After discussion Michelle Green recommends to Council to GRANT to Carl Moskaly for 7679 Millerwood Ln. Parma, Ohio 44130, an area variance, to City of Parma Codified Ordinance SECTION 1153.03(A) – SINGLE FAMILY HOUSE DISTRICTS- ACCESSORY USES AND BUILDINGS. A private garage with a maximum floor area of not more than 800 square feet may be erected in, or on the same lot with, the main building on a parcel with an area of 24,437 square feet. Not more than one garage, whether attached or detached, shall be permitted on any one lot. The proposal is to construct a 960 SF detached second garage. With the existing garage being 400 SF in area, the square footage of the two garages total 1340 SF. A variance would result in allowing a second garage on one lot and 540 more square feet of garage area than code allows. Michelle Green stated, “I’d like to make a motion to approve the variance as requested for the additional garage with the stipulations it will not be used for business, residence, and the trees on the property will not be removed to accommodate the building.” Allesan Armstrong second the motion. Between the front yard building line as established by this chapter and the street line, no building or portion of a building may be erected above the grade level. The proposal is to construct a covered front porch that projects 8 feet forward of the building line. This variance would result in allowing a covered porch to project 8 feet and into the front setback. Allesan Armstrong motioned, “I would like to move that the Board approve this variance because it would not be out of charter with neighborhood.” Michelle Green second the motion. Signs for uses in Retail Business Districts, Office Building Districts, Shopping Center Districts, and Automobile Parking Districts shall be permitted in accordance with the following regulations. (a) Permitted Types, Number, Area and Height. Signs by structural type are permitted only in accordance with the regulations regarding maximum number, area and height as presented in the following schedule. Sign types not listed are prohibited. All signs are permanent unless listed as temporary. Retail # - 1 per bldg street frontage Wall (major) SF - 10 + (W x 1.5) Per the Commercial Sign Schedule, a 104ft wide tenant space is allowed one wall sign not exceed 166 SF in area. The proposal is to install two 120 SF single face wall signs for a total of 240 SF. A variance would result in allowing an additional wall sign and 74 more SF of wall signage than code allows. Michelle Green stated, “I’d like to make a motion to approve the variance as it would not substantially alter the adjoining properties and the spirit and intent behind the zoning and building requirement would be observed and substantial justice done by granting it.” Allesan Armstrong second the motion. Ridgewood Parma, Ohio 44129, a use variance, to City of Parma Codified Ordinance SECTION 1153.02 PRINCIPAL USES AND BUILDINGS. Within any Single-Family House District, no building or premises shall be erected, used, arranged or designed to be used, in whole or in part, for other than single-family detached dwellings. The proposal is to operate two businesses, a daycare and hair salon, and not reside in this single-family home. A variance would result in allowing two non-residential business uses to operate out of a single-family dwelling in the single-family zoning district. Michelle Green motioned, “Given the circumstances of wanting to convert it to not only one but two commercial spaces and the Councilwoman’s recommendation, I am going to recommend we do NOT grant the variance at this 3 time, without at least getting a little further information with respect to what costs would be involved to make it compliant and make the city happy with that.” Allesan Armstrong second the motion. George Ziefle, Allesan Armstrong, and Michelle Green voted to DENY the variance. Motion made by Councilman Euerle seconded by Councilwoman Shuman to thereafter read the variance application by title only. Further moved to refer the Variance to the Planning Committee. Motion carried. Chief of Staff Rich Summers stated the following: The Mayor had asked me to come in and express that we are in support of denying the variance for 5506 W. Ridgewood Drive. I know there has been a lot of chatter about this in social media realms. One thing that we would request that each and every person do before they ever have the opportunity to vote on this is to actually listen to the hearing that was held by BZA. There are many issues involving this that could affect everybody’s ward if it were in fact to pass. I think a lot of people are being treated unfairly in saying that Parma is trying to be anti-business or that the Councilwoman is trying to be anti-business in this. This is a home in a neighborhood in which individuals went out and they purchased this property without doing their due diligence quite frankly. There’s not even a plan of anybody living in this house. They want to make the upstairs a beauty salon and the downstairs to be a daycare center. This isn’t an in-home daycare center like you have popped up in other areas, this would open up the city to liability as far as just spot zoning issues that we would have. If you were to agree with this and to allow the variance, it would be the same as somebody perhaps being a mechanic trying to open up a garage in the middle of a neighborhood. There are petitions.org’s out there to