II MINUTES Regular Town Board: December 3, 2025 III PUBLIC HEARING 1. Public Hearing to make a SEQR determination and amend the zoning ordinance to allow for a “Stadium Mixed Use” (SMU) Zone and to amend the zoning map to allow for a “Stadium Mixed Use” (SMU) Zone and to rezone an area of 282 +/- acres from various zoning districts including DR2, R3 and R4 to “Stadium Mixed Use” (SMU). Town Board to vote on proposed “Special Exception Use Permit” for a Legal Cannabis Dispensary at 3715 Southwestern Blvd. 2. Town Board to approve Change Order #2 to contract with Ground Breaking Solutions Inc. for the Berg Road Pump Station Replacement Project. VI PUBLIC COMMENT ON NEW BUSINESS *4 minute time limit per resident* VII NEW BUSINESS 1. Town Board to accept a donation from the Community Activity Council of Orchard Park to fund the purchase of a Gravity Recumbent Elliptical Machine for the Activity Center Fitness Room. 2. Town Board to authorize an amendment to the 2025 Town Budget to recognize an IT Grant. 3. Town Board to authorize the promotion of a Code Enforcement Officer in the Building Department.  4. Town Board to approve a referral to the NYSDOT requesting to reduce the speed limit on Big Tree Road. 5. Town Board to approve a referral to the NYSDOT requesting to reduce the speed limit on Southwestern Boulevard from the Hamburg Town Line to Michael Road. 6. Town Board to approve a referral to the Erie County DPW requesting to reduce the speed limit on Abbott Road between Lake Avenue and Big Tree Road. 7. Town Board to authorize the purchase of a 2025 Chevy 3500HD 1 ton dump truck with plow. 8. Town Board to award contract to F.A. Wellington Inc. for the Brush Mountain Softball Fields #3 & #4 Drainage Improvement Project. 9. Town Board to authorize advertisement for Dennis Road Bridge Replacement Project. 10. Town Board to authorize Supervisor to sign the NYSDOT Utility Agreement for the Intersection Improvements Project on Armor Duells Rd at Murphy Rd and Duerr Rd. 11. Town Board to adopt the Non-Union Salary schedule. 12. Town Board to authorize a Building Permit to install a fixed awning at 3847 Southwestern Blvd, west of Drive 5, “Prohibition 2020” Zoned DR-2, (SBL#161.00-5-18) as recommended by the Planning Board. 13. Town Board to schedule a Public Hearing for January 21, 2026 at 7:00pm (local time) regarding V/L adjacent to 5196 Ellicott Rd, located on the south side of Ellicott Rd, Zoned A-1. (SBL#185.05- 3-3) for a Conservation Easement renewal as recommended by the Conservation Board.
