MINUTES OF THE COUNCIL MEETING
OF THE CITY OF PAOLA, KANSAS
6:00 O’CLOCK P.M.
September 13, 2016
Held in the Municipal Court Room at the Paola Justice Center
805 North Pearl Street in Paola
The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding.
Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee
Gee Wilhoite, Leigh House, and Aaron Nickelson.
Council Members absent: No one was absent.
Also present: City Manager Jay Wieland, City Clerk Dan Droste, City Attorney
Lee Tetwiler, City Planner Mike Gotfredson, Interim Public Works
Director Kirk Rees, Chief of Police Paul Jokerst, Mike Gibson,
Richard Lentz, Julie Ritch, Jacob Ritch, Rachel Brown, Josephine
Miller, Tammy Medlin, Brian McCauley with the Miami County
Republic, and others.
CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville.
ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, House, and Nickelson
were present. No one was absent.
PRESENTATION OF “CITIZEN PUBLIC SERVICE AWARDS”: Chief of Police Paul
Jokerst introduced Julie and Jacob Ritch who on August 16th found a wallet in the roadway at the
intersection of Peoria and Silver Street. In addition to identification and credit cards, the wallet
contained nearly $2,000 in cash. Mr. & Mrs. Ritch turned the wallet over to the Paola Police
Department to return the wallet to the owner. Chief Jokerst presented Julie and Jacob Ritch with
Citizen Public Service Awards.
Agenda Item 1 - CONSENT AGENDA
a. Approval of minutes of the meetings of August 23, 2016
b. Approval of Salary Ordinance 16-18.
c. Approval of Appropriation Ordinance No 835.
d. Approval of the Pledged Security Report for August, 2016.
e. Approval of the Journal Entries Report for August, 2016.
Council Member Wilhoite made a motion to approve the Consent Agenda as presented and
authorize the Mayor to sign. The motion was seconded by Council Member Nickelson and all
voted aye. The motion passed 4 to 0.
Agenda Item 2 - COMMENTS FROM THE PUBLIC
Tammy Medlin addressed the Council in regard to the feral cat problem in Paola. She
recommended that the City of Paola consider adopting the “Trap – Neuter – Return” program to
assist in controlling the feral cat population. She indicated that the City of Ottawa has adopted this

program. After a discussion, City Manager Wieland agreed to contact the City Manager of Ottawa
to discuss the program with him.
No one else addressed the Council.
Agenda Item 3 - UNFINISHED BUSINESS – None.
Agenda Item 4 - NEW BUSINESS
Agenda Item 4a - Consider a report from the Paola Building Inspector regarding a dangerous
structure located at 104 E Miami pursuant to KSA 12-1752.
City Planner Gotfredson presented a report from Paola Building Inspector, Bill Trout, regarding
the property located at 104 E Miami Street. In the report, Trout details the following issues and
conditions of the property:
This house has been vacant since April 2009.
Rottenness is damaging the house and the garage.
No electricity or water at this time.
Front porch is in unsafe condition.
Some siding and soffits are falling off of the house.
Plumbing/ Electrical /HVAC needs to be up to codes
Water from rain is going into the open soffits and into the attic space.
The roof on the garage and the house look unsafe with obvious bowing visible.
Weeds and vines are all over the house and the yard.
After additional discussion, Council Member Nickelson made a motion to accept the report from
Paola Building Inspector, William Trout, Sr., declaring 104 E Miami as unsafe and dangerous
structures pursuant to KSA 12-1752. The motion was seconded by Council Member Wilhoite and
all voted aye. The motion passed 4 to 0.
Agenda Item 4b - Consider a Resolution Fixing the Time and Place of Condemnation Hearing
for the property located at 104 E Miami, Paola, Kansas, pursuant to KSA 12-1752.
Clerk Droste presented a Resolution Fixing the Time and Place of Condemnation Hearing for the
property located at 104 E Miami, Paola, Kansas. He explained that the resolution must be published
and mailed to all parties of interest according to KSA 12-1752. The proposed date for the public
hearing is Tuesday, November 8, 2016, at 6:00 pm at the Paola Justice Center during the regularly
scheduled City Council meeting.
After additional discussion, Council Member Pritchard made a motion to adopt A RESOLUTION
FIXING A TIME AND PLACE AND PROVIDING FOR NOTICE OF A HEARING BEFORE
THE GOVERNING BODY OF THE CITY OF PAOLA, KANSAS, AT WHICH THE OWNER,
HIS OR HER AGENT, LIENHOLDERS OF RECORD, OCCUPANTS, AND OTHER PARTIES
IN INTEREST OF STRUCTURES LOCATED WITHIN SAID CITY AND DESCRIBED
HEREIN MAY APPEAR AND SHOW CAUSE WHY SUCH STRUCTURES SHOULD NOT
BE CONDEMNED AND ORDERED REPAIRED OR DEMOLISHED AS UNSAFE OR
DANGEROUS STRUCTURES. The motion was seconded by Council Member Wilhoite and all
voted aye. The motion passed 4 to 0 and the Resolution was assigned number 2016-008.

