Special Call Meeting Minutes City Hall 101 S Hickory, Ottawa, Kansas Minutes of May 24, 2023 The Governing Body met at 10:00 am this date for a Special Call City Commission Meeting with the following members present and participating to wit: Mayor Crowley, Mayor Pro Tem Skidmore, Commissioner Caylor, Commissioner Clayton, and Commissioner Graves. Mayor Crowley called the meeting to order. The Mayor welcomed the audience. Consent Agenda Commissioner Caylor made a motion, seconded by Commissioner Graves, to approve this consent agenda to include this Special Call Meeting agenda. The motion was considered, and upon being put, all present voted aye. The Mayor declared the consent agenda duly approved. Public Comments None given. Declaration Mayor Crowley stated that due to his relationship with the applicant, he would abstain from voting on the Moderate Income Housing application. Request for Approval of Resolution Supporting Moderate Incoming Housing (MIH) Application by Platinum Properties LLC The Governing Body heard from Interim Community Development Director Melanie Landis, who reviewed a resolution supporting the development of certain housing within the City of Ottawa and applying to the Kansas Housing Resource Corporation for Moderate Income Housing grant funds. This funding would be used to support the development of eleven residential apartment units in a mixed-use building with three commercial units in the downtown area by Platinum Properties LLC and discussed the following: • Unit would be located on Walnut Street between First and Second Streets • $2.2M project is proposed with financial support by owner equity, permanent financing and MIH grant award • Grant application process requires a resolution adopted by the Governing Body in support of the application • Deadline for submission of an MIH grant application is June 2, 2023 • Staff recommends adoption of the resolution Commissioner Caylor made a motion, seconded by Commissioner Graves, to adopt this resolution supporting the moderate incoming housing application by Platinum Properties LLC including up to the same contributions as a reduction in permit fees, a reduction in connection fees and a NRP application that were offered to the last grant 1 May 24, 2023 City of Ottawa Regular Meeting Minutes May 24, 2023 Page 2 applicant. The motion was considered and upon being put, passed by the following vote: Commissioner Clayton aye, Commissioner Graves aye, Mayor Pro Tem Skidmore aye, Commissioner Caylor aye, Commissioner Crowley abstained. The Mayor declared this resolution duly approved and this resolution was duly numbered Resolution No. 1939-23. The City was awarded an MIH grant in 2017 and then again under the newly restructured and funded program beginning with 101 S. Hickory the December 2022 award. Ottawa, KS 66067 The grant application process requires a Resolution adopted by the City Commission in support of the 785.229.3600 application. These funds are not intended to substitute housing resources specified for lower incomes. Therefore, if a community needs to develop housing for a population that includes households below 60% of AMI, KHRC has the right to make an exception on a circumstantial basis. WHEREAS, the City of Ottawa is responding to the Request for Proposals for Kansas Moderate Income Housing (MIH) funds to be submitted to the Kansas Housing Resources Corporation through the State Housing Trust Fund (SHTF); and WHEREAS, the proposed housing development consists of one project containing eleven (11) residential units by Platinum Properties LLC, located within the city limits of the City of Ottawa; and WHEREAS, the housing development will help to revitalize the existing neighborhood and provide housing opportunities to meet the needs of residents; and WHEREAS, the housing units will be targeted to households between 60 and 150 percent of HUD's state non-metro area median income; and WHEREAS, the development will have the benefit of providing quality, affordable housing to the community and will help to satisfy the need for new rental housing as described in the Residential Demand Analysis: Franklin County, Kansas, prepared in June 2021; and WHEREAS, the City of Ottawa has the capacity to administer MIH grant funding. The City of Ottawa successfully administered MIH grant funding for a project by Prairie Fire Development Group, LLC in 2017, is currently under contract for the December 2022 award of MIH funding with Heartland Design Build, LLC and has contracted with the Southeast Kansas Regional Planning Commission, a professional grant administrator, for the administration of MIH grant funding, including the fulfillment of the requirements of the Kansas Housing Resources Corporation. NOW, THEREFORE BE IT RESOLVED by the Governing Body of the City of Ottawa, Kansas, that the City of Ottawa supports and approves the development of the aforesaid housing project in the community, subject to City codes, ordinances, building permit process, appropriate zoning and any applicable agreements, and selects said project for the City of Ottawa’s application to the Kansas Housing Resources Corporation for Moderate Income Housing funds. In the event that any of the housing characteristics mentioned above should substantially change prior to issuance of a building permit, this resolution is null and void. It is an exciting opportunity to be able to partner with the City of Ottawa to provide much needed housing for our community. This project is somewhat unique to the City of Ottawa. It will provide needed affordable housing that will retain existing residents, attract new residents, attract new industry and, being located between first and second street on Walnut, help to revitalize our downtown area. I am a lifelong resident of Ottawa and have spent virtually my entire adult life as a developer/contractor in this community. In addition to being the owner of Wiseguys Construction, LLC since 1999, I formed Platinum Properties in 2017 as I realized the distinctive need for more affordable housing in this community. Platinum owns 4 single family homes, 18 duplexes/apartments, as well as 2 commercial properties in Ottawa, including joint ownership in The Bottle House Event Center. This project consists of a three story, 15,000 square foot mixed use commercial/ residential building in the C-4 district. Platinum has owned this property since 2021 with plans for development and has been exploring how to utilize this property for maximum benefit. Attached you will see the building consists of 5 three bedroom units each with an approximate square footage of 1185 sq. ft. It also houses 5 two bedroom units each with an approximate square footage of 1075 sq. ft. There is an additional “penthouse” apartment that is approximately 2200 sq. ft. The building will also contain 2 commercial units each approximately 1075 sq. ft. There is also a courtyard and on-site parking. Attached you will find plans for the building as well as site plans for a project that is ready to begin and will be completed within 18 months. This building already conforms to the existing C-4 requirements by the city zoning regulations. Having reviewed the regulations and stipulations from KHRC, this project squarely fits within the parameters to qualify for and MIH grant.
