MINUTES OF THE COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS 6:00 O’CLOCK P.M. October 28, 2014 HELD AT THE PAOLA JUSTICE CENTER 805 North Pearl Street in Paola The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding. Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee Gee Wilhoite, Leigh House and Aaron Nickelson. Council Members absent: None. Also present: City Manager Jay Wieland, City Clerk Dan Droste, City Attorney Lee Tetwiler, Public Works Director Craig Browning, Police Chief Dave Smail, and City Planner Mike Gotfredson. Agenda Item 1 - CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville. Agenda Item 2 - ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, House, and Nickelson were all present. No one was absent. Agenda Item 3 - PETITIONS, REMONSTRANCES, AND COMMUNICATIONS: Mayor Stuteville asked the audience if anyone desired to address the Council about any issue that is not an agenda item. No one addressed the Council. Agenda Item 4 - CONSENT AGENDA: a. Approval of minutes of the regular meeting of October 14, 2014. b. Approval of Salary Ordinance 14-24. c. Approval of Appropriation Ordinance No 787. After a discussion, Council Member Wilhoite made a motion to approve the Consent Agenda as presented and authorize the Mayor to sign. The motion was seconded by Council Member Pritchard and all voted aye. The motion passed 4 to 0. Agenda Item 5 – REPORTS OF OFFICERS, BOARDS AND COMMITTEES: Agenda Item 5a – Consider approval of temporary street closures for the annual Paola Chamber of Commerce Halloween Parade on October 31st. Paola City Council Minutes – October 28, 2014 Page 1 Manager Wieland presented a request from the Paola Chamber of Commerce to close the streets immediately adjacent to the Park Square for the annual Halloween Parade on Friday October 31st. Council Member Pritchard made a motion to approve the closure of Silver, Pearl, Peoria, and Wea Streets adjacent to the Park Square on October 31st from 5:30 pm to 7:30 pm for the annual Paola Chamber of Commerce Halloween Parade. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 4 to 0. Agenda Item 5b – Consider approval of an Ordinance amending the General Regulations of the Water Department pertaining to meter tampering, theft of water, and penalties. Manager Wieland reported on a recent incident that initiated a review of the City Code relating to water meter tampering and theft of water. He noted that the code needed to be updated to specifically address water meter tampering, theft of water, and the penalties related to these actions. After additional discussion, Council Member Pritchard made a motion to approve AN ORDINANCE AMENDING TITLE VII: UTILITIES, CHAPTER 700: WATER DEPARTMENT, ARTICLE I: GENERAL REGULATIONS, ADDING SECTION 700.025: UTILITY, METER, OR METER BOX DAMAGE; AMENDING SECTION 700.170: UNLAWFUL USE OF WATER; AND AMEDING SECTION 700.240: PENALTY; OF THE MUNICIPAL CODE OF THE CITY OF PAOLA, KANSAS. The motion was seconded by Council Member Wilhoite and all voted aye. The motion passed 4 to 0 and the Ordinance was assigned number 3077. Agenda Item 5c Consider moving the date of the November 11th City Council Meeting as this meeting date falls on Veterans Day. Council Member House made a motion to move the next regular meeting date of the Paola City Council to Monday, November 10, 2014 at 6:00 pm at the Paola Justice Center pursuant to Chapter 105, Article I, Section 105.120 of the Paola Municipal Code. The motion was seconded by Council Member Nickelson and all voted aye. The motion passed 4 to 0. Agenda Item 6 – NEW BUSINESS Clerk Droste reported that sales tax revenue for the month of October amounted to $195,358 bringing the year to date total to $1,948,841 which is 4.03% more than the same time period last year. City Attorney Tetwiler made a brief report to the Council regarding a recent trial. City Manager Wieland reported that at a recent Chamber of Commerce event, the owners of Reliance Label Solutions were very complimentary of the City for efforts made in assisting with their recent plant expansion. Paola City Council Minutes – October 28, 2014 Page 2 City Manager Wieland reported that Chamber Director Jason Camis will be resigning to accept a position with the City of Gardner Chamber of Commerce at the end of November. The City will be working with the Chamber Board as they search for a replacement. Mayor Stuteville inquired about street repairs on Lakemary Drive. Public Works Director Browning reported that repairs will be completed in the spring after the current construction project is completed. Agenda Item 7 – EXECUTIVE SESSION for the purpose of discussing personnel matters of non-elected personnel. K.S.A. 75-4319(B)(1) is the authority for this recess. Council Member Pritchard announced that the Executive Session for discussing personnel matters of non-elected personnel will not take place this evening. It will be included on the agenda of the next meeting. Agenda Item 8 – ADJOURNMENT With no additional business to come before the Council, Council Member Nickelson made a motion to adjourn. The motion was seconded by Council Member Wilhoite and all voted aye.
