MINUTE RECORD PAPILLION CITY COUNCIL MINUTES TUESDAY, JULY 18, 2023 a 7: 00 P. M. The City Council of the City of Papillion met in open and public session in the City Council Chambers at Papillion City Hall, 122 E Third St, on July 18, 2023, at 7: 00 PM. City Clerk Nicole Brown called the roll. Present were Councilmembers Steve Sunde, Tom Mumgaard, Jason Gaines, Jim Glover, Dave Fanslau, Bob Stubbe, and Mayor David P. Black. Councilmembers Steve Engberg and Lu Ann Kluch were absent. Also present were City Administrator Amber Powers, Deputy City Administrator Mark Stursma, Finance Director Nancy Hypse, Recreation Director Tracy Stratman, Parks and Facilities Director Tony Gowan, Police Chief Chris Whiffed, Assistant City Attorney Carla Heathershaw Risko, Planning Director Travis Gibbons, Fire Chief Robb Gottsch, Public Works Director Michael Kleffner, Human Resources Director Carrie Svendsen, Chief Building Official Brad Sojka, Library Director Matt Kovar, and Communications Manager Trent Albers. Mayor Black led those present in the Pledge of Allegiance. Affidavit of Publication: Notice of the meeting was given in the Sarpy County Times, the designated method of giving notice. Public announcement that a current copy of the Open Meetings Act is posted in the Council Chambers. Presentations: Kiera Montiel and Jenna Woodward presented the Mayor' s Youth Leadership Council' s Quarterly Report. ADMINISTRATOR' S REPORT: City Administrator Amber Powers provided an update: ( 1) There will be a street naming ceremony at the Papillion Landing Softball Complex on July 21st; ( 2) The Northern National Softball Tournament will take place at the Papillion Landing Softball Complex July 21st— July 23rd; ( 3) The Digital Library at Papillion Landing will be moving classrooms and is being updated; ( 4) There is one month left for the Papillion Farmers Market; ( 5) There will be a Public Safety Committee Meeting on August 1st CONSENT AGENDA ITEMS: ( 1) Approval of the agenda as presented; ( 2) Approval of the minutes from the July 5, 2023, City Council Meeting; ( 3) RES. ORDINANCES FIRST READING: None. ORDINANCES SECOND READING AND PUBLIC HEARING: ORD. 2002 — An ordinance to approve a Chanqe of Zone from AG ( Agricultural) to CC Community Commercial) and R- 4/ PUD- 2 ( Multiple- Family Residential with a Specific Planned Unit Development Overlay) for the property legally described as a tract of land located in the SE 1/ 4 of the SW 1/ 4 of Section 36, T14N, R12E of the 6th P. M., Sarpy County, generally located on the NW corner of S 66th St and Schram Rd. The applicant is Spruce Capital Group, LLC. ( Tighe Farm) — Travis Gibbons — 597- 2077. Mayor Black opened the public hearing and called for proponents and opponents. Proponents: Larry Jobeun, 11440 W Center Rd, Omaha, and Kyle Haase, E& A Consulting, 10909 Mill Valley Rd Ste 100, Omaha, were present on behalf of the applicant. Mr. Jobeun briefly explained the project area and its existing conditions. Mr. Jobeun explained what housing types and amenities are proposed to be included on the property. Mr. Jobeun stated that Schram Rd and 66th St would be built out with this development and that there will be a public sanitary sewer brought down from north of HWY 370, which will serve additional properties as well. Councilmember Mumgaard expressed concern regarding the timing of 66th St construction. Mr. Jobeun explained the triggering events that would be included in the Subdivision Agreement. Councilmember Mumgaard stated that he would like to see an agreement put in place stating how far the development can be built without extending 66th St from HWY 370 to at least Towne Center Pkwy. He would like to avoid people from having to go back to S 72nd St to access HWY 370. Councilmember Sunde asked if the HWY 370 and 66th St intersection had already been approved by NDOT. Mr. Jobeun stated that it is an approved intersection. Councilmember Sunde asked for more information regarding the sanitary sewer system being brought down from the north side of HWY 370. Mr. Jobeun explained what would be done to connect the sanitary sewer system. Councilmember Sunde asked if that would involve taking any property to the north. Mr. Jobeun stated that they would work with that development. Councilmember Mumgaard asked why there are 28 conditions listed in the staff report for the Change of Zone for this development. Mr. Gibbons explained that these conditions are considered standard boilerplate language and that many are checklist items that would need to be completed before final approval. Councilmember Mumgaard stated that he sees there is an obligation to enter into a Subdivision Agreement that addresses the improvements of Schram Rd but not one for 66th St. Mr. Gibbons stated that language can be added into the Subdivision Agreement. Opponents: Jim Hrabik, 7020 Beth Ave, expressed the same concern as Councilmember Mumgaard regarding 66th St, as well as concerns with the commercial areas proposed for the northeast corner of the development area. Terry Tighe, 14102 S 108th St, Springfield, stated that he owns property east of this development where 66th St is proposed to be built, and stated that he has no interest in contributing any money or real estate towards the development. Mr. Tighe stated that he also believes the HWY 370 4 July 18, 2023 corridor should be used for business and commerce, not more rental units. Mr. Tighe then expressed concern with the request to reduce setbacks and building height. Joann and Eric Parks, 11515 S 72nd St, stated that their concern is with the high density being built adjacent to their property and that she believes that there should be a landscape buffer between this development and their property. Ms. Parks explained that they have two buildings on their property, with one being approximately 100' from the property line. Ms. Parks did not agree with the proposed setback distances. Mr. Parks stated that he believes if he were to develop his property that he should also be allowed to amend the setback distances if it is going