Police Sergeant Appointment - Connor Tompkins RESOLVED, the County of Westchester Department of Human Resources has certified to the Village of Ossining a list of eligible candidates for the contingent permanent appointment position of Police Sergeant, and WHEREAS, Connor Tompkins is ranked on the aforesaid list of eligible candidates; now therefore, it is, RESOLVED, that the Board of Trustees of the Village of Ossining, pursuant to the applicable provision of Civil Service Law and the Unconsolidated Laws of New York State, hereby appoints Connor Tompkins to the position of Police Sergeant in the Village of Ossining Police Department, from Eligible List No. 71-706, effective August 25, 2025, at an annual salary of $134,756. Referral of proposed zoning text amendment to the Planning Board WHEREAS, that pursuant to section 270-59 of the Village of Ossining Code, “this chapter, or any part thereof, may be amended, supplemented or repealed from time to time by the Village Board on its own motion or upon recommendation by the Planning Board. Prior to the public hearing…every proposed amendment shall be referred by the Village Board to the Planning Board for a report which shall be rendered within 62 days of such referral; and WHEREAS, the Board of Trustees is considering an amendment to chapter 270 (Zoning), adding a new article XX, Moratorium for submission and processing of land use approvals for cannabis dispensaries, vape shops, smoke shops, vape lounges and vape consumption businesses; now therefore be it RESOLVED, that pursuant to section 270-59 of the Village of Ossining Code, the Board of Trustees refers the proposed zoning text amendment to the Planning Board; and be it further RESOLVED, that the Planning Board shall issue its report on the proposed text amendments to the Zoning Code within sixty-two (62) days of this referral; and be it further RESOLVED, that pursuant to section 270-59A(1), the Planning Board shall make inquiry and determination concerning the items specified below: a. Whether such changes are consistent with the aims and principles embodied in the law as to the particular districts concerned. b. Which areas, land uses, buildings and establishments in the Village will be directly affected by such changes and in what way they will be affected. c. Whether such proposed amendments are consistent with the aims of the Comprehensive Plan of the Village and the Local Waterfront Revitalization Program (LWRP). Chapter 270 (Moratorium for cannabis dispensaries and vape shops) F. Extension of preferred developer status of WBP Development LLC for Main Street and Market Square Parking Lots WHEREAS, the Board of Trustees by resolution approved on November 2, 2022 authorized the Village Manager to enter into a letter agreement designating WBP Development LLC and St. Katherine Group, Inc. as the preferred developer for the village-owned property known as the Main Street and Market Square Parking Lots and identified on the tax map of the Village of Ossining as parcels: Main Street Parking Lots- 89.19-4-91, 89.19-4-92, 89.19-4-98, and 89.19-4-99 and Market Square Parking Lots- 89.19-4-38, 89.19-4-39, 89.19-4-40, 89.19-4-1, and 89.19-4-42 (“Property”); and WHEREAS, the first period of exclusivity as the preferred developer for the property ran for 180 days from November 10, 2022 until May 9, 2023; and WHEREAS, the November 2, 2022 resolution provided in part, “that the term of the preferred developer status will be 180 days which term can be extended by mutual consent of the Village and preferred developer”; and WHEREAS, the period of exclusivity subsequently was extended for an additional 180 days through November 5, 2023; and WHEREAS, the period of exclusivity subsequently was again extended for an additional 180 days through May 3, 2024; and WHEREAS, the period of exclusivity was extended through October 31, 2024; and WHEREAS, the Village of Ossining Board of Trustees, WBP Development LLC want to extend the period of exclusivity for an additional 630 days until July 23, 2026 to facilitate continued due diligence and actions toward the completion of an acceptable plan for the redevelopment of the property and the drafting and finalization of necessary contract documents; now therefore be it; and RESOLVED, that the period of exclusivity detailed in the November 8, 2022 letter agreement is extended through July 23, 2026. G Authorizing correction of exemption refunds. . WHEREAS, the Village Treasurer and Corporation Counsel were notified by the Town Assessor that the following homeowners in the Village of Ossining are entitled to a refund of real property taxes paid as a result of a clerical error, specifically that the incorrect percent for the disability exemption was applied: Howard Sackelman and Hannah Sackelman- 16 Rockledge Avenue, Unit 1-2N (97.15-1-37.1-2N); and WHEREAS, the Assessor submitted Form RP-566, Application for Refund or Credit of Real Property Taxes for the property; and WHEREAS, the Executive Director of the Westchester County Tax Commission approved the applications for refunds; now therefore be it RESOLVED, that the Board of Trustees of the Village of Ossining, hereby authorizes and directs the Village Treasurer to make such refund of real property taxes to the property owners noted in Schedule “A” below; and be it further RESOLVED, that a notation shall be made in the margin of the assessment roll indicating the corrected exemption amounts. Authorize Agreement with Westchester County for Prisoner Transportation RESOLVED, that following review by the Corporation Counsel the Village Manager is authorized to sign the agreement with Westchester County for the transportation of prisoners for the term of January 1, 2025 to December 31, 2026. J. Sidewalk Assessment- 54 Sherwood Avenue WHEREAS, on June 20, 2024, James Adamo, the owner of 54 Sherwood Avenue (89.16- 3-35) authorized the Department of Public Works to perform sidewalk and/or driveway apron repairs to his property; and WHEREAS, the work subsequently was completed; and WHEREAS, the property owner was notified that the Board of Trustees would meet on August 20, 2025 at 7:30 pm at the Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York and via Zoom to determine the assessment on the property for the repair work; and WHEREAS, at the aforementioned meeting the Board of Trustees discussed the assessment; now therefore be it RESOLVED, that the itemized costs noted below are just and reasonable; and be it further Legislative Meeting August 20, 2025 Page 4 of 6  RESOLVED, that if the amount so assessed is not paid within thirty (30) days after the assessment by this board an action to recover the amount assessed may be maintained by the Village against the property owner, or a special warrant may be issued by the board for the collection of such assessment of the amount thereof to be included in the next annual tax levy.
