Over the years Phase 2 was eliminated and rolled into Phase 1 with an additional $200K of CDBG funding and a Village match of $200K. The current project after a successful bid process along with associated soft costs is estimated at $1.7M total with the balance of funding ($900K) to be received from NYS Department of Transportation CHIPS grant funding. Each of these has also received a license from the State. The Village Board enacted a moratorium on the submission and processing of land use approvals for cannabis dispensaries, vape shops, and smoke shops. Based upon the discussion at the September 10, 2025, work session, draft regulations were developed with input from Taryn Ramey, Land Use Attorney, and Corporation Counsel, Stuart Kahan, and are attached to this memorandum. The draft regulations include: 1. New Use Category: Potential creation of "adult use cannabis dispensary, vape shops, smoke shops, vape lounges, and vape consumption" use that is separate and distinct from the general "retail sales and services, sales-oriented" use and restrict the zoning districts where dispensaries are permitted. 2. Time, Place, and Manner, including: • Hours of operation o Cannot restrict to less than 70 hours per week unless the licensee agrees to do so • Parking • Traffic • Grand Opening Plan • Odor • Lighting • Screening 3. Distance requirements between a cannabis facility and a public youth facility, up to 500 feet 4. Such paraphernalia shall include, but not be limited to, pipes, water pipes, and hookahs. An adult- use cannabis retail dispensary engaged in the accessory sales of paraphernalia shall not be considered a paraphernalia shop. Generally, the advertisement, window display, or reference to the availability of such paraphernalia in signage, television, print, or online media shall be prima facie evidence of the intent to engage in a significant trade exceeding the threshold to be classified as a cannabis and tobacco paraphernalia shop. ADULT-USE CANNABIS RETAIL DISPENSARY An establishment for the acquisition, sale, and delivery of cannabis to consumers in compliance with an Adult-use Retail Dispensary License duly licensed by the New York State Cannabis Control Board (CCB). An adult-use retail cannabis dispensary shall not include consumption of cannabis on-site, irrespective of the issuance of an adult-use on-site consumption license by the CCB. Where permitted under CCB licensure, an adult- use cannabis retail dispensary may also sell paraphernalia, equipment, and supplies intended to assist in the consumption of cannabis. PUBLIC YOUTH FACILITY A location or structure owned by a government or government subdivision or agency, that is accessible to the public, where the primary purpose is to provide recreational opportunities or services to children or adolescents of whom the primary population is reasonably expected to be 17 years of age or younger. SECTION TO BE ADDED UNDER ARTICLE V ADDITIONAL STANDARDS §270-26(B)(11) Adult-use cannabis retail dispensary. (1) General standards applicable to all adult-use cannabis retail dispensaries. (a) Permit. The cannabis retail dispensary shall submit evidence that all necessary licenses and/or permits have been obtained from New York State to the Village before a certificate of occupancy is issued by the Building Department to begin operation. (b) The cannabis retail dispensary shall only dispense approved cannabis products in accordance with the applicable laws of New York State. Page 16 of 25 (c) The view of cannabis plants, products, accessories, and associated paraphernalia shall not be permitted from a public sidewalk, public street, right-of-way, or any other public vantage point. On-site storage of cannabis products shall comply with applicable federal, state and local laws and regulations. (d) The cannabis retail dispensary shall provide for secure disposal of cannabis remnants or by-products; such remnants or by-products shall not be placed within the business’ exterior refuse containers. (e) The cannabis retail dispensary shall be ventilated so that the odor of the cannabis cannot be detected by a person with a normal sense of smell at the exterior of the business or at any adjacent use or property. (f) Location. [1] No dispensary shall be located within the State-prescribed distance regulations from a public or private school grounds as defined in the NYS Education Law, serving students through the 12th grade, or house of worship. [2] No dispensary shall be located within 500 feet of a public youth facility. This includes parks whose primary activity is a playground. (g) On-Site Consumption. [1] In accordance with Chapter 105 Cannabis, there shall be no on-site consumption of cannabis within the building or in outdoor areas, including the parking lot. Discrete signage shall be placed next to the entry of the facility and within the facility, notifying consumers of the limitation. [2] No on-site consumption of food, beverages, or other products by patrons shall be permitted at a dispensary. (h) Entrance. The public entrance to the dispensary must be located in a building with a principal entrance at the street level and located on a public thoroughfare. The Planning Board shall ensure that the