MINUTES OF THE COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. June 24, 2014 HELD AT THE PAOLA JUSTICE CENTER 805 North Pearl Street in Paola The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee Gee Wilhoite, Leigh House, and Aaron Nickelson. Council Members absent: None. Also present: City Clerk Dan Droste, City Attorney Lee Tetwiler, Police Chief Dave Smail, City Planner Mike Gotfredson, Gabe Cunningham, and Brian McCauley with the Miami County Republic. Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville. Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, House, and Nickelson were all present. No one was absent. Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS: Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that is not an agenda item. No one addressed the Council. Agenda Item 4 - CONSENT AGENDA: a. Approval of minutes of the regular meeting of June 10, 2014. b. Approval of Salary Ordinance 14-13. c. Approval of Appropriation Ordinance No 779. Council Member Wilhoite made a motion to approve the Consent Agenda as presented and authorize the Mayor to sign. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 4 to 0. Agenda Item 5 – REPORTS OF OFFICERS, BOARDS AND COMMITTEES: Agenda Item 5a – Consider a lease agreement with the Miami County Fair Association for the use of property in Wallace Park for the Miami County Fair from July 19 to July 27, 2014. Clerk Droste presented the annual lease agreement with the Miami County Fair Association for the use of a portion of Wallace Park during the 2014 Miami County Fair. Paola City Council Minutes – June 24, 2014 Page 1 Council Member Pritchard made a motion to approve the Lease with the Miami County Fair Association and authorize the Mayor to sign. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 4 to 0. Agenda Item 5b – Consider approval of an amendment to the agreement with Miami County Fire District #1 increasing the number of pieces of apparatus stored at the Paola Fire Station from “not more than 6” to “not more than 7”. Clerk Droste presented an amendment to the agreement with Miami County Fire District No 1 which would increase the number of pieces of apparatus stored at the Paola Fire Station. Currently, the Fire District is considering the purchase of a 4 wheel drive ATV to more effectively fight grass fires. The proposed amendment would allow for this piece of equipment to be stored at our Fire Station. After additional discussion, Council Member Pritchard made a motion to approve Addendum #1 to the Agreement between Miami County Fire District #1 and the City of Paola and authorize the Mayor to sign. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 4 to 0. Agenda Item 5c – Consider the approval of Payment Request No 10 for the Library Addition and Renovation Project #2013-001 – Part A. Clerk Droste presented a payment request for the Library addition and renovation project. He reported that the drilling for the geothermal HVAC system was completed last week. The contractor has indicated that the wrong doors were shipped with the elevator and that the correct doors were shipped from the factory today. The project is still on schedule for completion at the end of August. After additional discussion, Council Member Wilhoite made a motion to approve payment request #10 from Legacy Contractors, LLC in the net amount of $134,544 for the Library addition and renovation project #2013-001-Part A. The motion was seconded by Council Member House and all voted aye. The motion passed 4 to 0. Agenda Item 5d – Consider the approval of Payment Request No 6 for the Library Addition and Renovation Project #2013-001 – Part B. Pursuant to the previous discussion, Council Member Pritchard made a motion to approve payment request #6 from Legacy Contractors, LLC in the net amount of $51,262.00 for the Library addition and renovation project #2013-001-Part B. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 4 to 0. Agenda Item 5e – Discussion regarding 2015 Budget. Clerk Droste reported that he received the assessed valuation report from the County Clerk for the 2015 Budget. The new total assessed valuation is $45,464,567 which is $233,025 or 0.513% more than last year. He reported that now that the assessed valuation report has been received, the mill levy fund budgets can be completed. Additional budget reports will be presented at the Council work study meeting in July. Paola City Council Minutes – June 24, 2014 Page 2 Agenda Item 6 – NEW BUSINESS Clerk Droste reported that sales tax revenues for the month of June amounted to $209,367 bringing the year to date total to $1,151,389 which is 6.73% more than the same time period in 2013. City Planner Gotfredson introduced Gabe Cunningham with Boy Scout Troop 103 who is attending to complete the requirements for his Citizenship in the Community Merit Badge. Clerk Droste updated the Council on the recent damage to the lawn at the Park Square. He reported that the damage is not covered under the City’s insurance policy. Council Member Pritchard reported that he received complaints that people are driving too fast near the ball fields since the new asphalt was installed in Wallace Park. Council Member Wilhoite reported that she has received many positive comments about the improvements to Shawnee Street. Council Member House presented a check to Paola Pathways for a bench in Phase II from her grandmother, Alice Grandon in memory of Jerry Grandon. Council Member Nickelson reported that he enjoyed the Paola Chamber of Commerce Annual Dinner, especially the keynote speaker. Agenda Item 9 – ADJOURNMENT With no additional business to come before the Council, Council Member Wilhoite made a motion to adjourn. The motion was seconded by Council Member Pritchard and all voted aye.
