PRE-COUNCIL MEETING CITY OF P AS ADENA January 21, 2020 – 5:30 p.m. MINUTES CALL TO ORDER Mayor Wagner called the Pre-Council Meeting to order. (19) (A)-(1) – FINAL READINGS: Mayor Wagner noted there would be an amendment on Ordinance 2020-004. (19) (A)-(2) – FIRST READINGS: Item (B) – Councilmember Ybarra questioned whether this work could be done in-house by City workers. Robin Green, Public Works Director, responded that it could not. Further, that the fencing is not optional and required by TCEQ. Item (C) – Councilmember Ybarra mentioned he had talked with Police Chief Bruegger about the old City Hall building. Proceeded to present some additional questions to Chief Bruegger about PD needs followed by short question/answer session. Councilmember Ybarra then questioned Robby Lyde, Project Development Director, about the proposed renovations and office space needs. Robby Lyde explained the project and what work is planned for this building. Following his discussion, a question/answer session followed between Councilmembers Ybarra, Casados, Harrison and Schoenbein and Robby Lyde on matters including the current foundation, structural status, possibility of adding a third floor if needed and whether or not the foundation could handle the addition of a third floor, the date the two-story portion of old City Hall was built, problems that occurred during the building of the two-story portion, proposition of tearing down entire old City Hall and starting over with a new building and possibility of utilizing what one councilmember referred to as “open space” areas in current City Hall. Item (F) – Councilmember Harrison questioned how this will help the consumer. Robin Green responded it would have a direct impact on them. Discussion and short question/answer session followed between Councilmembers Harrison and Ybarra, Robin Green and Sherry Womack, Director of Financial Planning, over such issues as who will benefit from this reduction - commercial accounts versus personal accounts, whether it will help small businesses and where the money will come from to offset the reduction, etc. ADJOURNMENT 5:44 p.m. – Mayor Wagner adjourned the Pre-Council Meeting. INVOCATION – Lou Ann Stanley, Director; Madison Jobe Senior Center PLEDGES OF ALLEGIANCE – Councilmember Sammy Casados COMMUNITY INTEREST COMMENTS IN ACCORDANCE WITH CHAPTER 551.0415 OF THE GOVERNMENT CODE Councilmember Casados – Thanked audience for coming out. Acknowledged Jason Hernandez, an Iraq veteran in audience, noting that he (Jason) had addressed Council at last meeting regarding his small business. Hopes the City will be able to work with Mr. Hernandez and help him out. Councilmember Wheeler – Welcomed audience to meeting. Regarding comments pertaining to an Iraq veteran, mentioned his deployment when he was serving in the Marine Corps and noted that today is a “somber anniversary” of the loss of Darrell Morris, who was in his unit and was killed in combat 13 years ago today. Extended thoughts and prayers to Darrell’s family, commenting Darrell was a good Marine and will never be forgotten. Councilmember Cayten – Thanked audience for attending meeting and being a part of city government. Recognized Shanna Lopez with Waste Management in audience. Proceeded to discuss how a storm had struck his home and torn down his fencing. Explained how Waste Management had responded in a matter of minutes following a phone call to them requesting the removal of the torn fencing debris in front of his home. Expressed thanks to them for the great job they did. Councilmember Bass – Thanked audience for attending meeting. Appreciates them participating in city government. City of Pasadena – Council Meeting 2 Minutes: 01-21-20 6:00 p.m. Councilmember Schoenbein – Stated he is a strong supporter of small businesses and entrepreneurs. Commented the City needs to review its ordinances and permitting and that this process is already underway. Mentioned the importance of Cyber Security and commended the IT Department for providing information to directors that protect the servers. Looks forward to our city finding new ways to improve our security systems against cyber attacks and technology that will keep our city safe and secure. Welcomed former Councilmembers Leroy Stanley and Pat Van Houte. Councilmember Ybarra – Wished fellow Councilmember Sammy Casados a happy birthday, noting he had one over the past weekend. Extended thanks to Jason Hernandez for his service to this country. Commented Mr. Hernandez has had difficulties with some departments at the City regarding an issue; hopes a resolution will be reached on this matter. Councilmember Leamon – Thanked audience for coming to meeting. Regarding comments by fellow Councilmembers Casados and Ybarra, noted he has received calls in the past from small business owners who have encountered problems with the City in getting their businesses started. Hopes the City will work with small businesses and help them, commenting we need them in our city. Announced Queens Neighborhood meeting scheduled Monday, January 27th at 7:00 p.m. at the Sunset Methodist Church. Councilmember Harrison – Referred to an article pertaining to Jason Hernandez in audience that discussed his background in the military. Noted that Mr. Hernandez is a veteran who served in Iraq, is a businessman, has money invested in his business and is in need of help. Stated that he would support a variance on this business if one was presented to Council. Mentioned that Precinct 2 Harris County Commissioner, Adrian Garcia, has some projects that he (Garcia) would