Study Session Minutes Ottawa, Kansas Minutes of July 17, 2023 The Governing Body met at 4:00 pm this date at City Hall with the following members present and participating to wit: Mayor Crowley, Mayor Pro Tem Skidmore, Commissioner Caylor, Commissioner Graves and Commissioner Clayton. A quorum was present. Mayor Crowley called the meeting to order. Public Comments None were given. Hidden Lakes Subdivision Phase I Final Plat The Governing Body continued discussion on an application for an approximately 8.95-acre residential subdivision located east of the intersection of 19th and Princeton streets and consists of 25 lots, 24 of which are for single-family residential use. The plat includes public street construction, extension of utilities, sidewalks, street lighting, stormwater collection and management. Ms. Landis reviewed the following items: • Public comments have been received at both Planning Commission meetings as well as City Commission study sessions • A resolution has been provided for review o Recommendation is for consideration of approval of the proposed resolution accepting the final plat, easements, and right of way. • Draft Development Agreement is related to the public infrastructure to meet the City requirements based upon the approved stormwater study Public Comment was received from the following citizens: • Gary Harris, 1801 S. Princeton Street, stated he met with Belmont Development and discussed the stormwater concerns and the International Property Maintenance Code 304.7 • Karen Harris, 1801 S. Princeton Street, reviewed the timeline and minutes from Planning Commission meetings The Governing Body continued the discussion which included: • David Hamby, City Engineer, stated stormwater study shows a reduction in water flow for the 2, 10 and 100-year storm • The City Engineer would not review private improvements, but the code says it cannot adversely affect any neighbors Blaine Finch, City Attorney, reviewed the following: • Final plat document is binding on the developer to construct according to the plat • Part of the development agreement is accepting the plat, which includes public improvements shown on the plat, not accepting private improvements • Governing Body's role is subdivision regulations and what's shown on the face of the plat • Development Agreement states that they are going to complete the infrastructure and provide the City with a bond for assurance • Planning Commission is the recommending body and advisor to the Governing Body 1 July 17, 2023 City of Ottawa Study Session Minutes July 17, 2023 Page 2 • The Governing Body determines what is included in the final plat and development agreement The Governing Body agreed by consensus to place this item on the next regular meeting agenda on July 19, 2023 for further review. 2024 Budget Overview The Governing Body heard from Finance Director Melanie Landis, who reviewed the 2024 Budget and discussed the assessed valuation for 2023. Ms. Landis discussed the following: • 2023 assessed valuation received supports the 2024 budget • Proposed 2024 mill rate is 44.895, a 1.1 mill decrease from 2023 • Library fund, Ottawa Memorial Auditorium, and Debt Service are proposed with a level mill rate for 2024 • The following was accomplished with the 2024 proposed budget o Maintain current city services o Maintain fund balance carryover of $2,000,000 o Budget for a general fund reserve o Fund $585,000 of compensation study results o Maintain current employee health insurance benefit structure o Increase annual support for the Ottawa Municipal Airport for improvements grant matches o Continue 50% participation in the 911 Emergency Communications Budget • Flood insurance was discussed, and city staff will bring back a presentation on options • Community Partner requests have a small increase requested • Revenue Neutral Rate is 41.842, and the proposed budget proposes a 44.895 mill rate The Governing Body agreed by consensus to place the notice to exceed the Revenue Neutral Rate and publication on the next regular meeting agenda for July 19, 2023. Resolution Adopting Rules of Procedure for City Commission Meetings The Governing Body heard from City Manager Brian Silcott, who reviewed a resolution that adopts the rules of procedure previously approved at the June 21, 2023, regular meeting. The Governing Body agreed by consensus to place this item on the next regular meeting agenda on July 19, 2023. City Manager's Comments City Manager Brian Silcott thanked Finance Director and Interim Community Development Director Melanie Landis for her work in both departments. Mr. Silcott updated the Governing Body on current projects. Mr. Silcott also discussed the KMGA appointment for 2023-2025, which will be presented at the next regular meeting. Commissioner's Comments No comments were given. Mayor's Comments 2 July 17, 2023 City of Ottawa Study Session Minutes July 17, 2023 Page 3 Mayor Crowley had no comment. Announcements July 19, 2023 Regular Meeting July 24, 2023 Study Session Recess Mayor Crowley made a motion, seconded by Commissioner Clayton, to recess into executive session at 5:20 pm for a period of 10 minutes for the purpose of attorney/client consultation with the City Manager, Director of Utilities, and IT Director. The justification for the closed session is to engage in confidential and privileged communication with the board’s attorney by K.S.A. 75- 4319(b)(12). The open meeting is to resume in this room at 5:30. The Mayor declared the meeting duly recessed. Reconvene Mayor Crowley made a motion, seconded by Commissioner Clayton, to reconvene into open session. The motion was considered, and upon being put, all present voted aye. The Mayor declared the meeting duly reconvened at 5:30.
