLVED, that the following transfer be authorized: Account # Description – General Transferred Transferred to From A-01-5-3120.100 Police Department – Personal $3,545 Service Journal of Proceedings OF THE COMMON COUNCIL OF THE CITY OF OLEAN, N.Y. January 27, 2026 A-01-5-3120.462 Police Department – Travel, $3,545 Training BE IT FURTHER RESOLVED, that this Resolution is effective immediately. ROLL CALL, AYES ALL. MOTION CARRIED. A motion to suspend the rules was made by Robinson, seconded by Alderman Bennion. Voice vote, ayes all. Motion carried. A motion to amend Resolution #07-26 to remove “Reed McElfresh” due to a resignation was made by Alderman Robinson, seconded by Alderman Keary. Voice vote, ayes all. Motion carried. RESOLUTION #07-26 PL #06-26 By Alderman Robinson, Seconded by Alderman Keary TO CONFIRM THE MAYORAL APPOINTMENT OF MEMBERS TO THE PLANNING BOARD RESOLVED, that the Common Council hereby confirms the following appointments to the Planning Board: Jaye Beattie. RESOLVED, that this Resolution is hereby effective immediately. ROLL CALL, AYES ALL. MOTION CARRIED. A motion to postpone Resolution #08-26 to the next Regular Meeting was made by Alderman Robinson, seconded by Alderman McCall. Voice vote, ayes all. Motion carried. EXECUTIVE SESSION A motion to enter into executive session to discuss pending litigation was made by Alderman Robinson, seconded by Alderman Bennion. Voice vote, ayes all. Motion carried. Executive session began at 6:25 p.m. A motion to adjourn from executive session was made by Alderman Robinson, seconded by Alderman McCall. Voice vote, ayes all. Motion carried. Executive session adjourned at approximately 7:45 p.m. ADJOURNMENT Motion to adjourn was made by Alderman Robinson, seconded by Alderman Forney. Voice vote, ayes all. Motion carried.
