Village Manager- Authorizing Village Manager to sign a work plan modification to contract C1002440 WHEREAS, by resolution adopted on November 16, 2023, the Board of Trustees authorized the Village Manager to sign contract C1002440 with the State of New York through the New York State Department of State to transform the Joseph G. Caputo Community Center; and WHEREAS, the contract was signed by the Village Manager on December 7, 2023 and by the Chief Administrative Officer for the Department of State on April 8, 2024; and WHEREAS, representatives of the Department of State and the village discussed modifying the work plan to exclude the pool at the community center from the contract; now therefore be it RESOLVED, that following review by the Corporation Counsel, the Village Manager is authorized to sign the work plan modification to contract C1002440 excluding the Legislative Meeting November 5, 2025 Page 2 of 7 community center pool from this contract. G. DPW- Authorize Supplemental Agreement No. 2 with the New York State Department of Transportation WHEREAS, the village and the New York State Department of Transportation (NYSDOT) previously entered into Snow and Ice Agreement D014843; and WHEREAS, NYSDOT has proposed Supplemental Agreement 2 amending the estimated expenditure for the 2025-2026 season by adding funding to adjust the estimated expenditure to account for increases in labor, materials, equipment and/or overall costs; and WHEREAS, the estimated expenditure increase for the 2025-2026 season is $5,666.94; now therefore be it RESOLVED, that following review by the Corporation Counsel, the Village Manager is authorized to sign Supplemental Agreement No. 2 to Contract D014843. H. Recreation and Parks - Award of Bid – Nelson Sitting Park Playground Replacement RESOLVED, that, subject to review by Corporation Counsel, the Board of Trustees of the Village of Ossining hereby awards the bid for Contract No. REC 25-01, Nelson Sitting Park Playground Replacement, to Pat Corsetti, Inc., 610 Fenimore Road, Mamaroneck, New York 10543 for the bid amount of $291,895.00 as the lowest bid received from a responsive and responsible bidder; and be it further RESOLVED, that following review by the Corporation Counsel the Village Manager is authorized to sign the documents for Contract No. REC 25-01. I. Finance Department- Authorization for Village to Accept Payment in Satisfaction of Foreclosed Tax Liens (22 William Street) WHEREAS, in accordance with Ossining Village Charter Article IV, the Village Treasurer is charged with the duty of collecting real property taxes from persons named in the tax roll, and in accordance with NYS Real Property Tax Law Section 1110, the Village Treasurer has the authority on or before the expiration of the applicable redemption period to accept payment of real property taxes from such persons, along with all charges authorized by law, for real property subject to delinquent tax liens; and WHEREAS, the applicable redemption period expired as of November 3, 2025 for the 2022 real property taxes which had become delinquent tax liens in June 2023, and with such expiration of the redemption period, the Treasurer has no authority without action by the Board of Trustees to accept further payments; and WHEREAS, notwithstanding the expiration of such redemption period, the representative of the property owner for certain real property located in the Village at 22 William Street has provided sufficient proof of: (i) an ability to pay in full all taxes and assessments against the subject property to bring the account up to date and (ii) the ability to make a full and complete settlement in satisfaction of the foreclosed, delinquent tax liens. NOW, THEREFORE BE IT RESOLVED, that the Village of Ossining Board of Trustees hereby authorizes and directs the Treasurer to accept payment in an amount sufficient to pay in full the total amount, including any interest, penalties and other charges authorized by law, of the real property taxes and any tax liens, both pending and foreclosed, for property located at 22 William Street (97.7-5-10) in the Village of Ossining, and authorizes any and all necessary filings or notifications to evidence a release of said liens against the real property. J. Corporation Counsel- Public Hearing-Proposed Local Law -2025 amending chapter 247 (Towing) RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a Public Hearing to take place at 7:30 pm on November 19, 2025 at the Birdsall Fagan Legislative Meeting November 5, 2025 Page 3 of 7 Police-Court Facility, 86-88 Spring Street, Ossining, New York and via Zoom, to consider proposed Local Law -2025, amending chapter 247 (Towing); and be it further RESOLVED, that the proposed local law would amend Section 247-2 (Definitions), 247-5 (Application for tow truck operator’s permit; applicable fee), 247-6 (Minimum standards for permit approval), 247-7 (Insurance and indemnification), 247-10 (Fingerprint requirement), 247-12 (Rotational on-call tow list), 247-13 (towing charges), and 247-247- 14 (Suspension and revocation of tow truck operator permit or tow truck driver permit); and be it further RESOLVED, that members of the public are invited to attend the public hearing in- person at the above-referenced location; and be it further RESOLVED, that those members of the public requiring a reasonable accommodation to participate in the public hearing due to that person’s disability, shall notify the Corporation Counsel no later than seven (7) days before the public hearing (kahan@villageofossiningny.gov) to afford the village sufficient time to provide the reasonable accommodation; and be it further RESOLVED, that for those members of the public who want to attend/participate in the public hearing remotely, access will be available via the Zoom platform; and be it further RESOLVED, that comments regarding the proposed local law will be