sign that people are anti-business. That is anything from the truth. These individuals were told by our Building Department that they saw issues with this, but they had purchased the property without doing their due diligence. The city does plan on sitting down with these individuals to try to work something out, to try to figure out a way, whether it’s finding a different location or finding any type of solution to it but to just allow a business to go into a neighborhood is something that I don’t think the city wants in any of our wards to allow this and the liabilities. As far as spot zoning goes, I am sure Law Director Tuma would be able to explain to all of you, but why that is something that is a dangerous road we would be going down. So, we are in support of the denial of that variance. In addition, there was a neighbor that was going to speak at the BZA meeting, he didn’t speak though. They had said that all the neighbors were in favor of this which that couldn’t be anything from the truth from what we have been told by a neighbor that he is dead set against it. Again, I just wanted to make sure that everybody realized that these are individuals that are wanting to put this business into a neighborhood, there is no other retail around there and they do not even plan on living in this residence. I just wanted to make sure that we had cleared that up. So, in case you have heard from any members of your wards where they are saying its parma being anti-business and these poor people went out and bought a house and now we are not working with them. We are going to try to work with them and figure out some type of solution, but the solution is not allowing these businesses into that area. ----------------------------------------------------------------------------------------------------- AMENDMENT TO THE CALENDAR Motion made by Councilwoman Lime seconded by Councilwoman Shuman to amend the calendar by adding Resolution No. 65-24 to Suspension of the Rules. It is meant to highlight the issues affecting people that are in the Autism Spectrum and their families to educate the public on support services and celebrate the destigmatizing of the perceptions of those living with autism. Back in April of 2023, 1 in 36 children have been diagnosed with Autism and they are on the different spectrums. Stated Parma Schools do an exceptional job. His wife works with children with autism at Normandy High School and it is amazing to see the work that the teachers do and the joy of the students as they progress through the years as they learn how to fit into society in a better way. There is a great joy that the children and young adults have in feeling like they fit in. Please support the legislation. No: None; Resolution No. 57-24 is adopted. ------------------------------------------------------------------------------------------------------- RESOLUTION NO. 59-24 4/15/24 BY: DEBORAH LIME (By Request – Auditor) AN ORDINANCE APPROVING THE CITY AUDITOR’S POST CERTIFICATION OF REQUISITIONS AS DETAILED IN EXHIBIT “A” AND DECLARING AN EMERGENCY Councilwoman Lime – Questioned the two bills from Online Solutions from 2023. Building Commissioner Kulchytsky – Stated it has to do with Citizenserve. Councilwoman Lime – Asked why we are paying bills from August? Mr. Kulchytsky – Stated that there was a change in the billing structure that they proposed with Citizenserve. They were originally billing them at the end of the year which landed them during the temporary budget. So they asked them to restructure their billing to be in July so there are some delays going on. That may be the cause of the delay. Safety Director Coury – Stated it is his understanding that the funds were not available until the 2024 permanent budget was approved. Councilwoman Lime – Asked if it was budgeted for in 2023? Mr. Coury – Stated he didn’t know if there was adequate funding in the temporary budget. At the time of the invoice the funds were not available. Councilwoman Lime – Stated we were not in a temporary budget in August. We were in the permanent appropriations in August. Mr. Kulchytsky – Stated they did not have the money at the time. Keep in mind that the residents cannot leave their vehicles in the street for more than 24 hours at a time. Service Director Vannello – Asked Council members for their patience as they begin the paving season. A new component has been added to the program. The Cleveland Water Department has a lead line replacement program, and they are working to coordinate their paving road list with CWD’s list for lead line replacement. Auditor Day – No comment. Law Director Tuma – Reminded Council that the Law Department is always available for any questions or concerns. Treasurer Mastroianni – No comment. ------------------------------------------------------------------------------------------------------------ Councilwoman Zacharias - No comment. Councilwoman Boyd – Stated they are partnering with We Are Parma Proud and doing a trash pick up on Saturday from 10 am to noon. They will be starting at the Ridgewood Lakes Splash Pad and moving towards the Shoppes. All are welcome. Councilman Divis – Thanked everyone for their support with the National Autism Acceptance Month for April. Councilman Euerle – No comment. Councilman Kussmaul – Commended Walls of Books for their Eclipse Celebration. They did a great job. Councilwoman Lime – Reminded everyone that Polish Constitution Day will be Sunday, May 5.