like to coordinate with our city. CITIZENS WISHING TO ADDRESS COUNCIL Bill Pittman – Commented he feels there will be a great growth in our city over the next few years and that small businesses are “wonderful”. Noted he is a Vietnam Veteran and served in the 101st Airborne Division. Mentioned he had been doing a lot of reading lately, including such documents as the City Charter, By-Laws, Oaths of Office, etc. Pointed out that none of these documents referenced an individual/one person, but rather referenced “all of the City”. Shared a saying from when he served in the 101 st Airborne Division – “one for all and all for one”. Proceeded to explain why it’s important that elected officials and others should take the “individuality” out of their service and instead “all work together” for the people. Feels like a lot more could be accomplished without fighting each other and focus on issues as a group helping others. Jason Hernandez – Announced he is a veteran and small business owner who recently purchased property in Pasadena and has encountered problems in getting his business open. Read a John F. Kennedy quote and commented he feels as though he is being “discriminated against”. Proceeded to explain reasons why he feels this way and described all the problems he has had with various departments and staff at the City over past weeks relating to his business and the property he purchased. Also, discussed his military background, commenting he served our government and would now like the “government to work with him”. City of Pasadena – Council Meeting 3 Minutes: 01-21-20 6:00 p.m. Jocelyne Hernandez – Wife of Jason Hernandez. She too described the problems she and her husband, Jason, have had with the City over past weeks in obtaining an occupancy permit for their business on newly-purchased property. Proceeded with discussion of where the process began with the City and where it has come to, with the end result that of an occupancy permit being denied by the City. Explained why she feels their rights have been “violated” and why she feels this entire “nightmare” is the result of what she referred to as “incompetence” on the part of various City departments and is “unjust”. Randy Hernandez – Father of Jason Hernandez. Stated he was at meeting on behalf of his son, Jason, who served in the armed forces for ten years. Discussed at length Jason’s background in the military and experiences he suffered both during and after his service in the military. Urged Council to “not be the problem, but the solution” and hopes they will help his son in this matter. Dangelo Ramirez – Nephew of Jason and Jocelyne Hernandez. Discussed his background with the Hernandez family and his admiration for them. Talked about the many ways Jason and Jocelyne Hernandez had helped him and others in the family. Also, noted that this business helps many families, not just one. Asked Council to help with this issue and to reconsider their family. Robert Jeter III – Congratulated Councilmember Casados on his birthday. Also, extended congratulations to Mayor Tom Reid who was recently voted as Mayor Emeritus of Pearland by its City Council. Glad to see that City recently renamed some streets after fallen officers, commenting he mentioned this back in 2017 at the first council meeting under this Administration, a “wonderful idea”. Councilmember Ybarra – Noted that Jason Hernandez had addressed Council at last meeting and that since that meeting, he has had several communications with him over the problems he is having with the City. Discussed some of those communications and suggested the possibility of a variance. Also, noted that he, as a member on Council, has not suggested that Mr. Hernandez’s business be shut down. Talked about how he feels the City hires too many family members of employees and/or those with close connections. Councilmember Casados – Does not think this is a wise way to spend public funds and a “little foolish”. Mentioned other ways he feels would have been a better way to spend these funds. Councilmember Casados – Thinks this is an “exorbitant” amount to spend on this fencing; that it could be done by City workers. Reminded how he voted to take three million dollars out of Professional Services during budget process for just such expenditures. Councilmember Harrison – Stated he would not support this item; that someone at the City could do the work. City of Pasadena – Council Meeting 8 Minutes: 01-21-20 6:00 p.m. MOTION CARRIED AS FOLLOWS: “Ayes” – Councilmembers Leamon, Cayten, Bass, Schoenbein and Mayor Wagner “Nays” – Councilmembers Ybarra, Harrison, Casados and Wheeler ORDINANCE 2020-010 - Agreement with Camden Design Group, Inc. for architectural and engineering services for the renovation of the Old City Hall – North Wing (CIP #M041) in the amount of $445,450.00, with additional services of $60,000.00, for a total appropriation of $505,450.00 from the 2018 Certificates of Obligation fund balance account. Councilmember Bass moved, seconded by Councilmember Schoenbein that Ordinance 2020-010 be passed on first reading only. Councilmember Harrison – Remembered when the two-story portion of this building was built back in the 1980’s. Thought it was a bad structure then and a bad one now. Also, talked about the City getting involved over the years in what he referred to as “the real estate business” and he does not think this is a good thing; discussed some examples. Cannot support spending any money on this building. Councilmember Schoenbein – Discussed what he feels has been the City’s “job of well planning