accepted by the Board of Trustees at BOT@villageofossiningny.gov. Corporation Counsel- Adoption of Local Law 7-2025, “A Local Law amending Chapter 270 (Zoning) of the Village of Ossining Code”. WHEREAS, the Board of Trustees of the Village of Ossining (“Village Board”) has been considering the adoption of proposed Local Law -2025, titled, “A Local Law amending Chapter 270 (Zoning) of the Village of Ossining Code, Article XXI, Moratorium in the T (Two-family) zoning district”; and WHEREAS, a public hearing was conducted on October 15, 2025 at 7:30 pm at the Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York and via the Zoom platform affording members of the public an opportunity to be heard; and WHEREAS, the public hearing was closed on October 15, 2025; and WHEREAS, pursuant to 6 NYCRR section 617.3(f) of the State Environmental Quality Review (SEQR) regulations, no determination of significance, environmental impact statement or findings statement is required for Type II actions; and WHEREAS, 6 NYCRR section 617.5(c)(36) notes that “adoption of a moratorium on land development or construction” is a Type II action; and WHEREAS, there are no impediments to approving the proposed local law; now therefore be it RESOLVED, that the Board of Trustees of the Village of Ossining hereby adopts as Local Law 7-2025, A Local Law amending Chapter 270 (Zoning) of the Village of Ossining Code, Article XXI; and be it further RESOLVED, that Local Law 7-2025 shall become effective upon filing with the Secretary of State pursuant to the Municipal Home Rule Law. Final-Chapter 270 (T zone moratorium) N. Call for Public Hearing-Approval of Cable Television Franchise Renewal Agreement between the Village of Ossining and Cablevision of Ossining, L.P. Legislative Meeting November 5, 2025 Page 5 of 7 WHEREAS, New York Village Law section 4-412(6) provides in part that the Board of Trustees, “May grant rights and franchises or permission to use the streets, highways, public places or any part thereof or the space above or under them or any of them for any specific purpose upon such terms and conditions as it may deem proper and as may be permitted by law. No franchise shall be granted without a public hearing notice of which shall be given by publication in the official newspaper at least ten days before the meeting”; now therefore be it RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a Public Hearing to take place at 7:30 pm on December 3, 2025 at the Birdsall Fagan Police-Court Facility, 86-88 Spring Street, Ossining, New York for all interested persons to be heard in favor of or in opposition to the granting of a cable television franchise renewal agreement between the Village of Ossining and Cablevision of Ossining, L.P.; and be it further RESOLVED, that a copy of the cable television franchise renewal agreement is available for public inspection during regular business hours at the Village Clerk’s office, Village Hall, 16 Croton Avenue, Ossining, New York; and be it further RESOLVED, that members of the public are invited to attend the public hearing in- person at the above-referenced location; and be it further RESOLVED, that those members of the public requiring a reasonable accommodation to participate in the public hearing due to that person’s disability, shall notify the Corporation Counsel no later than seven (7) days before the public hearing (kahan@villageofossiningny.gov) to afford the village sufficient time to provide the reasonable accommodation; and be it further RESOLVED, that for those members of the public who want to attend/participate in the public hearing remotely, access will be available via the Zoom platform; and be it further RESOLVED, that comments regarding the proposed local law will be accepted by the Board of Trustees at BOT@villageofossiningny.gov. Village Manager- Authorization to sign Administrative Services Agreement with Rx Benefits, Inc. RESOLVED, that following review by the Corporation Counsel, the Village Manager is authorized to sign an Administrative Services Agreement with Rx Benefits, Inc., 3700 Colonnade Parkway, Suite 600, Birmingham, Alabama 35243 whereby Rx Benefits would administer the village’s prescription drug benefits as specified in the village’s plan; and be it further RESOLVED, that the agreement with Rx Benefits would be for a one-year term effective January 1, 2026 with additional one-year renewal terms unless written notice of intention to terminate the agreement is timely given. B. Board of Trustees- Memorandum of Agreement with Village of Ossining Policemen’s Benevolent Association, Inc. WHEREAS, on November 3, 2025, the Village Manager on behalf of the Village of Ossining and Sergeant Joseph Spinelli, President of the Village of Ossining Policemen’s Benevolent Association (“PBA”) signed a Memorandum of Agreement (“MOA”) memorializing the terms of a successor collective bargaining agreement for the period of January 1, 2022 through December 31, 2026; and WHEREAS, on November 5, 2025, a majority of PBA members in attendance ratified the MOA; and Legislative Meeting November 5, 2025 Page 6 of 7 WHEREAS, the village’s labor counsel and Village Manager were notified of the results of the ratification vote; and WHEREAS, pursuant to the MOA, “In the event that a majority of members in attendance at the PBA ratification vote to support this MOA, the Village Manager shall then place this matter on the agenda for its next regularly scheduled or special meeting of the Village Board…to be held no later than November 12, 2025, at which time its ratification vote to approve this MOA shall be conducted”; now therefore be it RESOLVED, that the Village of Ossining Board of Trustees ratifies the Memorandum of Agreement with the PBA; and be it further RESOLVED, that the mayor is authorized to sign the final collective bargaining agreement following review by the village’s labor counsel.
