ROLL CALL Present: 6 - Mayor Stephen H. Buxbaum, Mayor Pro Tem Nathaniel Jones, Councilmember Jim Cooper, Councilmember Julie Hankins, Councilmember Steve Langer and Councilmember Karen Rogers Excused: 1 - Councilmember Jeannine Roe 1.A ANNOUNCEMENTS Mayor Buxbaum announced this is a special meeting of the City Council and the first item is a discussion of the Shoreline Master Program in a Study Session format. Following the Study Session, Council will discuss the item under Other Business in order to take action. 1.B APPROVAL OF AGENDA Councilmember Hankins moved, seconded by Councilmember Cooper, to approve the agenda. The motion carried by the following vote: Aye: 6 - Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Cooper, Councilmember Hankins, Councilmember Langer and Councilmember Rogers Excused: 1 - Councilmember Roe 2. STUDY SESSION 2.A 13-0661 Review of Oral and Written Comments on the Shoreline Master Program (SMP) Mayor Buxbaum noted that Community Planning and Development Director Keith Stahley had provided a list of issues for tonight's discussion. Mayor Buxbaum then reviewed the process for the discussion. Councilmembers discussed the issues proposed by staff as well as additional items . Consensus was reached on changes to wording and those changes will be brought forward in the final draft to be presented to Council on September 17. Changes on five issues within Table 6.1 will be acted upon under Other Business directly following the Study Session. OTHER BUSINESS 3.A 13-0678 Provide Direction for the September 17 Draft of the Shoreline Master Program Mr. Stahley reviewed the five issues to be voted on within Table 6.1. Councilmember Langer moved, seconded by Councilmember Rogers, to designate water dependent use for marine recreation under the industrial/light category as a conditional use permit. The motion failed by the following vote: Aye: 3 - Mayor Pro Tem Jones, Councilmember Langer and Councilmember Rogers Nay: 3 - Mayor Buxbaum, Councilmember Cooper and Councilmember Hankins Excused: 1 - Councilmember Roe Since this was a tie vote, the Council agreed to bring this item back on September 17 when all Councilmembers will be present. Councilmember Cooper moved, seconded by Councilmember Rogers, to designate water related use for marine recreation under the industrial/light category as a permitted use. The motion failed by the following vote: Aye: 1 - Councilmember Rogers Nay: 5 - Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Cooper, Councilmember Hankins and Councilmember Langer Excused: 1 - Councilmember Roe Councilmember Langer moved, seconded by Councilmember Rogers, to designate water related use for the marine recreation under the industrial/light category as a conditional use permit. The motion carried by the following vote: Aye: 5 - Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Hankins, Councilmember Langer and Councilmember Rogers Nay: 1 - Councilmember Cooper Excused: 1 - Councilmember Roe Councilmember Rogers moved, seconded by Councilmember Cooper, to designate non-water oriented use for marine recreation under the industrial/light category as a conditional use permit. The motion failed by the following vote: Aye: 2 - Councilmember Cooper and Councilmember Rogers City of Olympia Page 2 City Council Meeting Minutes August 27, 2013 Nay: 4 - Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Hankins and Councilmember Langer Excused: 1 - Councilmember Roe Councilmember Langer moved, seconded by Councilmember Hankins, to prohibit non-water oriented use for marine recreation under the industrial/light category. The motion carried by the following vote: Aye: 5 - Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Cooper, Councilmember Hankins and Councilmember Langer Nay: 1 - Councilmember Rogers Excused: 1 - Councilmember Roe Councilmember Rogers moved to designate non-water oriented use for urban intensity under the industrial/light category as a conditional use permit. The motion died for lack of a second. Councilmember Langer moved, seconded by Councilmember Cooper, to prohibit non-water oriented use for urban intensity under the industrial/light category. The motion carried by the following vote: Aye: 5 - Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Cooper, Councilmember Hankins and Councilmember Langer Nay: 1 - Councilmember Rogers Excused: 1 - Councilmember Roe Councilmember Rogers moved, seconded by Mayor Buxbaum, to designate non-water oriented uses for port marine industrial under the industrial/light category as a conditional use permit. The motion failed by the following vote: Aye: 1 - Councilmember Rogers Nay: 5 - Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Cooper, Councilmember Hankins and Councilmember Langer Excused: 1 - Councilmember Roe Councilmember Hankins moved, seconded by Councilmember Langer, to prohibit non-water oriented uses for port marine industrial under the industrial/light category. The motion carried by the following vote: Aye: 5 - Mayor Buxbaum, Mayor Pro Tem Jones, Councilmember Cooper, Councilmember Hankins and Councilmember Langer Nay: 1 - Councilmember Rogers Excused: 1 - Councilmember Roe Staff will prepare a final draft for presentation to Council on September 17. CONSENT CALENDAR 4.A 13-0674 Approval of August 20, 2013 City Council Meeting Minutes The minutes were adopted. 4.B 13-0677 Approval of Bills and Payroll Certification Claim check numbers 336212 through 337290: Total $4,832,537.94; and payroll check numbers 86212 through 86378 and direct deposit transmissions: Total $9,722,059.84. The certification was adopted. 4.C 13-0630 Approval of the Proposed Cooper Point Area (County Island) Annexation Ordinance The contract was adopted. 4.D 13-0645 Approval of Planning Commission 2013 Work Plan The recommendation was adopted. 4.E 13-0666 Approval of Alley Names The recommendation was adopted. 4.F 13-0675 Confirmation of Funding Process for Acquisition of Isthmus Parcels The decision was adopted. Approval of the Consent Agenda Councilmember Langer moved, seconded by Councilmember Hankins, to adopt the Consent Calendar. PUBLIC HEARING - None 6. PUBLIC COMMUNICATION No one spoke. COUNCIL RESPONSE TO PUBLIC COMMUNICATION (Optional) 7. REPORTS AND REFERRALS 7.A COUNCIL INTERGOVERNMENTAL/COMMITTEE REPORTS AND REFERRALS Mayor Buxbaum reported the Ad Hoc Community Renewal Area Committee will meet this Thursday at 5:30 p.m. He also reported the Finance Committee met last Thursday and discussed funding for the Washington Center and will meet with members of the Washington Center on September 17 to finalize details for using funds from the endowment. He said the Finance Committee also looked at preservation and reconstruction of Percival Landing. Mayor Buxbaum noted the budget forum with the Coalition of Neighborhood Associations is scheduled for October 29 at 6:00 p.m. 7.B CITY MANAGER'S REPORT AND REFERRALS City Manager Steve Hall had no report. 8.
