MINUTES OF THE COUNCIL MEETING
OF THE CITY OF PAOLA, KANSAS
6:00 O’CLOCK P.M.
November 12, 2019
Held in the Municipal Court Room at the Paola Justice Center
806 N Pearl Street in Paola
The Governing Body of the City of Paola, Kansas, met with Mayor Stuteville presiding.
Council Members present: Mayor Artie Stuteville and Council Members Dave Smail, Trent
Upshaw, Leigh House and Aaron Nickelson.
Council Members absent: None
Also present: City Manager Jay Wieland, Police Chief Don Poore, Public
Works Director Kirk Rees, Assistant City Manager Randi
Shannon, HR Director Vicki Belt, and Brian McCauley with the
Miami County Republic.
CALL TO ORDER: The regular council meeting was called to order by Mayor Stuteville.
ROLL CALL: Mayor Stuteville and Council Members Smail, Upshaw, House and Nickelson
were all present.
Agenda Item 1 - CONSENT AGENDA
a. Approval of minutes of the meeting of October 8, 2019.
b.Approval of Salary Ordinances 19-22 and 19-23.
c. Approval of Appropriation Ordinances 913 and 914.
d.Approval of the Pledged Collateral Report for October 2019.
e. Approval of the Journal Entries Reports for October 2019.
f. Approval of minutes of the Special meeting of October 14, 2019.
g.Approval of minutes of the Special meeting of October 16, 2019.
Council Member Upshaw made a motion to approve the Consent Agenda as presented and
authorize the Mayor to sign. The motion was seconded by Council Member House and all
voted aye. The motion passed 4 to 0.
Agenda Item 2 - COMMENTS FROM THE PUBLIC: None
Agenda Item 3 – UNFINISHED BUSINESS:
Agenda Item 3a - Public Hearing to consider the creation of the proposed Community
Improvement District.

Council Member House made a motion to open the public hearing to discuss the creation of
the proposed Community Improvement District. The motion was seconded by Council
Member Nickelson and all voted aye. The motion passed 4 to 0.
Manager Wieland gave some background on the proposed district, informing the CID sales
tax will be 1.25% and anticipated eligible costs are $950,000 - $1.2 million with no burden
on the City. The CID will have a sunset of 22 years from the date the sales tax is imposed.
Manager Wieland discussed the location of the district to be east of Arby’s. The plan is to
extend the street to the south of that business for access to the new district.
Manager Wieland noted at the conclusion of the public hearing the Ordinance establishing the
district, if passed, will only become effective after the signing of the final agreement.
With no further comments Council Member Smail made a motion to close the public hearing.
The motion was seconded by Council Member Upshaw and all voted aye. The motion passed
4 to 0.
Agenda Item 3b - Consider adoption of an Ordinance establishing a Community
Improvement District within the City of Paola.
Council Member Nickelson made a motion to approve AN ORDINANCE CREATING THE
PAOLA CROSSINGS NO. 1 COMMUNITY IMPROVEMENT DISTRICT IN THE CITY
OF PAOLA, KANSAS AND AUTHORIZING THE LEVY OF A COMMUNITY
IMPROVEMENT DISTRICT RETAILERS’ SALES TAX TO BE COLLECTED WITHIN
THE DISTRICT. The motion was seconded by Council Member House and all vote aye. The
motion passed 4 to 0 and was given Ordinance No. 3150. The ordinance will become effective
once the final agreement has been signed.
Agenda Item 4 – NEW BUSINESS
Agenda Item 4a - Report on Election Results
Manager Wieland reported that the general election was held on November 5, 2019 to elect Mayor
and Council Members from Ward 1 and Ward 3. The unofficial results of the election are as
follows:
Mayor: Artie Stuteville 433 votes 59.97%
Bobby Knudsen 286 votes 39.61%
Ward 1: Dave Smail 112 votes 53.33%
Scott Shappell 98 votes 46.67%
Ward 3: Leigh House 160 votes 98.16%

