MINUTE RECORD PAPILLION CITY COUNCIL MINUTES TUESDAY, JANUARY 21, 2025 7: 00 P. M. The City Council of the City of Papillion met in open and public session in the City Council Chambers at Papillion City Hall, 122 E Third St, on January 21, 2025, at 7: 00 PM. City Clerk Nicole Brown called the roll. Present were Councilmembers Steve Sunde, Tom Mumgaard, Jason Gaines, Jim Glover, Dave Fanslau, Lu Ann Kluch, Bob Stubbe, and Mayor David P. Black. Councilmember Steve Engberg was absent. Also present were City Administrator Amber Powers, Deputy City Administrator Mark Stursma, Finance Director Nancy Hypse, Recreation Director Tracy Stratman, Parks and Facilities Director Tony Gowan, Police Chief Chris Whitted, Assistant City Attorney Carla Heathershaw Risko, Planning Director Travis Gibbons, Fire Chief Robb Gottsch, Public Works Director Michael Kleffner, Human Resources Director Carrie Svendsen, Director of Building and Fire Safety Brad Sojka, Library Director Matt Kovar, and Communications Manager Trent Albers. Mayor Black led those present in the Pledge of Allegiance. ADMINISTRATOR' S REPORT: City Administrator Amber Powers provided an update: ( 1) Papillion Landing will be hosting a Health and Wellness Fair on January 24; ( 2) The first Coffee with a Cop for 2025 will be at Papillion Landing on January 28; ( 3) The 55+ Club will be hosting a Valentine' s Day Party at Papillion Landing on February 14; ( 4) The League of Nebraska Municipalities Midwinter Conference is February 24- 25. ORDINANCES FIRST READING: ORD. 2046 — An ordinance to amend § 190- 5 of the Papillion Municipal Code to allow for vehicle enforcement in parks and trails — Tony Gowan — 597- 2049. Introduced by Councilmember Kluch. ORDINANCES SECOND READING AND PUBLIC HEARING: ORD. 2043 — An ordinance to approve a Change of Zone from LC ( Limited Commercial) to CC ( Community Commercial) for the property legally described as Lot 190, Granite Creek East and Lot 1, Granite Creek East Replat 1, generally located on the NE corner of S 102nd St and HWY 370. The applicant is Gerald Torczon. ( Granite Creek East)— Travis Gibbons— 597- 2077. Mayor Black opened the public hearing and called for proponents and opponents. Proponent: Randy Kuszak, Lamp Rynearson, 14710 W Dodge Rd, Omaha, came forward on behalf of the applicant and briefly explained the project. Opponents: None. No one else came forward and the public hearing was closed. ORD. 2045 — An ordinance to approve a Change of Zone from R- 4 ( Multiple- Family Residential) to Multiple- Family Residential with a Specific Planned Unit R- 4/ PUD- 2 ( Development Overlay) for the property legally described as a replatting of Lot 1, Trinity Addition, Outlot A, Papillion Landing, and Tax Lot 12B, Section 27 T4N, R12E of the 6th P. M., Sarpy County, generally located at 520 W Lincoln St. The applicant is Immanuel Retirement Communities. ( Trinity Addition Replat 1) — Travis Gibbons — 597- 2077. Mayor Black opened the public hearing and called for proponents and opponents. Proponents: Caleb Van Weelden, Lamp Rynearson, 14710 W Dodge Rd, Omaha, briefly explained the project. David Warner, Holland Basham Architects, 119 S 49th Ave, Omaha, came forward as the architect for the project. Rhonda Distefano, Immanuel Retirement Communities, 8402 Molokai Dr, explained Immanuel' s goals for assisted living facilities. Councilmember Kluch asked how many villas are proposed to be built. Ms. Distefano stated there would be 31 villas. Councilmember Kluch asked if the villas would be for single or double occupancy. Ms. Distefano stated that both will be available and explained the phasing of the project. Councilmember Fanslau asked for more information on the buildings on the western side of the property. Ms. Distefano stated that there will be no construction happening to the buildings on the western side of the property, which were funded by the HUD 201 Program. Opponents: None. No one else came forward and the public hearing was closed. 4 January 21, 2025 ORDINANCES THIRD READING AND RESOLUTIONS: ORD. 2036 — An ordinance to amend § 205- 20( 0) ( Funeral Services) of Article III ( Use Types), Table 205- 38 ( Permitted Uses by Zoning District) of Article IV ( Zoning District Regulations), and § 205- 202 ( Commercial Uses) of Article XXXIII ( Supplemental Use Regulations) of Chapter 205 ( Zoning) having to do with regulations for funeral services. Funeral Services Update)— Travis Gibbons— 597- 2077 ( Postponed from the December 17, 2024, City Council Meeting). Motion to approve ORD. 2036 by Councilmember Gaines, second by Councilmember Glover. Councilmember Mumgaard made a motion to amend ORD. 2036 as follows: ( 1) Change the name of the Funeral homes use type to be Funeral homes ( no crematorium); ( 2) Change the name of Mortuaries use type to be Funeral homes ( with crematorium); ( 3) Clarify that a Crematorium is an establishment that is not utilized as a Funeral homes use; ( 4) Update Table 205- 38 to allow Funeral homes ( with crematorium) by special use permit in the LC Limited Commercial and CC Community Commercial District and by right in the GC General Community District, in addition to allowing such use by right in the LI Limited Industrial District and GI General Industrial District; (5) Eliminate the required buffer for the previously