for future use of its buildings”. Explained why he supports the remodeling of this building and how it will benefit the City, its citizens and the Police Department. Councilmember Wheeler – Reminded audience that they can attend Pre-Council meetings before the Council meetings. Disagreed with comments that this building is “structurally sound” and that City will be saving money by renovating the building. Will not support this item. Feels there is a more responsible way to get what is needed done. Councilmember Ybarra – Explained that the “driving force” for renovation of this building has to do with the needs of Police Department for space to house articles of evidence. Discussed how every few years, since he has served on Council for nine years, the issue of City’s need for more space becomes an issue. Feels that the better solution would be to completely demolish this building and rebuild a new one that would meet needs of City. Commented it may cost more initially, but would be better planning for tomorrow. MOTION CARRIED AS FOLLOWS: “Ayes” – Councilmembers Leamon, Cayten, Bass, Schoenbein and Mayor Wagner “Nays” – Councilmembers Ybarra, Harrison, Casados and Wheeler ORDINANCE 2020-011 - Amend Ordinance No. 2019-157, which adopted the Annual Budget for the Fiscal Year 2020. City of Pasadena – Council Meeting 9 Minutes: 01-21-20 6:00 p.m. Councilmember Casados moved, seconded by Councilmember Cayten that Ordinance 2020-011 be passed on first reading only. Councilmember Harrison – Disagreed with comments made by fellow councilmember regarding bonds, taxes and certificates of obligation, etc. Councilmember Schoenbein – Responded to Councilmember Harrison that this ordinance has nothing to do with taxes or certificates of obligation that money was being moved from one account to another. Councilmember Ybarra – Responded to both Councilmembers Harrison and Schoenbein noting that this amendment had to do with raises for City employees. MOTION CARRIED, UNANIMOUS. ORDINANCE 2020-012 - Determining the public necessity for and authorizing the acquisition of a property at 5812 Sandy Lane in Pasadena, Texas for the Golden Acres Detention Project (CIP #D044) and the expenditure of $250,000.00 for land acquisition and any related relocation assistance and ancillary costs in an amount not to exceed $250,000.00 from the 2018 Certification of Obligation Fund Balance Account. Councilmember Wheeler moved, seconded by Councilmember Leamon that Ordinance 2020-012 be passed on first reading only. Councilmember Cayten – Discussed how this acquisition will pave the way for a new detention pond in front of Bliss Meadows which will help residents in that neighborhood with flooding issues. Councilmember Wheeler – Extended “kudos” to the Administration and Public Works for getting this done. A good project which will help the residents in the area. Councilmember Harrison – Explained “relocation assistance” involving federal funds. Pleased that this type of assistance is being paid regarding this acquisition. MOTION CARRIED, UNANIMOUS. ORDINANCE 2020-013 - Amend Ordinance No. 2018-126, contract with Waste Management of Texas, Inc. for commercial and industrial trash services, to reduce City commercial franchise fee from 25% to 15%, effective March 1, 2020. Councilmember Cayten moved, seconded by Councilmember Leamon that Ordinance 2020-013 be passed on first reading only. Councilmember Casados – Explained reasons why he would be voting “no” on this item until he has more information. Councilmember Harrison – Mentioned he had asked questions regarding this item during Pre-Council and learned it would lower rates for the customer by ten percent. Councilmember Ybarra – Feels the reduction from 25 to 15 percent is a good thing for small business and he will be supporting it. City of Pasadena – Council Meeting 10 Minutes: 01-21-20 6:00 p.m. Councilmember Leamon – He too will be supporting this item which will help small businesses. Councilmember Schoenbein – Noted that the language in this item specifically makes reference to “commercial and industrial trash services”. Therefore, it directly impacts our small businesses and will give them a ten percent reduction. RESOLUTION 2020-015 – Accepting donations from various donors totaling $7,775.28 for the care and treatment of animals housed at the animal shelter. RESOLUTION 2020-016 – Accepting in-kind donation of supplies valued at $200.00 from Josiah Deppisch & Family for the Multipurpose Center to be used by participants. City of Pasadena – Council Meeting 11 Minutes: 01-21-20 6:00 p.m. RESOLUTION 2020-017 – Authorizing Pasadena Parks and Recreation Department to seek funding annually in the amount of $1,000.00 from Target for the Youth Soccer Program. Councilmember Leamon moved, seconded by Councilmember Schoenbein that Resolution 2020-017 be passed, approved and adopted. MOTION CARRIED, UNANIMOUS. RESOLUTION 2020-018 – Accepting donations valued at $308.57 from the Friends of the Pasadena Public Library and 13 books valued at $254.35 from MidAmerica Books for programming, volunteer and staff appreciation luncheon or giveaways and books for the collection. RESOLUTION 2020-019 – Accepting donation of Walmart gift cards valued at $400.00 from Queens Court HOA for needy families during Holidays 2019. RESOLUTION 2020-020 – Accepting donation of $100.00 from Maria Elena Ramirez for Madison Jobe Senior Center events. RESOLUTION 2020-021 – Authorizing the Mayor or his designee to execute documents related to Harris County Precinct 2 Partnership Capital Improvement Project Applications.
