Regular Meeting Minutes City Hall 101 S Hickory, Ottawa, Kansas Minutes of July 19, 2023 The Governing Body met at 10:00 am this date for the Regular City Commission Meeting with the following members present and participating to wit: Mayor Crowley, Mayor Pro Tem Skidmore, Commissioner Caylor, Commissioner Clayton, and Commissioner Graves. Mayor Crowley called the meeting to order. The Mayor welcomed the audience and led the Pledge of Allegiance to the American flag. Pastor Dakota Smith from Ottawa Bible Church gave the invocation. Consent Agenda Commissioner Graves made a motion, seconded by Commissioner Clayton, to approve this consent agenda to include minutes from June 19, 2023 Study Session, June 21, 2023 Regular Meeting, June 26, 2023 Study Session; application for a cereal malt beverage license for Riley Browning; appointment of City Manager Brian Silcott to the Kansas Municipal Gas Agency (KMGA) Board of Directors for a two-year term and this Regular Meeting agenda. The motion was considered, and upon being put, all present voted aye. The Mayor declared the consent agenda duly approved. Public Comments None given. Declaration The Governing Body stated they had received an email and had communications with the Harris family. Request for Approval of Resolution Approving the Final Plat and Accepting the Dedication of all Easements and Right-of-Ways Within the Hidden Lakes Subdivision The Governing Body heard from Interim Community Development Director Melanie Landis, who reviewed a resolution to approve the final plat and provided the following information: • Phase 1 of Hidden Lakes Subdivision, the applicant is proposing an approximately 8.95-acre residential subdivision located east of the intersection of 19th and Princeton • It consists of 25 lots, 24 are single-family residential use with one lot for community use • Plat includes public street construction and extension of utilities, sidewalks, street lighting, stormwater collection, and management • Final plat was submitted on March 25, 2023 • The City Engineer has approved the stormwater study and drainage plan • Traffic study found that future roadway improvements should be reevaluated as additional development occurs 1 July 19, 2023 City of Ottawa Regular Meeting Minutes July 19, 2023 Page 2 • The city is working to address the safety of Princeton Street and the intersection of 19th Street by first lowering the speed limit • Intersection plan has been revised collaboratively by Anderson Engineers, the City Engineer and Public Works • Belmont Development has engaged the two property owners who will be impacted by the extension of 19th Street and are in active negotiations • Developer has acceptably addressed City Staff comments • Planning Commission made a recommendation with acceptance of staff findings and a vote of 6-0 approval to move the final plat to the City Commission for consideration of approval Public comment was received from Gary Harris, 1801 S. Princeton and Karen Harris, 1801 S. Princeton, who opposed approval of the final plat. Commissioner Graves made a motion, seconded by Commissioner Clayton, to adopt this resolution. The motion was considered, and upon being put, all present voted aye. The Mayor declared this resolution duly adopted, and this resolution was duly numbered Resolution No. 1940-23. Notice of Indication to Exceed the Revenue Neutral Rate The Governing Body heard from Finance Director Melanie Landis regarding the notification to the Franklin County Clerk of the City of Ottawa’s intent to levy property tax exceeding the current Revenue Neutral Rate. Ms. Landis stated that this notification is due to the County Clerk by July 20, 2023 and reviewed the following: • Valuation for 2023 is $134 million; each mill that is adopted is equal to $134,085 which is a 9.96% increase over the 2022 assessed valuation • Approximately $2.8 million of the assessed valuation increase is related to new improvements or change in use • Revenue Neutral Rate for 2023 is 41.842 • 2024 proposed estimated mill rate is 44.895 • Proposed 2024 operating budget represents a 7.29% increase in ad valorem taxes over the 2023 budget • September 6, 2023 at 7:00 pm is the proposed budget public hearing Mayor Pro Tem Skidmore made a motion, seconded by Commissioner Graves, to approve the intent to exceed the Revenue Neutral Rate for 2024 with a proposed mill levy of 44.895. The motion was considered and upon being put, all present voted aye. The Mayor declared this item duly approved. Request for Approval to Set Date for Public Hearing to 2024 Operation Budget The Governing Body heard from Finance Director Melanie Landis, who requested approval of the Notice of Hearing to Exceed Revenue Neutral Rate and 2024 Budget Hearing. July 19, 2023 2 City of Ottawa Regular Meeting Minutes July 19, 2023 Page 3 Commissioner Clayton made a motion, seconded by Commissioner Caylor, to approve the publication of the Notice of Hearing to Exceed Revenue Neutral Rate and 2024 Budget Hearing calling these Hearings for September 6, 2023 at 7:00 pm at the City Hall Commission Chambers. The motion was considered and upon being put, all present voted aye. The Mayor declared the publication duly approved. Request for Approval of Resolution Adopting Rules of Procedure for City Commission Meetings The Governing Body heard from City Manager Brian Silcott, who reviewed citizen comment rules for City Commission meetings and provided the following information: • Comments received included incorporating the existing language contained on the agenda coversheet regarding public comments • Many cities adopt criteria for citizens addressing the Governing Body during both citizen commentary periods and on specific agenda items and public hearings • Purpose of the citizen comment procedure is to ensure that all parties present are given equal opportunity to speak and be heard by the elected officials of their communities • Draft proposal is based on the Code of Meeting Procedures for Kansas Cities Commissioner Clayton made a motion, seconded by Commissioner Graves, to adopt this resolution. The motion was considered, and upon being put, all present voted aye. The Mayor declared this resolution duly adopted, and this resolution was duly numbered Resolution No. 1941-23. City Manager’s Comments City Manager Brian Silcott had no comment. Commissioner’s Comments Commissioner Clayton stated that numerous hours go into budget preparation. Mayor Pro Tem Skidmore noted the review of the ordinance prohibiting chickens in City limits would be reviewed in the future. Mayor’s Comments Mayor Crowley had no comment.
