WHEREAS, the Administration is recommending that Section 351.13 of the Parma Heights Codified Ordinances be amended, in part, to prohibit the parking of certain commercial vehicles; and WHEREAS, this update to the Parma Heights Codified Ordinances regarding the parking of commercial vehicles would allow for more efficient regulation of commercial vehicle storage; and WHEREAS, this Council desires to adopt the recommendation of the Administration. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Parma Heights, County of Cuyahoga, and State of Ohio: Section 1: That Section 351.13 of the Codified Ordinances shall be amended, and as amended, shall henceforth read as shown by edits set forth in Exhibit “A”, which is attached hereto and incorporated by reference. Section 2: This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this Ordinance were taken in an open meeting of this Council and that all deliberations of the Council and of any of its Committees comprised of a majority of the members of the Council that resulted in those formal actions were in meetings open to the public, in compliance with the law. Section 3: That this Ordinance shall take effect and be in force from and after the earliest date provided for by law. (a) No person, operator or owner of a school bus, commercial tractor, agricultural tractor, truck of more than one-half ton capacity, bus, trailer, semitrailer, pole trailer or moving van shall park or permit such vehicle to remain on any street during the period from 60 minutes after sunset until 60 minutes before sunrise or at any other time when there is not sufficient natural light to render discernible persons, vehicles and substantial objects in the street at a distance of 500 feet ahead.; unless there has been placed in the street at a point which is approximately the center of the width of such vehicle, at a distance of ten feet in advance of such vehicle and ten feet to the rear of the vehicle, two flares or red electric lanterns, one front and one rear, which may be seen and distinguishable at a distance of 500 feet under normal atmospheric conditions at nighttime. (b) No person shall stand or park a commercial trailer, which is detached from the tractor or other means of locomotion, upon a street, except for the minimum period required in the usual course of business for making a delivery of merchandise or for loading merchandise for delivery. (c) No person, business, or corporation shall park or leave standing any commercially-plated vehicle that exceeds twenty feet in length, or eight feet in width, or nine feet in height on any residential property within the City for any purpose or length of time other than for the expeditious unloading and delivery; pickup; and/or loading of materials. In addition to the above restrictions, no person, business, or corporation shall park or leave standing any of the following vehicle types on any residential property within the City for any purpose or length of time other than for the expeditious unloading and delivery; pickup; and/or loading of materials: 1) tow trucks; 2) flat-bed trucks; 3) tractor or semi-tractor trailer trucks; 4) stake bed trucks; 5) school buses or buses; 6) dump trucks exceeding one (1) ton; or 7) any vehicle transporting hazardous or flammable materials beyond what would be normally required to propel that type of vehicle. (c) No person shall stand or park a truck with a net weight of over 4,000 pounds, or a commercial tractor, trailer or semitrailer, in a roadway at any time, except for the minimum period required in the usual course of business for making a delivery of merchandise or for unloading merchandise for delivery, in case of emergency or to perform work or maintenance on residential property. (d) No person shall stand or park a commercial tractor or commercial trailer on any private property that has been zoned for residential use, except for the minimum time period that may be required in the usual course of business for making a delivery of merchandise or for unloading merchandise for delivery. (e) No person shall park a commercial tractor-trailer or semitrailer on any private property that has been zoned for commercial/office district during the period of 60 minutes after sunset and 60 minutes before sunrise, except for the minimum time period that may be required in the usual course of business for making a delivery of merchandise, or unloading merchandise for delivery, or otherwise conducting the business of the commercial/office located on the premises. Passed 2-22-21.)  RESOLUTION 2023 - 52 A RESOLUTION AUTHORIZING THE ADMINISTRATION TO DISPOSE OF OBSOLETE CITY VEHICLES AND EQUIPMENT AT A PUBLIC SALE THROUGH GOVPLANET/IRONPLANET, AND DECLARING AN EMERGENCY, AS AMENDED WHEREAS, the Council authorized membership in the National Joint Power Alliance [now known as Sourcewell], a purchasing cooperative in Ordinance No. 2017-3; and WHEREAS, GovPlanet/IronPlanet is a vendor of the National Joint Power Alliance [now known as Sourcewell]; and WHEREAS, GovPlanet/IronPlanet will provide the City of Parma Heights with auction services for the disposal of obsolete city vehicles and equipment; and WHEREAS, the Administration recommends that the vehicles and equipment listed on Exhibit “A” be removed from service as a result of their age and mechanical condition. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Parma Heights, County of Cuyahoga, and State of Ohio: Section 1: The Administration is authorized and directed to dispose of obsolete city vehicles at a public sale through GovPlanet/IronPlanet, a list of which is described in Exhibit “A”, as amended, attached hereto and incorporated by reference. Section 2: This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this Resolution were taken in an open meeting of this Council and that all deliberations of the Council and of any of its Committees comprised of a majority of the members of the Council that resulted in those formal actions were in meeting open to the public, in compliance with the law. Section 3: That this Resolution shall take effect and be in force from and after the earliest date provided for by law. This Resolution is declared to be an emergency measure necessary for the public peace, health, and safety of the Municipality, and for the further reason it is necessary to place these vehicles up for auction immediately due to storage constraints; wherefore, this Resolution shall be in full force and effect immediately upon its passage by Council and approval by the Mayor. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Parma Heights, Cuyahoga County, State of Ohio: Section 1: That this Council does hereby establish and enact Section 105.08, entitled, “Bid Evaluation Factors” of the Administrative Code, which reads in its entirety as set forth in Exhibit “A” and which is attached to this Ordinance and incorporated by reference as if fully rewritten herein. Section 2: All Ordinances and Resolutions or parts thereof which are in conflict or inconsistent with any provision of the new Section adopted in Section 1 of this Ordinance are hereby repealed as of the effective date of this Ordinance. (1) The bidder's familiarity with the project. (2) Adequacy of the equipment for the project. (3) The bidder's record on similar projects. (4) The bidder's experience in the relevant field in the preceding twelve months, including the original contract price for each job undertaken and the cost of any change order and overruns. (5) The bidder's compliance with deadlines. (6) The bidder's prior performance on any project taken for the City of Parma Heights. (7) The bidder's financial solvency. (8) Whether the bidder has ever sued or been sued by a public entity over a public project. (9) The bidder’s bonding record. (10) The bidder's compliance record with, and maintenance of, unemployment and workers' compensation laws for all employees. (11) The bidder's compliance record with, and maintenance of, federal and state wage laws for all employees. (12) The bidder's compliance record with, and maintenance of, the Fair Labor Standards Act for all employees. (13) The bidder's compliance record with, and maintenance of, Occupational Safety and Health Administration regulations for all employees. (14) The experience, training, and skill of the bidder's workforce in writing. (15) The number of years the bidder has been in the relevant businesses. (16) The continuity of the bidder's workforce. (17) The bidder's past compliance with employee drug testing. (18) Past compliance with local and state income tax laws. (19) The bidder's participation in a state accredited apprenticeship program when it is required by Ohio prevailing wage law. (20) Any other factor determined to be relevant. (b) Bid specifications may contain provisions conforming to subsection (a) of this section. Evidence of the factors a bidder wishes to be considered is the responsibility of the bidder. (c) City Officials may reject any or all bids, or parts of bids, for any reason if acceptance is not in the best interest of the City.  RESOLUTION NO. 2023 – 54 A RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY FISCAL OFFICER, AND DECLARING AN EMERGENCY WHEREAS, the Council of the City of Parma Heights, Cuyahoga County, Ohio, met in regular session on the 11th day of September, 2023, at the office of City Council with the following members present: ___________________, _____________________, _____________________, ________________________, ______________________, ______________________, and _______________________; and WHEREAS, ______________________ moved the adoption of this Resolution; and WHEREAS, this Council in accordance with the provisions of law has previously adopted a Tax Budget for the next succeeding fiscal year commencing January 1, 2024; and WHEREAS, the Budget Commission of Cuyahoga County, Ohio, has certified its action thereon to this Council together with an estimate by the County Fiscal Officer of the rate of each tax necessary to be levied by this Council, and what part thereof is without, and what part within the ten mill tax limitation. This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of the Ordinance were taken in an open meeting of this Council and that all deliberations of the Council and of any of its Committees comprised of a majority of the members of the Council that resulted in those formal actions were in meetings open to the public, in compliance with the law. Section 4. The Director of Finance is authorized to draw warrants from any of the foregoing appropriations upon receiving the proper requisition, certificate, and voucher therefore; approved by the officers authorized by law to approve same, or an Ordinance or Resolution to make the expenditure, provided that no warrants shall be drawn or paid for salaries or wages except to persons employed by authority of and in accordance with law and Ordinance. 56 A RESOLUTION AUTHORIZING AND DIRECTING THE ADMINISTRATION TO EXECUTE A PURCHASE ORDER WITH ROSENBAUER MINNESOTA, LLC THROUGH SOURCEWELL FOR THE PURCHASE OF ONE (1) ROSENBAUER AERIAL LADDER TRUCK AT THE PURCHASE PRICE OF ONE MILLION, EIGHT HUNDRED THOUSAND DOLLARS ($1,800,000.00), AND DECLARING AN EMERGENCY WHEREAS, the Council authorized membership in the National Joint Power Alliance [now known as Sourcewell], a purchasing cooperative in Ordinance No. 2017-3; and WHEREAS, the purchase order with Rosenbauer Minnesota, LLC for the procurement of one (1) Rosenbauer Aerial ladder truck in the amount of one million, eight hundred thousand dollars ($1,800,000.00) as identified in Exhibit “A”, attached hereto, and made a part hereof as though fully rewritten, was obtained through the National Joint Power Alliance [now known as Sourcewell]; and WHEREAS, Council may authorize the purchase order through the City’s membership in the National Joint Power Alliance [now known as Sourcewell], a purchasing cooperative, pursuant to Article V Sections 1 and 6 of the Charter, and Ohio Revised Code Section 9.48 without a competitive bidding process; and WHEREAS, the City of Parma Heights was recently notified of an award from the Federal Emergency Management Agency (FEMA) for the FY 2022 Assistance to Firefighters Grant in the amount of one million dollars ($1,000,000.00), which requires a ten percent (10%) match by the City, to assist with the cost of a new ladder truck for the fire department. With your cooperation, changes can be kept to a minimum which means we will be able to reduce lead times, increase production and maintain costs which will benefit all of us.