to be allowed in this development. Ms. Parks added that they have no intent to sell their property or to allow Towne Center Pkwy to go through their property. No one else came forward and the public hearing was closed. ORDINANCES THIRD READING AND RESOLUTIONS: RES. R23- 0112— PUBLIC HEARING AND VOTE— A resolution to approve a Preliminary Plat for the property legally described as a tract of land located in the SE 1/ 4 of the SW 1/ 4 of Section 36, T14N, R12E of the 6th P. M., Sarpy County, generally located on the NW corner of S 66th St and Schram Rd. The applicant is Spruce Capital Group, LLC. ( Tighe Farm) — Travis Gibbons — 597- 2077. Mayor Black opened the public hearing and called for proponents and opponents. Mayor Black stated for the record that all discussion from the public hearing from El. ORD. 2002 will be carried over. Proponents: Larry Jobeun, 11440 W Center Rd, Omaha, and Kyle Haase, E& A Consulting, 10909 Mill Valley Rd Ste 100, Omaha, were present and explained how Towne Center Pkwy would be built within the project area. Mr. Jobeun explained the request for the reduced setbacks and landscape buffers, as well as specific triggering events that can be included in the Subdivision Agreement for the installation of 66th St. Councilmember Sunde noted that Mr. Jobeun mentioned that 66th St could not be built without another development sharing the costs, but that the portion of 66th St north of HWY 370 was built for the Titan Springs neighborhood without outside help. Opponents: Eric Parks, 11515 S 72nd St, stated that he disagrees with the setbacks being proposed. Carla Tighe, 14102 S 108th St, Springfield, stated that 66th St is proposed to be built on their land and that when it comes time to develop that portion of their property, they will be in opposition to it then as well. No one else came forward and the public hearing was closed. Motion to approve RES. R23- 0112 by Councilmember Stubbe, second by Councilmember Glover. Councilmember Stubbe stated that he plans to support this Preliminary Plat because staff and the developer will work through concerns and questions prior to the Final Plat and Subdivision Agreement being presented to the Council. Councilmember Sunde stated that he would like to disclose that he has a partial ownership interest in the undeveloped property on the north side of HWY 370 and through tonight' s discussion learned that there could be a direct impact on that property so he would like to recuse himself from voting. 5 July 18, 2023 Councilmember Fanslau explained that he shares Councilmember Mumgaard' s concerns regarding 66th St but agrees with Councilmember Stubbe that the Preliminary Plat should move forward. Councilmember Gaines asked what effect a motion to table would have on the developer. Mr. Jobeun explained that quite a bit of time goes by between a Preliminary Plat and a Final Plat and that if the Preliminary Plat is delayed, it would further delay the project. Councilmember Gaines stated that he agrees with Councilmembers Stubbe and Fanslau and that he is in favor of moving the Preliminary Plat forward and taking the time to work out the issues before the Final Plat and Subdivision Agreement come before Council. Councilmember Mumgaard stated that he likes the plan and what is being proposed but would like to table the vote at this time. Councilmember Stubbe explained that he would oppose any sort of layover because the developer has time between approval of the Preliminary Plat and approval of the Final Plat and Subdivision Agreement to address the Council' s concerns. Councilmember Sunde noted that the vote tonight would have to be unanimous to pass because he was abstaining and there were two Councilmembers absent. Mayor Black confirmed. Councilmember Mumgaard made a motion to table RES. R23- 0112 to the August 15th City Council Meeting and to require a written agreement regarding the developer' s obligation to construct 66th St with triggering events outlined, second by Councilmember Gaines. Councilmember Mumgaard asked if the motion to approve the Preliminary Plat is subject to the contingencies that are outlined by staff. Mayor Black stated that it is. Councilmember Mumgaard withdrew the motion to table and made a motion to amend the contingencies to include a requirement that the developer agrees to enter into a Subdivision Agreement to address construction of 66th St from HWY 370 to at least Towne Center Pkwy, second by Councilmember Glover. Upon roll call vote, Mumgaard, Glover, Fanslau, and Stubbe voted yes. Voting no: Gaines. Abstained: Sunde. Absent: Kluch and Engberg. Motion failed. Mayor Black noted for the record that it if a Preliminary Plat is denied, it cannot come back for consideration for a year. Mr. Jobeun stated that a delay of that length would kill the project. Councilmember Gaines stated that he was concerned there would not be enough votes to approve the Preliminary Plat at tonight' s meeting and would like to make a motion to table this until the August 15th City Council Meeting to make sure the full Council is present, second by Councilmember Sunde. Councilmember Mumgaard stated that he would like to approve the Preliminary Plat and asked for confirmation that an agreement will be worked on prior to the Final Plat being approved. Mr. Jobeun agreed. Councilmember Mumgaard stated that he would then vote against the motion to table. Councilmember Gaines withdrew the motion to table. Upon roll call vote on the motion to approve, Mumgaard, Gaines, Glover, Fanslau, and Stubbe all voted yes. Voting no: none. Abstained: Sunde. Absent: Kluch and Engberg. Motion passed. 6 July 18, 2023 RES. R23- 0119 — A resolution to approve an extension of the West Papillion Catholic Community Preliminary Plat— Travis Gibbons— 597- 2077. Motion to approve RES. Ray Higgins; ( 2) Mayor Black and staff attended a Mutual Finance Organization ( MFO) Meeting; (3) Mayor Black attended budget meetings with staff and council members; ( 4) Mayor Black and staff attended the ribbon cutting for On The Border Mexican Grill & Cantina.
