CALL TO ORDER Mayor Alfin called the meeting to order at 9:00 AM B. PLEDGE OF ALLEGIANCE TO THE FLAG C. ROLL CALL City Clerk Virginia Smith called the roll. All members were present. D. PUBLIC PARTICIPATION Public Participation shall be held in accordance with Section 286.0114 Florida Statutes. And pursuant to the City Council’s Meeting Policies and Procedures: (1) Each speaker shall at the podium, provide their name and may speak for up to 3 minutes. (2) The Public may provide comments to the City Council relative to matters not on the agenda at the times indicated in this Agenda. Following any comments from the public, there may be discussion by the City Council. (3) When addressing the City Council on specific, enumerated Agenda items, speakers shall: City of Palm Coast Created on 12/2/21 5 (a) direct all comments to the Mayor; (b) make their comments concise and to the point; (c) not speak more than once on the same subject; (d) not, by speech or otherwise, delay or interrupt the proceedings or the peace of the City Council; (e) obey the orders of the Mayor or the City Council; and (f) not make any irrelevant, impertinent or slanderous comments while addressing the City Council; which pursuant to Council rules, shall be considered disorderly. (4) Any person who becomes disorderly or who fails to confine his or her comments to the identified subject or business, shall be cautioned by the Mayor and thereafter must conclude his or her remarks on the subject within the remaining designated time limit. Any speaker failing to comply, as cautioned, shall be barred from making any additional comments during the meeting and may be removed, as necessary, for the remainder of the meeting. Laura Amara spoke on the need for dredging canals and on sea wall issues. William Hills has had a sewage problem for four years. He submitted a set of photos for Council. Also, the pavement of Clearview Court is being torn up. Mr. Hills agrees with previous speaker on canals. Steve Carr addressed Florida Park Drive issues and thoroughfare traffic. He is more concerned with the development all around the City and what is being done about the traffic being diverted from the neighborhoods. He also asked if there is a location on Palm Coast Connect where individuals who speak at Council Meetings get a response. Robert MacDonald thanked the gentleman who is on the Agenda today for his years of service and asked the audience to stand and applaud him. Al Krier represented the Committee for Safety on Cimmaron. Today has been a year since we started talking about the safety issue on Cimmaron. He thanked everyone for their support. E. MINUTES 1. PROCLAMATION - "BE LOCAL BUY LOCAL" Council Member Barbosa presented this Proclamation to local business owners in attendance: Clean Eats Kitchen - Jodee Soltes Eagle Pest Solutions - Brad Ward Chez Jacqueline - Shara Brodsky Gotcha Covered - Jay McAlister 3. PROCLAMATION – NOVEMBER 17, 2021 AS GIS DAY Council Member Klufas presented this Proclamation to members of the City's GIS Division: Laura Castelnovo – GIS Coordinator Cathleen Almberg – GIS Specialist Jacob Ejnes – GIS Specialist Monica Diaz – GIS Specialist 4. EMPLOYEE RECOGNITION VIDEO/PRESENTATION Ms. Kershaw presented a video to Council that showed Department Directors honoring employees who have gone above and beyond in recent days. 5. RECOGNITION OF PUBLIC SERVANT CHARLES "CHARLIE" ESPOSITO Mayor Alfin presented this honor of service to Mr. Charles "Charlie" Esposito. 6. UPDATES ON HOLIDAY FESTIVITIES Ms. Lauren Johnston presented an update on Holiday Festivities. G. ORDINANCES SECOND READ 7. ORDINANCE 2021-XX REZONING GRAND LANDINGS NORTH - APPLICATION #4873 City Attorney Borkert read the title into the record. Attorney Borkert reminded Council that this item is quasi-judicial and called for any ex-parte communications. There were none. Mr. Tyner and Ms. Myers presented to Council on this item. Public Comment: There were none. ORDINANCES FIRST READ 8. ORDINANCE 2021-XX AMENDING THE FUTURE LAND USE MAP DESIGNATION FOR 141.5+/- ACRES OF PROPERTY FROM RESIDENTIAL LOW-DENSITY AND CONSERVATION TO RESIDENTIAL AND CONSERVATION WITH SITE SPECIFIC POLICY TO LIMIT DEVELOPMENT TO 217 UNITS City Attorney Borkert read the title into the record. Mr. Tyner and Mr. Papa presented this item along with item 9. Applicant’s Attorney, Jay Livingston, was present for questions. Public Comment There were none. ORDINANCE 2021-XX AMENDING THE ZONING MAP DESIGNATION FOR 141.5+/- ACRES FROM FLAGLER COUNTY DESIGNATION OF PLANNED UNIT DEVELOPMENT (PUD) TO CITY DESIGNATION OF SINGLE-FAMILY RESIDENTIAL-1 (SFR-1) AND PRESERVATION (PRS)-GRAND RESERVE EAST City Attorney Borkert read the title into the record. Attorney Borkert reminded Council that this item is quasi-judicial and called for any ex-parte communications. There were none. This item