MINUTE RECORD PAPILLION CITY COUNCIL MINUTES TUESDAY, OCTOBER 19, 2021 7: 00 P. M. The City Council of the City of Papillion met in open and public session at the Chrysalis Event Center at Papillion Landing, 1046 W Lincoln St, on October 19, 2021, at 7: 00 PM. Administrative Assistant Taylor Baratta called the roll. Present were Councilmembers Steve Sunde, Tom Mumgaard, Jim Glover, Lu Ann Kluch, Steve Engberg, and Mayor David P. Black. Councilmembers Jason Gaines, Gene Jaworski, and Bob Stubbe were absent. Also present were City Administrator Thelen, Police Amber Powers, Deputy City Administrator Phil Green, City Attorney Alan Lieutenant Ray Higgins, Parks & Facilities Director Tony Gowan, Recreation Director Tracy Stratman, Finance Director Nancy Hypse, Assistant Planning Director Travis Gibbons, Fire Chief Bill Bowes, Deputy City Engineer Alex Evans, Interim Public Works Director Jen Roesler, Assistant Library Director Lacey Partlow, Human Resources Director Carrie Svendsen, and Executive Assistant Robin Lance. Mayor Black led those present in the Pledge of Allegiance. Affidavit of Publication: Notice of the meeting was given in the Sarpy County Guide & News, the designated method of giving notice. ADMINISTRATOR' S REPORT: City Administrator Amber Powers provided an update: ( 1) A presentation was done on the levee project in downtown Papillion for Congressman E3acon' s representatives; ( 2) Deputy Police Chief interviews are being conducted; ( 3) Upcoming events: Clean- up Days October 18- 24, Papillion 150 Fall Finale October 22- 23, the Boy Scout Cabin Restoration Dedication October 25, and the Recreation Department' s Fall Festival and Halloween Safe Night October 28. No one else came forward and the public hearing was closed. ORDINANCES THIRD READING AND RESOLUTIONS: RES. R21- 0192— A resolution to approve the proposed Scope of Services and Proposal for Topographic Dreessen & Survey for N Beadle, N Osage and E 3rd St Street Extensions from Thompson, Dorner Inc. — Alex Evans — Councilmember Mumgaard, second by 597- 2043. Motion to approve RES. R21- 0192 by Councilmember Sunde. Mayor Black called for proponents and opponents. Mayor Black noted for the record that several emails were received in opposition of RES. R21- 0192. Proponents: None. Opponents: Bill Smith, 121 N Beadle St, stated that he would like more information on the traffic study for this area and that he opposes this project because he wants to maintain a quiet neighborhood. Councilmember Mumgaard stated that he would like to include the traffic flow evaluation for all the major streets in the neighborhood in the Scope of Services. Mayor Black asked what the current Scope of Services includes and how the Council could change it if necessary. Mr. Thelen briefly explained options. Councilmember Mumgaard stated that he would like to vote on the Scope of Services today and do a change order if necessary. Mayor Black explained that the change order would go before Council for approval. Mr. Evans briefly explained the traffic study that would be done. Councilmember Mumgaard explained that he would like the traffic study to show the traffic flow in and around the neighborhood. Mr. Evans stated that information would be included. Councilmember Sunde asked if the traffic study would include 6th St. Mr. Evans stated that it would. Mr. Smith briefly explained that he still wonders how many new cars would travel through the neighborhood if the street extensions were completed. Paula Adams, 121 N Beadle St, explained that she does not think these extensions should be done just because they were part of a 20- year plan. Ms. Adams stated that she would also like to keep the neighborhood quiet and peaceful. 5 October 19, 2021  Larry Cherney, 301 N Osage St, stated that he thinks extending the streets would cause a safety issue with the increased traffic. Greg Penning, 431 E 2nd St, stated that he does not agree with doing a project when the residents do not want it done. Mayor Black called for council discussion. Councilmember Engberg briefly explained that after listening to public testimony he will be voting against the Scope of Services. Councilmember Sunde disagreed and stated that he thinks the traffic study will be beneficial. Councilmember Mumgaard agreed with Councilmember Sunde. Councilmember Kluch explained that she will be supporting this to get more valuable information that could help the Council determine the right course of action. Councilmember Glover stated that he thinks the traffic study will provide important information. Mayor Black briefly explained the next steps for this project. Councilmember Kluch made a motion to table RES. R21- 0192 to the November 2, 2021, City Council Meeting, second by Councilmember Sunde. Upon roll call vote, Sunde, Mumgaard, Glover, and Kluch voted yes. Voting no: Engberg. Absent: Gaines, Jaworski, and Stubbe. Motion failed. Ms. Simmons stated that she understands it as being necessary because of the previous experiences with unprofessionalism from other shops in the past. Proponents: Bill Bima, 809 Chisholm Trl, explained the reasoning for the Public Property Lease request. Councilmember Glover asked what the amount of the lease is. Mr. Bima stated it is 286. 00 per year and renewable each year. Councilmember Mumgaard asked if the trees are on the property line and if the fence would be placed just outside the trees. Mr. Bima stated that is correct. Councilmember Mumgaard explained that he is in favor for this lease but does not agree with the fee. Mayor Black explained that Council may amend the lease, if desired. Councilmember Mumgaard made a motion to amend the lease and have the fee be $ 286. 00 the first year and then $ 0. 00 thereafter, second by Councilmember Glover. Mayor Black called for council discussion on the motion to amend. Councilmember Kluch asked what would happen if Mr. Bima decided to sell the property. Mr. Thelen explained that the way the lease is currently written the new owner would assume the lease under the same terms. Councilmember Kluch stated that she does not think the lease should just be carried over with the same terms if this property is sold. Councilmember Mumgaard modified his motion to amend to include language in the lease stating that the lease is subject to renewal upon the sale of the property. Councilmember Sunde asked if someone could explain how the$ 286. 00 amount was determined. Mayor Blackmaking suggested brieflytheexplained how the fee amount was determined.
