MINUTES JUNE 2, 2025 COUNCIL MEETING PARMA COUNCIL CHAMBERS 6:30 P.M. The Regular Council Meeting was called to order by President of Council Vito Dipierro presiding: COUNCIL MEMBERS PRESENT: AMANDA BOYD ALLAN DIVIS ROB EUERLE KEVIN C. KUSSMAUL DEBORAH LIME KAMMY SHUMAN JOHN SOEDER MONICA WILSON KELLY ZACHARIAS Mrs. Saban – Mr. Chairman, the Roll of Council has been called, and I find a quorum of Council members present. The following officials and department heads were also present: Mayor Timothy DeGeeter, Law Director Scott M. Tuma, Auditor Brian Day, Treasurer Tom Mastroianni, Service Director Tony Vannello, Safety Director Bob Coury, Building Commissioner Dan Kulchytsky, City Engineer Hasmukh Patel, Assistant Building Commissioner Jim Lobenthal, Communications and Community Relations Director Carolyn Kovach, Recreation Commissioner Mickey Vittardi, Chief of Staff Rich Summers and Clerk of Council Kristin L. Stated, hearing none, the minutes will stand approved as printed. ------------------------------------------------------------------------------------------------------------ AMENDING THE CALENDAR Motion made by Councilwoman Lime seconded by Councilwoman Shuman to amend the Calendar by: Adding Ordinance No. 96-25 to Second Reading, move Ordinance No. 98-25 from Second Suspension to Second Reading and add Resolution No. 99-25 to Third Reading. SHUMAN (By Request – Treasurer) AN ORDINANCE AUTHORIZING THE ISSUANCE OF NOT TO EXCEED $1,560,000 OF BONDS FOR THE PURPOSE OF RETIRING NOTES ISSUED FOR THE PURPOSE OF IMPROVING THE SERVICE GARAGE, JUSTICE CENTER, SENIOR CENTER, AND OTHER PUBLIC BUILDINGS BY REPLACING ROOFS, TOGETHER WITH ALL NECESSARY APPURTENANCES THERETO, APPROVING RELATED MATTERS IN CONNECTION WITH THE ISSUANCE OF THE BONDS, AND DECLARING AN EMERGENCY Mrs. Saban read the following: CERTIFICATE OF ESTIMATED LIFE AND MAXIMUM MATURITY To: The City Council of the City of Parma, Ohio The undersigned Auditor of the City of Parma, Ohio (the “City”) , as the fiscal officer of the City, certifies as follows: 1. The estimated life of the improvements described as follows (the “Improvements”) exceeds five years: Improving the Service Garage, Justice Center, Senior Center and other public buildings by replacing roofs, together with all necessary appurtenances thereto, 2. The maximum maturity of a single issue of bonds proposed to be issued to pay the cost of the Improvements, calculated in accordance with Section 133.20, Ohio Revised Code, is 20 years. SHUMAN (By Request – Treasurer) AN ORDINANCE AUTHORIZING THE ISSUANCE OF NOT TO EXCEED $1,600,000 OF BONDS FOR THE PURPOSE OF CURRENTLY REFUNDING A PORTION OF THE CITY’S OUTSTANDING $7,940,000 VARIOUS PURPOSE AND REFUNDING GENERAL OBLIGATION BONDS, SERIES 2016 (LIMITED TAX), DATED NOVEMBER 22, 2016; APPROVING RELATED MATTERS IN CONNECTION WITH THE ISSUANCE OF BONDS; AND DECLARING AN EMERGENCY Mrs. Saban read the following: CERTIFICATE OF ESTIMATED LIFE AND MAXIMUM MATURITY To: The City Council of the City of Parma, Ohio The undersigned Auditor of the City of Parma, Ohio (the “City”) , as the fiscal officer of the City, certifies as follows with respect to a proposed issue of refunding bonds (the “Bonds”) of the City, in the aggregate principal amount of not to exceed $1,600,000, that are to be used to refund a portion of certain bonds (the “Refunded Bonds”) of the City as described below, and the maximum maturity of the Bonds cannot exceed the last maturity permitted by law for the Refunded Bonds, in accordance with Ohio Revised Code Section 133.34, to wit: currently refunding a portion of the City’s outstanding $7,940,000 Various Purpose and Refunding General Obligation Bonds, Series 2016 (Limited Tax), dated November 22, 2016 (the “Series 2016 Bonds”), issued for the purpose of (a) refunding a portion of the City’s outstanding $10,200,000 Municipal Facility Improvement Refunding Bonds, Series 2006, (b) retiring the City’s $2,548,000 Dispatch Center Improvement Notes, Series 2016, and (c) paying certain costs of issuance of the Series 2016 Bonds. The last maturity of the Series 2016 Bonds is December 1, 2036. Therefore, the maximum maturity of the Bonds cannot be later than December 1, 2036. TO CONTINUE THE SCHOOL ZONE PHOTO ENFORCEMENT PROGRAM IN THE CITY OF PARMA, AND DECLARING AN EMERGENCY Motion made by Councilwoman Lime seconded by Councilwoman Shuman to refer Ordinance No. 98-25 back to the Public Safety Committee. Motion carried. 