II MINUTES Regular Town Board: October 15, 2025 III PUBLIC HEARING 1. Public Hearing regarding the 2026 Preliminary Budget & Benefit Basis Special District IV PUBLIC COMMENT ON OLD BUSINESS *4 minute time limit per resident* V OLD BUSINESS 1. Town Board to vote regarding the V/L 4956 & 4968 Chestnut Ridge Road, located on the north westerly corner of Armor Duells & Chestnut Ridge Roads, Zoned B-2. Miranda Holdings, Inc. is requesting a “Special Exception Use Permit” to operate a Drive-through Service Facility for a proposed “Tim Hortons”. (SBL#s 172.20-1-17 & 172.20-1-16) The Public Hearing was closed on 10/15/2025. 2. Town Board to schedule a Public Hearing for December 3, 2025 at 7:00pm (local time) regarding 3715 Southwestern Boulevard, south side of Southwestern Boulevard, west of Taylor Road, Zoned I-1. Mr. Joseph DeMarco Jr. is requesting a “Special Exception Use Permit” for a Legal Cannabis Dispensary (Coconut Buds LLC) (SBL #161.00-5-29). 3. Town Board to repeal Resolution #3 from September 17, 2025 regarding Accessory Dwelling Units (ADU) VI PUBLIC COMMENT ON NEW BUSINESS *4 minute time limit per resident* VII NEW BUSINESS 1. Town Board to authorize Supervisor to sign the 2024/2025 Erie County STOP-DWI contract.  2. Town Board to authorize the Orchard Park Town Court to apply for a JCAP grant. 3. Town Board to authorize the transfer of funds from Police Department Revenue Accounts to Expense Accounts. 4. Town Board to authorize an amendment to the 2025 Town Budget to recognize a Police Grant. 5. Town Board to approve the appointment of a part-time cleaner for the Utilities and Parks and Grounds buildings. 6. Town Board to approve the appointment of a laborer in the Orchard Park Parks and Grounds Department. 7. Town Board to approve Change Order #4 to our Contract with Greenauer Blacktop Inc. for the Orchard Park Little League 90ft. Baseball Diamond Earthwork Contract - Thorn Ave. Duerr Rd. Facility. 8. Town Board to refer the following to the Planning and Conservation Boards for their review:  3670 South Benzing Road, located on the west side of South Benzing Road, Zoned DR-2. Benzing Plaza LLC. is seeking to construct a 24,600 square foot medical building. (SBL #161.60-1-9.1)  3310 North Benzing Road, located on the west side of North Benzing Road, Zoned I-1. Marathon Roofing is seeking to construct a 5,000 square foot cold storage building. (SBL# 152.13-3-25)  3730 California Road, located at the northwest corner of Webster Road and California Road, Zoned I-1. Applicant is seeking to construct a 15,050 square foot warehouse and construction building and a 27,090 square foot warehouse and construction building, each with parking areas.