Agenda Item 4c - Consider an Ordinance amending Contractor Licensing Fees and Building
Permit Fees for Residential and Commercial Re-roofing.
City Planner Gotfredson presented an ordinance amending Building Permit Fees for the re-roofing
of residential and commercial buildings from a flat fee to a fee based on value; and increasing the
License Fee for General Contractors from $125.00 to $150.00 and the License Fee for Special
Trades Contractors from $75.00 to $100.00.
After additional discussion, Council Member House made a motion to approve AN ORDINANCE
AMENDING SECTION 500.310, FEES, AND SECTION 500.420, CONTRACTOR LICENSE, OF
THE CODE OF THE CITY OF PAOLA, KANSAS, 2009. The motion was seconded by Council
Member Nickelson and all voted aye. The motion passed 4 to 0 and the Ordinance was assigned
number 3102.
Agenda Item 4d - Consider a Resolution changing the location of the October 11, 2016 City
Council meeting.
Manager Wieland reported that the Paola Police Department is hosting a multi-department training
on the new interactive video training system. The training is scheduled for the week of October
10th and will last for several days. The training will be held in the Municipal Court Room and due
to the time and effort involved in setting up and taking down the training system, the Police
Department has inquired if the Council would be agreeable to hold its October 11 th meeting at an
alternate location. He presented a Resolution to change the location of the regular meeting on
October 11th to the second floor conference room at the Paola Fire Station.
After additional discussion, Council Member Pritchard made a motion to adopt A RESOLUTION
CHANGING THE LOCATION OF THE OCTOBER 11, 2016 PAOLA CITY COUNCIL
MEETING. The motion was seconded by Council Member Wilhoite and all voted aye. The motion
passed 4 to 0 and the Resolution was assigned number 2016-009.
Agenda Item 5 - COMMITTEE REPORTS
There were no Committee Reports presented.
Agenda Item 6 - STAFF REPORTS
Clerk Droste reported that the League of Kansas Municipality “Regional Supper” will be
held at Atchison on Wednesday, October 26th at 5:30 pm.
City Planner Gotfredson reported that on Thursday, September 22nd at 1:30 pm, the
Sunflower Foundation will be at City Hall to meet and discuss the success of the Paola
Pathways project. The Sunflower Foundation has provided grants in the amount of $50,000
for the project.
Chief of Police Jokerst reported that the Department developed a physical agility test for
new applicants for the Police Department. He noted that 27 employees of the City and the
County participated in a trial of the test. The test will be administered to 5 applicants
tomorrow morning and those that pass will move on in the evaluation process with a written
test.

Interim Public Works Director Rees reported that Public Works has been very busy getting
caught up with mowing and tree trimming. The rain has delayed progress on the curb and
sidewalk installation at the new Jail.
Manager Wieland reported that a part of the Price Chopper remodeling, they will be
installing a marquee sign that would be able to promote community events as well as sale
information at the store. The City is working with KCP&L to move some power poles that
are in the location of the proposed sign.
Manager Wieland reported that the permit for the addition to the Prairie Place Apartments
has been issued. The addition includes 17 units as well as a community building and
offices.
Manager Wieland reported that he completed his visit to the City of Mulvane as a part of
the “First Impressions” program. On Thursday, November 10th at 8:00 am at the Jackson
Hotel, the team from Kansas State will present the findings in a “community conversation”.
Manager Wieland reported that the City will be addressing a long list of properties with
maintenance and nuisance issues. Additionally, the Police Department has been asked to
make recommendations for the safety of the intersection at Pearl and Piankishaw Streets.
Manager Wieland reported that the traffic counter has been installed on Holly Lane to
gather additional traffic data.
Agenda Item 7 - MISCELLANEOUS MATTERS FROM THE COUNCIL
Council Member House reported that she has been approached about a driveway issue in
Rockwood Estates. The issue was discussed at length in general terms.
Council Member Nickelson reported that he would not be in attendance at the next City
Council meeting.
Agenda Item 8 - MISCELLANEOUS MATTERS FROM THE MAYOR
Nothing additional was discussed.
Agenda Item 9 – ADJOURNMENT
With no additional business to come before the Council, Council Member Wilhoite made a motion
to adjourn. The motion was seconded by Council Member Pritchard and all voted aye. The motion
passed 4 to 0.
