MINUTES OF THE COUNCIL MEETING
OF THE CITY OF PAOLA, KANSAS
6:00 O’CLOCK P.M.
June 10, 2014
HELD AT THE PAOLA JUSTICE CENTER
805 North Pearl Street in Paola
The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding.
Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee
Gee Wilhoite, Leigh House, and Aaron Nickelson.
Council Members absent: None.
Also present: City Manager Jay Wieland, City Clerk Dan Droste, City Attorney
Lee Tetwiler, Public Works Director Craig Browning, Deputy
Police Chief Don Poore, City Planner Mike Gotfredson, Richard
Lentz, Evelyn Fegan, Kevin Smith, Chad Oehlert, and Jennifer
Salva with the Miami County Republic.
Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by Mayor
Stuteville.
Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite,
House, and Nickelson were all present. No one was absent.
Mayor Stuteville introduced Jennifer Salva who is the new intern for the Miami County Republic.
Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS:
Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that
is not an agenda item. No one addressed the Council.
Agenda Item 4 - CONSENT AGENDA:
a. Approval of minutes of the regular meeting of May 27, 2014.
b. Approval of Salary Ordinance 14-12.
c. Approval of Appropriation Ordinance No 778.
d. Approval of the Journal Entries Report for May, 2014.
e. Approval of the Pledged Securities Report for May, 2014.
f. Approval of the renewal of a Class A Private Club License for the American Legion.
g. Approval of the renewal of a Drinking Establishment License for El Potro Mexican
Restaurant.
h. Approval of a request from USD 368 to waive building permit fees in the amount of
$4,374.00.
Council Member Wilhoite made a motion to approve the Consent Agenda, including the correction
to the invoice to Hawkins Inc. on the Appropriation Ordinance, as presented and authorize the

Mayor to sign. The motion was seconded by Council Member House and all voted aye. The
motion passed 4 to 0.
Agenda Item 5 – REPORTS OF OFFICERS, BOARDS AND COMMITTEES:
Agenda Item 5a – Consider the approval of Payment Request No 2 for the repairs to the
Paola Family Pool.
Manager Wieland and Public Works Director Browning presented a payment request from
Carrothers Construction for the final payment to the pool repairs.
After additional discussion, Council Member Pritchard made a motion to approve payment request
#2 from Carrothers Construction Company, LLC in the amount of $117,384.00 for repairs to
the Paola Family Pool. The motion was seconded by Council Member Wilhoite and all voted aye.
The motion passed 4 to 0.
Agenda Item 5b – Consider an Ordinance repealing Ordinance No 2999 – Criminal Use
of Weapons.
Manager Wieland presented an Ordinance that repeals the City’s existing Ordinance pertaining
to the Criminal Use of Weapons. More specifically, the old ordinance restricted the open carry
of firearms in the City of Paola.
After additional discussion, Council Member House made a motion to approve AN
ORDINANCE REPEALING ORDINANCE NO. 2999. The motion was seconded by Council
Member Nickelson and all vote aye. The motion passed 4 to 0 and the Ordinance was assigned
number 3071.
Agenda Item 5c – Consider a Resolution restricting parking on the east side of Redbud
Drive.
Public Works Director Browning reported that currently vehicles park on both sides of Redbud Drive
creating a very narrow passage for two way traffic. Emergency vehicles and Snow Plows have a very
difficult time navigating this road. This situation also creates safety issues with the many children that
live in this neighborhood. Since January of this year, the Indian Hills Homes Association has looked at
many different ideas to solve these safety issues.
Public Works Director Browning reported that at the April meeting of the Homes Association, the
Board voted to purchase three community style mailbox kiosks. These new mailbox kiosks will help
facilitate the implementation of no parking restrictions without creating additional issues with mail
delivery. He also reported that the Homes Association sent two different notification and informative
letters to all residents of the Indian Hills. To date, only had one negative response was received and it
has been addressed. At their May meeting, the Homes Association Board voted to request a No Parking
Restriction along the sidewalk side of Redbud Drive.
Evelyn Fegan and Kevin Smith, who both reside on Redbud Drive, addressed the Council in
support of the parking restriction.

After additional discussion, Council Member Wilhoite made a motion to approve A
RESOLUTION AMENDING THE OFFICIAL TRAFFIC CONTROL DEVICE
SCHEDULES FOR THE CITY OF PAOLA, KANSAS. . The motion was seconded by
Council Member Pritchard. Council Members Pritchard, Wilhoite, and House voted aye and
Council Member Nickelson abstained because he lives on Redbud Drive. As an abstention is
counted toward the majority, the motion passed 4 to 0 and the Resolution was assigned number
2014-001.
Agenda Item 5d – Discussion regarding 2015 Budget.
Manager Wieland presented draft budgets for the Police Department, Fire Department, and
Municipal Court for 2015. He also presented a revision to the Transient Guest Tax Fund budget.
Each of the budgets were discussed in detail.
Clerk Droste presented a report of the year to date tax receipts for all of the mill levy funds. He
noted that with the latest distribution from the County, the tax revenue line items for the General
Fund, Library, Employee Benefits, and Bond & Interest funds, on average, are as follows:
Current Taxes 99%
Delinquent Taxes 148%
Motor Vehicle Taxes 75%
Special Assessments 119%
Agenda Item 6 – NEW BUSINESS
Clerk Droste reported that the Chamber of Commerce Annual Dinner will be held on Thursday,
June 19th at Town Square. The guest speaker is Danny O’Neill of The Roasterie, Inc. in Kansas
City.
Public Works Director Browning reported that the signs have been installed on the new trail kiosks
at Wallace Park. Everything will be completed in time for the dedication ceremony on Friday.
Manager Wieland reported that he has been working with Judy Welter at USD 368 on a
Memorandum of Understanding for the School Resource Officer.
Manager Wieland reported that he is also working on methods of financing for the crosswalk
improvements at Hospital and Baptiste Drives.
Manager Wieland reported that the elevator is being installed at the Library and the project should
be completed by mid-August.
Manager Wieland reported that his is continuing to look into the procedure for dispatching the Fire
Department on County ambulance calls. He and the City Manager are also reviewing the written
response agreement.
Council Member Pritchard reported that he recently attended a movie at the Community Center
with his grandson. He indicated that there were quite a few in attendance.

Mayor Stuteville reminded everyone that the Car Show is this coming Saturday and the dedication
ceremony for the Paola Pathways Trail at Wallace Park in on Friday at 10:00 am.
Council Member Nickelson thanked the Police Department for their role in assisting the Miami
County Sherriff’s Department in apprehending a criminal suspect.
Agenda Item 9 – ADJOURNMENT
With no additional business to come before the Council, Council Member Wilhoite made a motion
to adjourn. The motion was seconded by Council Member House and all voted aye. The motion
passed 4 to 0.
