MINUTES OF THE COUNCIL MEETING
OF THE CITY OF PAOLA, KANSAS
6:00 O’CLOCK P.M.
December 12, 2017
Held in the Municipal Court Room at the Paola Justice Center
806 N Pearl Street in Paola
The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding.
Council Members present: Mayor Artie Stuteville and Council Members Jim Pritchard, Gee
Gee Wilhoite, Leigh House, and Aaron Nickelson.
Council Members absent: None.
Also present: City Manager Jay Wieland, City Clerk Dan Droste, Assistant
City Clerk Stephanie Marler, City Attorney Lee Tetwiler, Chief
of Police Don Poore, Public Works Director Kirk Rees, Human
Resources Director Vicki Belt, Police Sergeant Nick Gazzano,
Police Officer Mark Miller, Dave Smail, Dennis Steele, Noah
Stringham, Steve Stringham, and others.
CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville.
ROLL CALL: Mayor Stuteville and Council Members Pritchard, Wilhoite, House, and
Nickelson were all present. No one was absent.
SPECIAL RECOGNITION: Police Sergeant Nick Gazzano and Police Officer Mark Miller
were recognized for their efforts in providing first responder assistance during a medical
emergency on November 22nd. A letter from a relative of the family was read thanking
Gazzano and Miller for their prompt, professional, and compassionate assistance.
Agenda Item 1 - CONSENT AGENDA
a. Approval of minutes of the meeting of November 14, 2017 and December 5, 2017.
b. Approval of Salary Ordinances 17-24 and 17-25.
c. Approval of Appropriation Ordinances 865 and 866.
d. Approval of the Journal Entries Report for November, 2017.
e. Approval of the Pledged Collateral Report for November, 2017.
f. Approval of the renewal of a Drinking Establishment License for Spudley’s at 2
Morningside Drive.
g. Approval of the renewal of the Class “A” Private Club License for the VFW at 202

i. Approval of a leak allowance in the amount of $397.12 or USD 368.
Council Member Nickelson made a motion to approve the Consent Agenda as presented and
authorize the Mayor to sign. The motion was seconded by Council Member House and all
voted aye. The motion passed 4 to 0.
Agenda Item 2 - COMMENTS FROM THE PUBLIC – Boy Scout Noah Stringham
introduced himself and his father, Steve Stringham. Noah indicated that he was in attendance
to complete a merit badge requirement.
Agenda Item 3 - UNFINISHED BUSINESS – None.
Agenda Item 4 – NEW BUSINESS
Agenda Item 4a - Consider applications for new Cereal Malt Beverage Licenses for
Paradise Cove, LLC at 110 W Peoria Street.
Clerk Droste reported that he has received applications for the sale and consumption of Cereal
Malt Beverages on premises and for package sales of Cereal Malt Beverages from Mr. Dennis
Steele who operates the Paradise Cove at 110 W Peoria Street. He reported that the applicant
has satisfactorily completed the background investigation and the business facility did pass the
required fire safety inspection. The business is not located within 200 feet of a church or a
school so a public hearing is not required.
After additional discussion, Council Member Nickelson made a motion to approve the Cereal
Malt Beverage Licenses for consumption on premises and for package sales for consumption
off premises for Paradise Cove, LLC at 110 W Peoria Street. The motion was seconded by
Council Member House. Council Members Pritchard, House, and Nickelson voted aye and
Council Member Wilhoite abstained. As an abstention is counted toward the majority, the
motion passed 4 to 0.
Agenda Item 4b - Consider approval of the purchase of a vehicle for the Police
Department.
Manager Wieland reported that the Police Department has been searching for a used vehicle
to replace one of the older vehicles in the fleet. A 2015 Ford Taurus with 41,723 miles was
located at Bob Allen Ford in Ottawa, KS. After a trade in allowance for the old vehicle, the
cost of the vehicle is $11,696.50. The cost of the vehicle will be paid from the Police
Department Drug Fund.
Council Member Wilhoite made a motion to approve the purchase of a 2015 Ford Taurus from
Bob Allen Ford in Ottawa, Kansas, in the net amount of $11,696.50 after a trade in allowance
of $4,000.00 for a 2005 Dodge Ram Pickup. The motion was seconded by Council Member
Nickelson and all voted aye. The motion passed 4 to 0.

Agenda Item 4c - Consider approval of a “Request for Consent to Modifications” from
Verizon Wireless to modify equipment located on the City’s water tower.
Manager Wieland presented a request from Verizon Wireless to modify the equipment that
they have located on the City’s water tower. He reported that Verizon did provide the required
engineering drawings and that the Public Works Department reviewed the request. Manager
Wieland recommended that the modification request be approved.
After additional discussion, Council Member Nickelson made a motion to approve the
“Request for Consent to Modifications” from Verizon Wireless, as presented, and authorize
the City Manager to sign. The motion was seconded by Council Member Wilhoite and all voted
aye. The motion passed 4 to 0.
Agenda Item 4d - Consider approval of employee Christmas gifts and Workers
Compensation Safety Awards.
Manager Wieland requested that the City Council authorize the purchase of $60 gift cards for
each of the City’s employees as a Christmas gift. He also requested that the City Council
approve a 1 day floating paid holiday for each employee as a reward for the outstanding safety
record that was achieved in 2017.
After additional discussion, Council Member House made a motion to approve the issuance of
a $60 gift card as a Christmas gift and to award a 1 day floating paid holiday as a safety award
to City employees. The motion was seconded by Council Member Wilhoite and all voted aye.
The motion passed 4 to 0.
Agenda Item 5 - COMMITTEE REPORTS – None.
Agenda Item 6 - STAFF REPORTS
Clerk Droste reported that sales tax revenue for the month of November amounted to $222,217
bringing the year-to-date total to $2,360,460 which is 4.94% more than the same time period
last year.
Clerk Droste presented a preliminary budget analysis summary for 2017. He reported that, in
total, year-to-date revenues through November 30th are $14,435,528 or 93.8% of the amended
budget, and year-to-date expenditures are 10,575,839 or 88.8% of the amended budget.
Clerk Droste reminded everyone that the January City Council meeting will be held on the
second Monday of the month on January 8th in compliance with the new State Statutes for the
installation of newly elected and re-elected officials.
Agenda Item 7 - MISCELLANEOUS MATTERS FROM THE COUNCIL
Council Member Pritchard wished everyone a Merry Christmas.

Council Member Wilhoite thanked the Police Department for their thoughtfulness in checking
on her well being recently. She also wished everyone a Merry Christmas.
Council Member House passed along a compliment that she recently received from a friend
who lives in Hillsdale. The friend commented on how nice the City of Paola looks. She also
wished everyone a Merry Christmas.
Council Member Nickelson passed along compliments from a friend who attended the
Tallgrass Theater production of “A Christmas Carol Live Radio Show” at the Paola
Community Center. He also wished everyone Merry Christmas.
Agenda Item 8 - MISCELLANEOUS MATTERS FROM THE MAYOR
Mayor Stuteville also wished everyone a Merry Christmas and a Happy New Year.
Agenda Item 9 – ADJOURNMENT
With no additional business to come before the Council, Council Member Pritchard made a
motion to adjourn. The motion was seconded by Council Member Wilhoite and all voted aye.
The motion passed 4 to 0.