site is designed so that there is a clear entrance into the facility visible from the parking area and the public thoroughfare. (i) Screening. The Planning Board may require screening from neighboring properties if the Board deems screening is appropriate due to the location of the entrance, parking area, or operations of the facility. Page 17 of 25 (j) Outdoor furniture. There shall be no outdoor benches, seats, or congregating areas available to the public located on the same lot. (k) Lighting. The parking area and entrance shall be well lit during operational hours and for up to 1/2 hour following facility closure. Only security lighting shall be on when the facility is closed. Average horizontal lighting levels at the property line or beyond the property line shall not exceed 0.1 footcandles. All lighting shall be from full-cutoff night-sky friendly fixtures with a color temperature not to exceed 3000K. The Applicant shall indicate to the Planning Board the tyle of lighting to be used and indicate on the site plan that the lighting shall be reasonably contained to the site. (l) Hours. In accordance with §119.2 of the Cannabis Regulations, the hours of operation of an adult-use cannabis retail dispensary shall not be restricted to less than 70 hours per week. No retail dispensary shall operate before 8:00 am or after 11:00 pm Monday through Saturday and before 10:00 am on Sunday. (m) Grand Opening Plan. A Grand Opening Plan shall be submitted be submitted to the Planning Board. (n) Parking. The application shall meet the parking requirements of Appendix C and §270-30 of this chapter. (o) Vehicles and Traffic. [1] No drive-through sales to the public shall be permitted at a dispensary. [2] A plan for queuing of waiting customers based upon an estimate of peak demand may be requested by the Planning Board. [3] A Traffic Impact Report that includes potential traffic generation based upon the anticipated maximum demand may be required by the Planning Board. (2) Additional application information required for all adult-use cannabis retail dispensaries. (a) Proof of provisional or final licensure by the New York State Cannabis Control Board. (b) A narrative providing information about the type and scale of all activities that will take place on the premises, including but not limited to on-site sales, on-site deliveries, and other programs or activities. (c) The proposed hours of operation. (d) A copy of the security plan submitted by the Applicant to the New York State Cannabis Control Board and Office of Cannabis Management, including a narrative Page 18 of 25 description of the security installations, including security during closed hours. The Applicant shall provide the name, phone number and e-mail address of a contact person to notify regarding suspicious activities during or after operating hours. 270-26(B)(12) Vape shops, smoke shops, and cannabis and vape paraphernalia shops. (1) General standards applicable to all Vape shops, smoke shops, and cannabis and vape paraphernalia shops. No entrance into a Vape shops, smoke shops, and cannabis and vape paraphernalia shops shall be permitted within 1,000 feet of the entrance to an adult-use cannabis retail dispensary or within 1,000 feet of the entrance of an existing cannabis and tobacco paraphernalia shop. PARKING REQUIREMENTS 1 space per 350 square feet of gross floor area Page 19 of 25 LETTER OF RESOLUTION BETWEEN THE NEW YORK STATE URBAN DEVELOPMENT CORPORATION D/B/A EMPIRE STATE DEVELOPMENT, ANDTHE NEW YORK STATE OFFICE OF PARKS, RECREATION AND HISTORIC PRESERVATION, REGARDING THE VILLAGE OF OSSINING MULTI-MODAL TRANSPORTATION HUB VILLAGE OF OSSINING, WESTCHESTER COUNTY, NEW YORK OPRHP PR# 25PR02135 WHEREAS, the New York State Urban Development Corporation d/b/a Empire State Development (“ESD”) plans to administer funding to the Village of Ossining (“the Sponsor”) for the construction of the Village of Ossining Multi-Modal Transportation Hub (“the Project”) located at 30 Brandreth Street, Ossining, New York; and WHEREAS, the Project is located at Brandreth Street and Leonard Street on tax lot Section 89.19, Lot 4, Block 3 owned by the Village of Ossining; and WHEREAS, the Project would include the construction of a 22,475 square foot, four-story multi-modal transportation hub facility that includes approximately 240 parking spaces, charging infrastructure for electric/hybrid vehicles, and e-bikes/e-scooters, electrical work for future rooftop solar, and space for an e-bike rental vendor; and WHEREAS, the associated site improvements would include access to the Old Croton Aqueduct, which is listed in the State and National Registers of Historic Places and is a National Historic Landmark, a new asphalt driveway, a public plaza, landscaped areas, site utilities, and upgrades to the existing 41-space municipal parking lot to increase parking capacity for the immediate area; and WHEREAS, ESD has consulted with the Sponsor regarding the impacts of the project on historic properties and has invited them to sign this LOR; and WHEREAS, the Office of Parks, Recreation and Historic Preservation (“OPRHP”) has determined in consultation with ESD that the project will have an Adverse Impact on the Old