PAPI LION PLANNING COMMISSION MEETING MARCH 29, 2017 The Papillion Planning Commission met in open session at the Papillion City Hall Council Chambers on Wednesday, March 29, 2017 at 7: 00 PM. Chairman Michael Mallory called the meeting to order. Planning Assistant Andrea Blevins called the roll. Planning Commission members present were David Barker, Howard Carson, Raymond Keller Jr., Jim Masters, John E. Robinson III, and Judy Sunde. Rebecca Hoch and Herb Thompson joined the Commission at 7: 02 P. M. With a full commission present, alternate Commission member Leanne Sotak was not required to attend. Assistant City Attorney Amber Rupiper, Assistant Planning Director Travis Gibbons, City Planner Michelle Romeo, and Staff Engineer Derek Goff were also present. Notice of the meeting was given in advance by publication in the Papillion Times on March 15, 2017. A copy of proof of publicatior is on file at the office of the City Clerk. Chairman Mallory led those present in the Pledge of Allegiance. Chairman Mallory announced that a copy of the Open Meetings Act is posted in the City Council Chambers. Approval of Aqenda Motion was made by Mr. Robinson III, seconded by Mr. Barker, to approve the agenda as presented. Roll call: Eight yeas, no nays. Motion carried. Approval of the Planninq Commission Minutes Motion was made by Mr. Robinson III, seconded by Mr. Barker, to approve the 02/22/ 17 minutes. Roll Call: Eight yeas, no nays, one abstention from Ms. Sunde. Motion carried. FINAL PLATS Final Plat— A Final Plat for the property legally described as a tract of land located in part of the SE1/ 4 of the NE1/ 4 and the SW1/ 4 of the NE1/ 4 of Section 29, T14N, R12E of the 6th P. M., Sarpy County, NE, generally located on the NE corner of 114th St and Lincoln Road. The applicant is Stone Creek Plaza, LLC. ( Granite Falls North Phase 2) FP- 17- 0002 Chairman Mallory called for discussion amongst the Commission. With no further discussion, Motion was made by Ms. Hoch, seconded by Ms. Sunde, to recommend approval of the Granite Falls North Phase 2 Final Plat ( FP- 17- 0002) because it is genera!! y consistent with the Comprehensive Plan, compatible with adjacent uses, and compliant with the Subdivision Regulations and Zoning Regulations, contingent upon the resolution of staff comments. Roll Call: Nine yeas, no nays. Motion carried. Final Plat — A Final Plat for the property legally described as Lots 86-236, inclusive, being a I replatting of Lot 86, Outlots D, F, H, I, and G, Ashbury Creek, a subdivision, as surveyed, 1 Planning Commission March 29, 2017 platted and recorded in Sarpy County, NE, together with the N1/ 2 of the SW1/ 4 of Section 32, T14N, R12E of the 6th P. M., Sarpy County, NE, generally located SW of 114th Street and HWY 370. The applicant is Ashbury Creek, LLC c/ o John Allen. ( Ashbury Creek Phase 2). FP- 17- 0003 Pat Hillyer, 14710 W. Dodge Rd ( Omaha), stepped forward to represent the applicant. He explained that this second phase of the Ashbury Creek development will add 149 lots to the 86 lots platted as Phase 1. He added that the replat of Lot 86 includes the property owned by Robert and Elaine Moore, and will add ten feet to the southern portion of their property. Mr. Hillyer confirmed that the zoning will be R- 4 which is consistent with Ashbury Creek Phase 1, and that Phase 2 is generally consistent with the original plat. Chairman Mallory called for discussion amongst the Commission. Mr. Carson asked whether the existing farmhouse located in Lot 86 would remain with the development. Mr. Hillyer confirmed that it would remain, and that the Moore' s property would not be a part of the Sanitary Improvement District ( SID). Mr. Carson asked whether 114tn Avenue would then be routed around the property. Mr. Hillyer answered in the affirmative. With no further discussion, Motion was made by Mr. Carson, seconded by Mr. Keller, to recommend approval of the Ashbury Creek Phase 2 Final Plat ( FP- 17- 0003) contingent upon the resolution of staff comments because the application is generally consistent with the Comprehensive Plan as amended by CPA- 13- 0001, compatible with adjacent uses, and compliant with the Subdivision Regulations. Roll Call: Nine yeas, no nays. Motion carried. PUBLIC HEARINGS Chanpe of Zone— A Change of Zone from Agricultural ( AG) to Multiple-family Residential ( R-4) for the property legally described as Lots 86- 236, inclusive, being a replatting of Lot 86, Outlots D, F, H, I, and G, Ashbury Creek, a subdivision, as surveyed, platted and recorded in Sarpy County, NE, together with the N1/ 2 of the SW1/ 4 of Section 32, T14N, R12E of the 6th P. M., Sarpy County, NE, generally located SW of 114th