Manager Wieland also reported on the question to renew the half cent sales tax to fund the
pool/parks/and street program. The results are as follows:
Paola Sales Tax Yes 550 Votes 75.45%
No 179 votes 24.55%
Manager Wieland stated the Miami County Commissioners will certify the official election results
at their meeting on November 15th and the City Council will take formal action to accept the results
at their December 10th meeting. The installation of the new Council will take place at the December
meeting.
Agenda Item 4b - Consider the renewal of the City’s group health insurance policy with
Blue Cross Blue Shield of Kansas, Delta Dental, Metlife and Surency.
HR Director Belt presented the City’s Group Health Insurance Plans set to renew on January
1st. Blue Cross Blue Shield of Kansas has offered to renew the existing policies with an overall
premium decrease of 2.9%. The City’s Group Dental Plan with Delta Dental will decrease by
5.7% and improve plan coverage. Met Life Basic Life will increase $.03 and optional vision
coverage through Surency shows no change in premium.
HR Director Belt stated employees are taking advantage of the preventative services and they are
more active in the wellness program. Drug costs are low due to the use of generic prescriptions.
After some discussion Council Member Smail made a motion to approve the renewal of the
City’s group health insurance policy with Blue Cross Blue Shield of Kansas, Delta Dental,
Metlife and Surency as presented. The motion was seconded by Council Member Upshaw and
all voted aye. The motion was passed 4 to 0.
Agenda Item 4c - Consider a Resolution fixing the time and place for a public hearing to
consider the project plan intent for Paola Crossings.
Council Member Nickelson made a motion to approve A RESOLUTION STATING THE INTENT
OF THE CITY OF PAOLA, KANSAS TO CONSIDER ADOPTION OF A REDEVELOPMENT
PROJECT PLAN WITHIN THE PAOLA CROSSINGS REDEVELOPMENT DISTRICT CREATED
BY THE CITY AND PROVIDING FOR NOTICE OF A PUBLIC HEARING ON SUCH MATTERS.
The motion was seconded by Council Member Upshaw and all vote aye. The motion passed
4 to 0 and was given Resolution No. 2019-016.
Agenda Item 4d - Consider a Resolution to install a stop sign on Poplar Ridge at Pawnee
Drive and restrict parking on the south side of Ottawa from Silver to Pearl.
After some discussion Council Member Upshaw made a motion to approve A RESOLUTION
AMENDING THE OFFICIAL TRAFFIC CONTROL DEVICE SCHEDULES FOR THE
CITY OF PAOLA, KANSAS. The motion was seconded by Council Member House and all
voted aye. The motion passed 4 to 0 and was given Resolution No. 2019-017.

Agenda Item 4e - Consider approval of a new CMB license for Pizza Hut.
Council Member Nickelson made a motion to approve a new Cereal Malt Beverage License
for Grand Mere Restaurant Group ACQ1, LLC, doing business as Pizza Hut at 1613 E Peoria,
subject to a satisfactory fire safety inspection. The motion was seconded by Council Member
Smail and all voted aye. The motion passed 4 to 0.
Agenda Item 5 - COMMITTEE REPORTS – None.
Agenda Item 6 - STAFF REPORTS
Assistant City Manager Shannon reported the dangerous structure located at 602 W. Wea had
been demolished.
Assistant City Manager Shannon mentioned since the new housing incentive program was
passed, 4 new houses have been approved for construction.
Manager Wieland said a couple projects that have been starting to come together will possibly
be ready for discussion in December.
Manager Wieland noted Greg Vahrenberg has been reviewing the city bonds to see if there
would be any benefit to refunding with the dropping of interest rates.
Manager Wieland asked the Council to take formal action to appoint Assistant City Manager
Randi Shannon as the Interim City Manager after his retirement. Manager Wieland reminded
the Council this was discussed at the study session and just needs a motion to make it official.
Council Member Smail made a motion to appoint Randi Shannon as the Interim City Manager
until the position is filled. The motion was seconded by Council Member Nickelson and all
voted aye. The motion passed 4 to 0.
Manager Wieland presented the Council will his official retirement notice effective January
17, 2020.
Agenda Item 7 - MISCELLANEOUS MATTERS FROM THE COUNCIL
Council Member Smail thanked Manager Wieland for doing the best job of any City Manager
he has worked with.
Council Member Upshaw thanked Manager Wieland for his service and he was grateful to
have him for guidance.
Council Member Nickelson thanked Manager Wieland and said he helped to make him a better
council member.

With no additional business to come before the Council, Council Member Nickelson made a
motion to adjourn. The motion was seconded by Council Member Smail and all voted aye.
