Approval of Voucher Detail - September 30, 2024 RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the Voucher Detail Report dated September 30, 2024 in the amount of $1,257,801.73. VOUCH DET 100224 E. Adoption of Local Law 16-2024, “A Local Law amending Chapter 92 (Building Construction and Fire Prevention Code- Administration and Enforcement) of the Village of Ossining Code”. WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been considering the adoption of proposed Local Law -2024, titled, “A Local Law amending Chapter 92 (Building Construction and Fire Prevention Code- Administration and Enforcement) of the Village of Ossining Code”; and WHEREAS, a public hearing was conducted on September 18, 2024 at 7:30 pm at the Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York and via the Zoom platform affording members of the public an opportunity to be heard; and WHEREAS, the public hearing was closed on September 18, 2024; and WHEREAS, pursuant to section 617.3(f) of the State Environmental Quality Review (SEQR) regulations, no determination of significance, environmental impact statement or findings statement is required for Type II actions; and WHEREAS, SEQR regulation 617.5(c) lists Type II actions including: i) routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment and ii) adoption of regulations, policies, procedures and local legislative decisions in connection with any action on the Type II list; and WHEREAS, the proposed local law is a Type II action requiring no determination of significance pursuant to the SEQR regulations; and WHEREAS, there are no impediments to approving the proposed local law; now therefore be it RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts as Local Law 16-2024, A Local Law amending Chapter 92 (Building Construction and Fire Prevention Code- Administration and Enforcement); and be it further RESOLVED, that Local Law 16-2024 shall become effective upon filing with the Secretary of State pursuant to the Municipal Home Rule Law. Adoption of Local Law 17-2024, “A Local Law amending Chapter 250 (Vehicles and Traffic) of the Village of Ossining Code”. Local Law (Revision to chapter 250 sections 250-29 and 250-33) G. Call for Public Hearing-Proposed Local Law -2024 titled “A Local Law amending chapter 1, article III (General provisions, General Penalty) of the Village of Ossining Code.” RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a Public Hearing to take place at 7:30 pm on October 16, 2024 at the Birdsall Fagan Police- Court Facility, 86-88 Spring Street, Ossining, New York to consider proposed Local Law -2024, titled, “A Local Law chapter 1, article III (General provisions, General Penalty) of the Village of Ossining Code”; and be it further RESOLVED, that the proposed local law amends the fines for certain offenses under the Village Code; and be it further RESOLVED, that members of the public are invited to attend the public hearing in- person at the above-referenced location; and be it further RESOLVED, that those members of the public requiring a reasonable accommodation to participate in the public hearing due to that person’s disability, shall notify the Corporation Counsel no later than seven (7) days before the public hearing (kahan@villageofossining.org) to afford the village sufficient time to provide the reasonable accommodation; and be it further RESOLVED, that for those members of the public who want to attend/participate in the public hearing remotely, access will be available via the Zoom platform; and be it further RESOLVED, that comments regarding the proposed local law will be accepted by the Board of Trustees at BOT@villageofossining.org. Amend 2024 Cabaret License WHEREAS, on August 21, 2024, the Board of Trustees approved a cabaret license for The 19th Hole Golf Simulator Corporation; and WHEREAS, the type of entertainment identified in the board’s resolution was recorded music; and WHEREAS, The 19th Hole Golf Simulator Corporation filed documentation with the New York State Liquor Authority amending its method of operation to include live music in addition to the recorded music; now therefore be it RESOLVED, that the Board of Trustees approves an amended 2024 Cabaret License for The 19th Hole Golf Simulator Corporation as follows: Days/Hours: Sunday through Thursday 12:00 pm (noon) to 11:00 pm Friday and Saturday 12:00 pm to 12:00 am (midnight) Types of Entertainment: Recorded and Live Music; and be it further RESOLVED, that the Village Clerk shall issue an amended cabaret license to The 19th Hole Golf Simulator Corporation; and be it further RESOLVED, that except for the amendment noted above to types of entertainment, this board’s August 21, 2024 resolution shall remain in full force and effect as if more fully set forth herein. I. Lead service line replacement WHEREAS, the Village is undertaking a program to replace lead water service lines with copper to comply with regulations from the Environmental Protection Agency; and WHEREAS, the next phase in the replacement is the planned replacement of up to twenty-eight service lines on Spring Street; and WHEREAS, section 42-5B of the Village Code states that the Village, “shall be permitted to piggyback on a previous order for the procurement of apparatus, materials, equipment and supplies and related installations, maintenance or repair services when the following requirements are met: 1. The contract must have been let by the United States or any agency thereof, any state or any other political subdivision or district therein; 2. The contract must have been made available for use by other governmental entities, and this must be clearly stated in the contract let by the other entity that extends the terms and conditions of the contract to other governmental entities; and 3. The contract must have been let to the lowest responsible bidder or on the basis of best value in a manner consistent with the Village Code Chapter 42 and the General Municipal Law”; and WHEREAS, the village’s Procurement Policy provides that the Village Manager or Board of Trustees shall approve piggybacking depending on the value of the contract or services; and WHEREAS, the Water Superintendent proposes to have the village piggyback off of the contract let by the City of White Plains, contract number 903353, Job Order Contracting Services Paving, Excavating and Right-of-Way; and WHEREAS, the Corporation Counsel has reviewed the aforementioned contract and associated documents and concludes that the contract is consistent with section 42-5B; now therefore be it Legislative Meeting September 30, 2024 Page 4 of 5  RESOLVED, that the Village Manager is authorized to sign an agreement with ELQ Industries, Inc., 567 Fifth Avenue, New Rochelle, New York 10801 for the excavation work related to the replacement of up to twenty-eight service lines on Spring Street for a not-to-exceed cost of $150,000; and be it further RESOLVED, the Village is authorized to piggyback off of City of White Plains contract number 903353, Job Order Contracting Services Paving, Excavating and Right-of-Way. J. Fire Department – Appointment – Ossining Hose CO. #1 RESOLVED, that upon recommendation of the Fire Chief, Kevin Castro, Ossining, New York was elected as active members of Ossining Hose CO. #1 for interior firefighting. Kevin Castro K. Fire Department – Appointment – Washington Hook & Ladder Company #2 RESOLVED, that upon recommendation of the Fire Chief, Brenna Burrows, Ossining, New York was elected as active members of Washington Hook & Ladder Company #2 for interior firefighting. Brenna Burrows L. Agreement with AllPaid, Inc. RESOLVED, that following review by the Corporation Counsel, the Village Manager is authorized to sign the Merchant Agreement with AllPaid, Inc., 7820 Innovation Boulevard, Suite 250, Indianapolis, Indiana 46278 whereby AllPaid will act as the Village’s authorized agent for the purpose of receiving on the Village’s behalf payments from customers purchasing railroad station and municipal parking lot parking permits issued by the Clerk’s office.