was presented under item 8. Public Comment There were none. ORDINANCE 2021-XX ACCEPTING THE DISTRICTING COMMISSION REPORT AND REVISING THE CITY COUNCIL DISTRICTS City Attorney Borkert read the title into the record. Mr. Papa was available for questions as well as the Chair of the Districting Commission, Mr. Mike Martin. OTHER BUSINESS 11. LIAISON APPOINTMENTS TO VARIOUS SERVICE ORGANIZATIONS FOR FISCAL YEAR 2021-2022 Ms. Smith, City Clerk, presented this item to Council. Council concurred to appoint the same Council liaison to each of the organizations they currently serve on. The motion was made by Council Member Danko and seconded by Vice Mayor Branquinho to each remain in their liaison positions for fiscal year 2021-2022. 12. SELECT VICE MAYOR FOR 2021-2022 Ms. Smith presented this item to Council. Council Member Danko made a motion to appoint Vice Mayor Branquinho to remain as Vice Mayor for 2021-2022. Council Member Klufas seconded the motion. Public Comment: Mike Martin echoed Council Member Danko’s words that Vice Mayor Branquinho did a great job this past year and supports the nomination. There were no further comments. The motion passed unanimously. City of Palm Coast Created on 12/2/21 9 J. CONSENT 13. RESOLUTION 2021-XX APPROVING THE EXECUTION OF A FLORIDA INLAND NAVIGATION DISTRICT PROJECT AGREEMENT FOR THE CONSTRUCTION OF PART 2 ITEMS ASSOCIATED WITH ADDING WATER ACCESS AT WATERFRONT PARK There were no comments from Council. Randy Stapleford, Commissioner for FIND (Florida Inland Navigation District Commission), stated that he is excited about the ribbon cutting and the shovel and dirt activity for our beautiful new waterfront project. He is looking forward to Part 3 in the future with the new dock. RESOLUTION 2021-XX APPROVING A CONTRACT (#W1245) WITH THE FLORIDA DEPARTMENT OF CORRECTIONS FOR TWO STORMWATER INMATE LABOR WORK CREWS Pass Motion made to Adopt on consent by Vice Mayor Branquinho and seconded by Council Member Danko Approved - 5 - Mayor David Alfin, Vice Mayor Eddie Branquinho, Council Member Victor Barbosa, Council Member Ed Danko, Council Member Nick Klufas K. PUBLIC PARTICIPATION Remainder of Public Comments is limited to three (3) minutes each. Heather Badger, manager of WastePro, shared that WastePro supports Be Local Buy Local. They are a local business and hire locals. L. DISCUSSION BY CITY COUNCIL OF MATTERS NOT ON THE AGENDA Mayor Alfin shared that the City Council has received a final report on an Ethics violation charged on Council Member Danko. There is a suggestion in the report for training, and Mayor Alfin suggests all Council Members, including himself, accept the training on how to work with staff. Council Member Barbosa reminded the public that there is a Special Meeting tomorrow at 6:00 p.m. regarding the City Manager search. Vice Mayor Branquinho thanked Council for their support and confidence. Vice Mayor Branquinho addressed Council Member Danko regarding the Ethics investigation and suggested that all let bygones be bygones. Vice Mayor Branquinho saw nothing in the report that would require censure by the Council. Vice Mayor Branquinho shared that feeding 350 veterans and their families on Veteran's Day picnic was nice. The recognition of Charlie Esposito today was wonderful and emotional. Vice Mayor Branquinho acknowledged that Be Local Buy Local brought in $8 million in taxes, and then recognized all the employees City of Palm Coast Created on 12/2/21 11 highlighted in today’s video. Vice Mayor Branquinho teased that Chief Forte rigged the Fire Truck Pull for City of Palm Coast to win. Mayor Alfin reinforced what Council Member Barbosa said: we are tasked with one of the most important duties -- selecting a City Manager. Mayor Alfin encouraged the Council to make this their best effort because this determines the future of the City. Mayor Alfin appreciates all of the input and work that has gone into this matter. M. DISCUSSION BY CITY ATTORNEY OF MATTERS NOT ON THE AGENDA Nothing at this time. N. DISCUSSION BY CITY MANAGER OF MATTERS NOT ON THE AGENDA Ms. Bevan presented the monthly emergency and sole source purchases. Council had no questions. Ms. Bevan presented the meeting schedule for the Holidays by proposing a cancellation of the December 21st meeting and calling a Special Business Meeting to immediately follow the December 14th Workshop to facilitate any action that would be required. The next meeting would then be January 4, 2022. Council concurred. Ms. Bevan will be traveling out of state starting Friday to spend time with her family for Thanksgiving and has appointed Chief Forte, Interim Assistant Manager, to act on her behalf. She will return on November 30, 2021. 18. REPORTING OF EMERGENCY AND SOLE SOURCE PURCHASES FOR OCTOBER 2021 PURCHASES Ms. Bevan included this in her City Manager’s Report. There were no questions. O.