defined Mortuaries use; ( 6) Amend Section J to read as follows: Funeral Services — Crematoriums. Any Crematorium use shall require a special use permit when any outer wall adjacent to any crematorium equipment for the proposed Crematoriums use is within 1, 000 feet, as measured from the building line to the lot line, of ( 1) any lot that is zoned RE Rural Residential Estates, R- 1 Single- Family Residential ( Low Density), R- 2 Single- Family Residential ( Medium Density), R- 3 Urban Family Residential, R- 4 Multiple- Family Residential or MU Mixed Use Group or ( 2) any use classified as Assisted Living, Group care facility, Group home, Intermediate care facility, Skilled nursing services, and Nursing facility. Any Crematoriums use shall require a special use permit when the lot is within 500 feet, as measured from lot line to lot line, of any use classified as College or university facilities, Daycare Services, Hospital, Primary educational facilities, Secondary educational facilities, Medical offices, Restaurants, or Retail services. Motion to amend ORD. 2036 was seconded by Councilmember Stubbe. Mayor Black called for any proponents and opponents on the motion to amend. None came forward. Councilmember Mumgaard briefly explained his reasoning for the motion. Councilmember Fanslau suggested that Mobile Homes should be listed as a residential type in Section J and asked why crematoriums require a buffer and special use permit but a funeral home with a crematorium does not. Councilmember Gaines disagreed with the motion to amend and stated that ORD. 2036 as written should be approved. Councilmember Sunde stated that he is not opposed to crematoriums but does not think they belong in residential areas. Councilmember Mumgaard explained that Section J remained mainly unchanged from the original proposed ordinance and that all he was trying to amend was the buffer zone. Councilmember Mumgaard briefly explained the difference between crematoriums and funeral homes with crematoriums. Councilmember Kluch stated that she is pro- business and thinks that Papillion needs to keep its doors open for businesses to build here. 5 January 21, 2025 Mayor Black called for further discussion. R25- 0011 — A resolution to accept Dedications of Street Right- of-Way for two tracts at the intersection of S 90th St and Devon Dr— Travis Gibbons— 597- 2077. Motion to approve RES. R25- 0011 by Councilmember Fanslau, second by Councilmember Stubbe. Mayor Black called for proponents and opponents. None came forward. Councilmember Kluch stated that she is concerned that the streetlights have gone out along S 90th Street, making it more difficult for drivers to see at night. R25- 0012— PUBLIC HEARING AND VOTE— A resolution to approve a Comprehensive Plan Amendment to update the Master Plan as adopted and approved by the Sarpy County and Cities Wastewater Agency — Travis Gibbons — 597- 2077. Councilmember Kluch stated that she was in favor of this project. Councilmember Mumgaard stated that he believes this project is a step in the right direction. Councilmember Kluch asked if traffic impacts on W Lincoln St had been considered. Mr. Gibbons stated that there was extensive discussion about traffic at the Planning Commission Meeting and that the use does not warrant a traffic study at this time based on the number of units that are proposed to be built, but that is something the City will continue to monitor. Mr. Shields stated that access would not be from HWY 370. Douglas Graham, U- Haul, 721 32nd Ave, Council Bluffs, IA, briefly explained the proposed facility. Councilmember Fanslau asked if there would be any outdoor storage. Mr. Graham stated there would only be indoor storage. Opponents: None. No one else came forward and the public hearing was closed. ADMINISTRATIVE REPORTS: Committee Reports: Affordable Housing Plan Ad Hoc Committee: Councilmember Stubbe briefly explained the project discussed and stated that the Committee voted 2- 2 regarding moving it forward to Council. Councilmember Mumgaard asked if there was any further discussion of this project moving to the Sarpy County Housing Agency, rather than the Omaha Housing Authority. Councilmember Stubbe stated that the vouchers are only available through the Omaha Housing Authority at this time and explained how the vouchers are allocated. Councilmember Sunde explained that the vouchers being discussed are project- based vouchers that go with the unit rather than the person, which means the entire project would be Section 8 Government Assisted Housing, versus a traditional tenant- based voucher. He added that the Sarpy County Housing Authority had already used their allotted vouchers so the only way for vouchers to be used for this project is through the Omaha Housing Authority. Comments from the Floor: Christine Holder stated that she is concerned about the lack of handicap accessible parking available within Shadow Lake Towne Center. Mayor Black stated that staff will review to see if the City can assist. Comments from Mayor and Council: Mayor Black provided an update on his events: ( 1) Mayor Black and staff attended the ribbon cutting for The Back Nine Golf; ( 2) Mayor Black attended a Governor/ LONM Executive Board Meeting; ( 3) Mayor Black and staff attended the 2025 Midlands Community Foundation Gala.