Street and HWY 370. The applicant is Ashbury Creek, LLC c/o John Allen. ( Ashbury Creek Phase 2). CZ- 17- 0003 Chairman Mallory opened the public hearing. Pat Hillyer, 14710 W Dodge Road ( Omaha), stepped forward to represent the applicant. Mr. Hillyer expressed that he was happy to address any questions or concerns. Chairman Mallory called for proponents and opponents. Robert Moore, 11422 S 114' Street, stepped forward as the owner of Lot 86 to ask for clarification about the zoning. Mr. Moore expressed that Lot 86 is used as a farmstead with farm equipment and implements onsite. He asked how the change of zone will affect his property. City Planner Michelle Romeo explained that when Ashbury Creek was originally platted Mr. and Mrs. Moore' s property was included in the Change of Zone from Agricultural ( AG) to Multiple- family Residential ( R-4), therefore, the property in question is currently zoned R- 4. She expressed that the property is being replatted, and that it is her understanding that Mr. and Mrs. 2 Planning Commission March 29, 2017 Moore will be receiving additional property that would also be given the R-4 zoning designation to be consistent with the remainder of his property. She further indicated that the zoning does not affect Mr. Moore' s ability to farm the property or move machinery. She confirmed that the change of zone for the Moore' s property happened in 2015 with the original platting and zoning of Ashbury Creek. She also affirmed that the Moore' s property is not part of the Ashbury Creek SID. Seeing no further public input, Chairman Mallory closed the public hearing and called for Commission Discussion. Mr. Carson asked what will happen to 114' Avenue and the Moore's farmstead further into the future. Mr. Hillyer answered that the developer worked with staff on this question during Phase 1 of this project where they were required to show a future layout for developing that lot. He added that this plan contemplated that 114th Avenue would continue through Lot 86 and Lot 86 would be subdivided into six lots. Mr. Carson asked whether there was any type of agreement with the Moore family about how this would happen in the future. Ms. Romeo added that the Ashbury Creek Subdivision Agreement, which was signed by Robert and Elaine Moore, included provision related to the potential future redevelopment of Lot 86. Mr. Carson asked whether the property could remain a farmstead if a future buyer wanted to keep it that way. Ms. Romeo said that the Subdivision Agreement addresses the terms of when and how redevelopment of Lot 86 would happen. Mr. Masters asked whether there would be any changes in access to Lot 86 or the farmland across the street. Mr. Hillyer stated that the Subdivision Agreement contemplates that Lot 86 will 114th still have access to Street. He added that the Moore' s will be connected to public sewer through this project. With no further discussion, Motion was made by Mr. Keller, seconded by Ms. Sunde, to recommend approval of the Ashbury Creek Phase 2 Change of Zone ( CZ- 17- 0003) from Agricultural ( AG) to Multiple- Family Residential ( R- 4) contingent upon the resolution of staff comments because the application is generally consistent with the Comprehensive Plan as amended by CPA- 13- 0001, compatible with adjacent uses, and compliant with the Subdivision Regulations. Roll Call: Nine yeas, no nays. Motion carried. Chairman Mallory and Mr. Keller acknowledged the students present. Each student introduced herself. Special Use Permit — A Special Use Permit to allow Automotive Rental and Sales as a permitted use on the property legally described as Lot 2 Hamor Addition & Lot 9B, Papillion 6th Industrial Park, generally located at 499 W. Street. The applicant is Joey Brezina. ( Brezina AutoCare) SUP- 17- 0001 Chairman Mallory opened the public hearing. Roll Call: Nine yeas, no nays. Motion carried. Preliminarv Plat — A Preliminary Plat for the property legally described as a tract of land 6th located in the W1/ 2 of the NW1/ 4 of Section 30, T14N, R12E of the P. M., Sarpy County, NE, generally located near the intersection of S 132" d St and Lincoln Rd. The applicant is Jerry Reimer— Prairie Queen, LLC. ( Prairie Queen) PP- 16-0006 Chairman Mallory opened the public hearing. Chairman Mallory recognized that the applicant and staff have requested that this agenda item be continued to a later date when the applicant and staff are ready to present it. With no further discussion, Motion was made by Mr. Barker, seconded by Mr. Keller, to continue the public hearing of the Prairie Queen Preliminary Plat ( PP- 16- 0006) to a later date when the applicant and staff are ready to present it.
