MINUTE RECORD PAPILLION CITY COUNCIL MINUTES TUESDAY, MAY 19, 2020 (cry_ 7: 00 P. M. The City Council of the City of Papillion met in open and public session at Papillion City Hall, and on virtual meeting via Zoom, on May 19, 2020, at 7: 00 PM. City Clerk Nicole Brown called the roll. Present were Councilmembers Steve Sunde, Tom Mumgaard, Jason Gaines, Jim Glover, Gene Jaworski, Lu Ann Kluch, Bob Stubbe, Steve Engberg, and Mayor David P. Black. ORDINANCES FIRST READING: ORD. 1875 — An ordinance to approve the issuance of Water Revenue Refunding Bonds, Series 2020 with principal not to exceed $ 8, 000, 000 — Nancy Hypse — 597- 2020 ( Staff is recommending a waiver of the second and third ordinance readings). Introduced by Councilmember Gaines. Mayor Black noted for the record that staff was recommending waiver of the second and third ordinance readings, which requires a super majority vote. Motion to waive second and third readings by Councilmember Jaworski, second by Councilmember Stubbe. Mayor Black called for proponents and opponents. None came forward. Councilmember Sunde asked what the benefit is to waiving readings in this instance. Mayor Black stated that the waiver of readings allows the City to lock in current interest rates. Councilmember Sunde noted that he doesn' t believe this is necessary, as there is no guarantee that rates will increase. Upon roll call vote, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe, and Engberg all voted yes. Voting no: Sunde. Motion passed. Mr. Jobeun thanked the Council for allowing additional time for the developer to discuss contingencies with City staff and noted that they believe resolution has been reached. He stated that Sarpy County has agreed to allow a full- movement intersection at the 1/ 8 mile because the City is willing to allow it and the intersection lies within the City' s extra- territorial jurisdiction. Mr. Jobeun added that the SID is paying 100% of the road improvements and the County has agreed to provide maintenance until the area is annexed. R20- 0083 — A resolution to approve a Memorandum of Understanding between Sarpy County Human Services, City of Papillion, and Lift Up Sarpy for a Water/ Sewer Assistance Program — Christine Myers — 827- 1111. Motion to approve RES. R20- 0083 by Councilmember Kluch, second by Councilmember Stubbe. Mayor Black called for proponents and opponents. None came forward. Councilmember Stubbe asked for an explanation of the program. Mayor Black stated that the program is similar to other utility assistance programs in the area. It will allow the City to use discretion in shutting off water connections due to legitimate hardship. When a shut- off notice is issued, information will be included for applying for assistance through Lift Up Sarpy. Councilmember Stubbe stated that he believes this will be an excellent program. R20- 0094 — A resolution to approve the acquisition, by condemnation if necessary, of easements across certain private property for the Turkey Road to Summit Ridge Water Transmission Main Project — Alex Evans — 597- 2043. Mayor Black stated for the record that the property owner in question had requested that this item be tabled to the June 2, 2020, City Council Meeting. Mayor Black noted that he and City Administration were comfortable with the request to table. Councilmember Mumgaard asked for the purpose in tabling the item. Deputy City Administrator Phil Green stated that the property owner is a farmer and was not able to participate in tonight' s meeting due to farming activities. Councilmember Mumgaard stated that he understands extending good will, but expects to see cooperation from the property owner prior to the next meeting. City Administrator Chris Myers stated that there were a few items that still needed to be worked out, including easement and acquisition price, so she saw no harm in delaying the vote. Councilmember Stubbe clarified that the purpose of the project in question is to extend water to the western growth area. He added that an OPPD easement already exists on this property and that the City' s request is to place the water line within the existing OPPD easement. Motion to table RES. ADMINISTRATIVE REPORTS: Committee Reports: Public Safety Committee: Councilmember Gaines stated that the Committee discussed the locations for placement of speed transition signs in the downtown area. He noted that the City hopes to place the signs on existing OPPD power poles to utilize electrical power. The Committee also discussed the possibility of locating downtown mobile vendors in the alley behind the businesses on the east side of Washington St and noted that staff will be providing recommended procedures in 30- 45 days. Comments from the Floor: None. Comments from Mayor and Council: Mayor Black provided an update on his events: 1) Mayor Black participated in daily briefings with City department heads and administration; ( 2) Mayor Black attended daily briefings with the Sarpy/ Cass Health Department and other City and County officials; ( 3) Mayor Black attended the White House briefing conference calls; ( 4) Mayor Black attended the Governor' s virtual press conferences. 7 May 19, 2020 ADJOURNMENT: Motion to adjourn by Councilmember Glover, second by Councilmember Gaines.