4 RESOLUTION NO. 103-25 5/19/25 BY: K. SHUMAN (By Request – Auditor) A RESOLUTION ADOPTING THE TAX BUDGET OF THE CITY OF PARMA, OHIO, FOR THE YEAR 2026, AND DECLARING AN EMERGENCY Motion made by Councilwoman Shuman seconded by Councilwoman Boyd to refer Resolution No. 103-25 back to the Finance Committee. Motion carried. ------------------------------------------------------------------------------------------------------------ ORDINANCE NO. 106-25 5/19/25 BY: K. SHUMAN (By Request – Community Services & Economic Development Director) AN ORDINANCE AUTHORIZING THE MAYOR, OR HIS DESIGNEE, TO SUBMIT THE FIVE-YEAR FY 2025-2029 CONSOLIDATED PLAN AND THE FY 2025 ANNUAL PLAN TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AS AN ENTITLEMENT COMMUNITY WITHIN THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM, AND DECLARING AN EMERGENCY Motion made by Councilwoman Shuman seconded by Councilwoman Lime to amend Ordinance No. 106-25 by accepting Exhibit “A” and referring back to the Finance Committee. LIME (By Request – Service Director) AN ORDINANCE AUTHORIZING THE MAYOR AND/OR DIRECTOR OF PUBLIC SERVICE TO ENTER INTO A CONTRACT WITH THE LOWEST AND BEST BIDDER FOR THE BROOKVIEW BOULEVARD WATER MAIN REPLACEMENT PROJECT (FROM STATE ROAD TO BROADVIEW ROAD), IN THE CITY OF PARMA, AND DECLARING AN EMERGENCY Motion made by Councilwoman Shuman seconded by Councilwoman Lime to amend Ordinance No. 74-25 as follows: In Section 1 line 2 the blank shall read CATTS Construction and in line 4 the blank shall read $2,594,717.02. Motion carried. Councilwoman Zacharias voted no. Motion made by Councilwoman Lime seconded by Councilwoman Shuman to adopt Ordinance No. 74-25 as amended. Yes: Boyd, Divis, Euerle, Kussmaul, Lime, Shuman, Soeder, Wilson. No: Zacharias; Ordinance No. 74-25 is adopted as amended. Motion made by Councilwoman Lime seconded by Councilwoman Shuman to withdraw motion to adopt Ordinance No. 74-25. Motion carried. Motion made by Councilwoman Shuman seconded by Councilwoman Lime to amend Ordinance No. 74-25 as follows: In Section 1 line 2 the blank shall read CATTS Construction and in line 4 the blank shall read $2,594,717.02. Motion carried. Councilwoman Zacharias voted no. LIME A RESOLUTION REQUESTING THE BUILDING COMMISSIONER TO INSTITUTE SUMMARY NUISANCE ABATEMENT OF PERMANENT PARCEL NUMBER 448-06- 059, 6015 MORNINGSIDE DRIVE, PARMA, OHIO, AND DECLARING AN EMERGENCY Motion made by Councilwoman Lime seconded by Councilwoman Shuman to adopt Resolution No. 99-25. SHUMAN (By Request – Auditor) A RESOLUTION APPROVING THE CITY AUDITOR’S POST CERTIFICATION OF REQUISITIONS AS DETAILED IN EXHIBIT “A” AND DECLARING AN EMERGENCY Councilwoman Lime – Asked, what is the money for that is being paid to Cleveland Water? Service Director Vannello – Stated, it is for the Sprague Road widening project. Motion made by Councilwoman Lime seconded by Councilwoman Boyd to adopt Resolution No. 114-25. Yes: Boyd, Divis, Euerle, Kussmaul, Lime, Shuman, Soeder, Wilson, Zacharias. SHUMAN (By Request – Auditor) AN ORDINANCE TO AMEND THE 2025 PERMANENT APPROPRIATIONS OF THE CITY OF PARMA, OHIO, AND DECLARING AN EMERGENCY 6 Councilwoman Lime – Asked, for an explanation. Auditor Day – Explained that the money is for the Midtown updates, Brookdale water line replacement, and Brookview Blvd. water main replacement. Motion made by Councilwoman Lime seconded by Councilwoman Boyd to adopt Ordinance No. 115-25. Yes: Boyd, Divis, Euerle, Kussmaul, Lime, Shuman, Soeder, Wilson, Zacharias. No: None; Ordinance No. 115-25 is adopted. ------------------------------------------------------------------------------------------------------------ ORDINANCE NO. 116-25 6/2/25 BY: K. SHUMAN (By Request – Auditor) AN ORDINANCE AUTHORIZING THE TRANSFER OF APPROPRIATIONS WITHIN THE 2025 PERMANENT APPROPRIATIONS OF THE CITY OF PARMA, AND DECLARING AN EMERGENCY Auditor Day – Explained, that years ago several firefighters sued the city and lost. They have been paying back the city, and this is their last payment, all left over money will go to the Fire Fighters liability fund. Motion made by Councilwoman Lime seconded by Councilwoman Boyd to adopt Ordinance No. 116-25. Yes: Boyd, Divis, Euerle, Kussmaul, Lime, Shuman, Soeder, Wilson, Zacharias. DIVIS (By Request – Community Services & Economic Development Director) AN ORDINANCE TO ACQUIRE A TAX DELINQUENT PROPERTY LOCATED ON ARLINGTON LANE, PERMANENT PARCEL NUMBER 454-36-015, FROM THE STATE OF OHIO THROUGH THE CUYAHOGA COUNTY LAND REUTILIZATION CORPORATION, AND DECLARING AN EMERGENCY Councilwoman Wilson – Asked, what will be done with the property. Community Development Director Tollerup – Stated, that once the property lines are verified the land can be split and offered to the adjoining properties. Councilman Euerle – Asked, what does the city do with the properties and why do they get involved. Community Development Director Tollerup – Stated, that the city gets first chance to purchase the property. Also, they do not want an outside investor purchasing the property. Councilwoman Lime – Stated, the cost of the property is $1. Community Development Director Tollerup – Stated, that Councilwoman Lime is correct. Motion made by Councilwoman Lime seconded by Councilwoman Shuman to adopt Ordinance No. 117-25. Yes: Boyd, Divis, Euerle, Kussmaul, Lime, Shuman, Soeder, Wilson, Zacharias.