Croton Aqueduct (“OCA”) NHL and the Downtown Ossining Historic District, which is listed in the State and National Registers of Historic Places, pursuant to the requirement of the New York State Historic Preservation Act (Article 14 of the New York State Parks, Recreation, and Historic Preservation Law, N.Y. PRHPL §14.09 et seq.) and applicable regulations (9NYCRR Part 428) and policies (collectively, “State Historic Preservation Act” or “SHPA”); and WHEREAS, OPRHP also noted that due to the size of the Project and its proximity to the OCA NHL, the proposed parking garage would have an adverse impact on historic resources and only a substantial reduction in size of the parking garage would be required to effectively avoid or minimize these impacts to historic resources; and, WHEREAS, the Sponsor, in a letter to OPRHP dated April 24, 2025 indicated that there are no prudent and feasible alternatives to the project as proposed; and WHEREAS, OPRHP by letter dated May 15, 2025 concurred that there are no prudent and feasible alternatives which would avoid or minimize adverse impacts to the OCA NHL; and Page 1 of 6 Page 20 of 25 NOW, THEREFORE, ESD and OPRHP agree that the Project shall be implemented in accordance with the following stipulations to take into account the impact of the Project on historic properties. STIPULATIONS 1. The existing on-site interpretive display, which captures the history of the Historic District and the OCA, will be updated. Text and images will be developed by a 36 CFR 61 qualified cultural resource consultant and submitted to OPRHP for comments and concurrence. 2. A Construction Protection Plan (“CPP”) will be developed to protect historic structures, including the OCA, within 90 feet of new construction and will be implemented by a licensed professional engineer. The CPP will be submitted to OPRHP for review and approval prior to the commencement of construction. OPRHP will have 30 days to review and comment on this document. 3. Design review for developed landscape plans. Consultation will include SHPO review of plans depicting the new construction at the following milestones: preliminary review (during the development phase) and final review (approximately 90% completion of design). The SHPO will have 30 days to review and comment at each milestone. 4. The Sponsor will fund the development of an educational program, developed by a 36 CFR 61 qualified cultural resource consultant, focused on the history of the Historic District and the OCA. This can take the form of an educational presentation or a pamphlet. Draft and final informational and graphic content will be submitted to OPRHP no later than 6 months after the construction has been completed. OTHER TERMS AND CONDITIONS 1. DURATION This LOR will expire if its terms are not carried out within five (5) years from the date of its execution. Prior to such time, ESD may consult with the other signatories to reconsider the terms of the LOR and amend it in accordance with Stipulation 4. 2. POST-REVIEW DISCOVERIES Should any previously unknown cultural resources be discovered during the implementation of the proposed Project, the Sponsor and their contractors will cease all work near the discovery and notify ESD and OPRHP within two (2) days of the discovery. The Sponsor, in consultation with ESD, and OPRHP, will develop and implement an appropriate treatment plan prior to resumption of activities near the discovery area. 3. MONITORING AND REPORTING Each year following the execution of this LOR until it expires or is terminated, the Sponsor shall provide all parties to this LOR, upon request, a summary report detailing work undertaken pursuant to its terms. Such report shall include any scheduling changes proposed, any problems encountered, and any disputes and objections received regarding the terms of this LOR. 4. AMENDMENTS This LOR may be amended when such an amendment is agreed to in writing by all signatories. The amendment will be effective on the date a copy is signed by all the signatories. 5. DISPUTE RESOLUTION Should any signatory to this LOR object at any time to the way the terms of this LOR are implemented, ESD shall consult with any entities it considers appropriate to resolve the objection. Prior to reaching a final decision on the dispute, ESD shall prepare a written response that considers any timely advice or Page 2 of 6 Page 21 of 25 comments from the signatories regarding the dispute and provide each with a copy of this written response. ESD shall proceed according to its final decision. 6. TERMINATION If any signatory to the LOR determines that its terms will not or cannot be carried out, that signatory shall immediately confer with the others to attempt to resolve a dispute or develop an amendment per Stipulation 4. If within thirty (30) days a dispute cannot be resolved or an agreement on an amendment cannot be reached, any signatory may terminate the LOR upon written notification to the other signatories. 7. COUNTERPARTS This LOR may be executed in counterparts, with a separate page for each signatory. This LOR will become effective upon the date of the final signature. ESD shall ensure that each signatory is provided a complete copy of the final LOR.
