MINUTES OF THE SPECIAL COUNCIL MEETING OF THE CITY OF PAOLA, KANSAS PAOLA JUSTICE CENTER 805 N PEARL 6:00 O’CLOCK P.M. January 20, 2022 The Governing Body of the City of Paola, Kansas, met with Mayor House presiding. Council Members present: Mayor Leigh House and Council Members Dave Smail, Trent Upshaw, Kathy Peckman, and LeAnne Shields. Council Members absent: None Also present: Acting City Manager Randi Shannon, City Clerk Stephanie Marler, Police Chief Eric Jenkins, City Attorney Lee Tetwiler and several members of the public. CALL TO ORDER: The special council meeting was called to order by Mayor House. ROLL CALL: Mayor House and Council Members Smail, Upshaw, Peckman and Shields were all present. Council Member Shields announced she believed the special council meeting was called illegally. She stated according to the Kansas Municipalities Handbook whenever there is a specially called meeting it has to be by the written request of three members of the council. She did not believe three members called the meeting and asked Mayor House what she wanted to do about it. Mayor House explained that historically an agenda is prepared at the request of the council, and by at least three council members signing the agenda before the special meeting is called, it serves as the written request and agreement to the meeting. Council Member Shields stated the agenda had not been signed by three members since herself and Council Member Peckman did not sign it, so the meeting could not proceed. Council Member Peckman signed the agenda and moved that the council sign the agenda ahead of the meeting so there is no problem being in error of the Kansas Municipalities Handbook. Council Member Shields then signed the agenda and seconded the motion and all voted aye. The motion passed 4 to 0. Special Paola City Council Minutes – January 20, 2022 Page 1 Agenda Item 1 -OLD BUSINESS Agenda Item 1a -Consider contracts for engineering services in Wallace Park. Acting Manager Shannon said an initial step for investigating exactly what Wallace Park improvements are possible is to have a survey and geotechnical analysis done. She said gathering this information will allow the City Council to consider what options for improvements are available. Acting Manager Shannon said with council direction a project scope for a proposal was developed. She said the entire project scope includes two phases. Phase 1 is the possible improvements to the amenities north of Wallace Park Dr, Phase 2 would be to the south of Wallace Park Dr. She explained the only items for consideration at this time are the fees for the survey and geotechnical analysis for the entire project (Phase 1 and 2) and the scope alignment and Phase 1 permit and construction documents. Acting Manager Shannon said the scope was sent to the following three companies for proposals: Confluence: Survey Services - $30,370.00 Geotechnical Services - $5,480.00 Phase 1 Design- $109,890.00 Total - $145,740.00 Mammoth Sports Construction: Survey Services - $12,000.00 Geotechnical Services - $8,000.00 Phase 1 Design - $54,000.00 Total - $74,000.00 Mid-America Sports Construction: Did not submit a proposal. After some discussion Council Member Smail made a motion to approve a contract with Mammoth Sports Construction in the amount of $74,000 for engineering services in Wallace Park and authorize the necessary signatures. The motion was seconded by Council Member Peckman. Council Members Smail, Upshaw and Peckman all voted aye and Council Member Shields voted nay. The motion passed 3 to 1. The motion was seconded by Council Member Smail and all voted aye.
