PRE-COUNCIL MEETING CITY OF PASADENA May 21, 2024 – 5:30 p.m. MINUTES CALL TO ORDER Mayor Wagner called the Pre-Council Meeting to order. Proceeded to go over agenda. (13) – PROGRESS PAYMENTS: Item (B) – Councilmember Van Houte noted there had previously been a change order for this project. Questioned the current overage of cost. Robin Green, Director of Public Works, explained there is no way to know exact cost of a project until the job is finished. (19) – (A)-(1) FINAL READINGS: 2024-093 – Mayor Wagner noted there would be a Motion to Amend on this item and it would be read separate. (19) – (A)-(2) FIRST READINGS: Item (L) – Councilmember Van Houte questioned if the estimate listed in this item was for the total fuel cost with fees. (No one present at this time to respond to inquiry) (19) – (B) RESOLUTIONS: Item (F) – Councilmember Van Houte asked what type of equipment was referenced in this item. (Mayor Wagner attempted to call the department that would have the information) Discussion followed between Councilmembers Van Houte and Schoenbein; Mayor Wagner, Jay Dale, City Attorney, Police Chief Jerry Wright, and Sherry Womack, Director of Financial Planning. Mayor Wagner stated he would find out and get back with Councilmember Van Houte on this item. Item (B) – Councilmember Guerrero thanked Chief Wright for his initiative in applying for this grant. Asked how long it would be before they would know if the grant is approved. Chief Wright responded that they will know within 30 days if they were approved. RECORD OF PROCEEDINGS CITY OF PASADENA May 21, 2024 – 6:00 p.m. CALL TO ORDER City of Pasadena – Council Meeting 1 Minutes: 05-21-24 6:00 p.m. The regular Council Meeting of the City of Pasadena, Harris County, Texas, was called to order by Mayor Wagner. ROLL CALL COUNCIL PRESENT: Mayor Wagner RUBEN VILLARREAL - District A JONATHAN ESTRADA - District E EMMANUEL GUERRERO - District C DOLAN DOW - District F PAT VAN HOUTE - District D ORNALDO YBARRA - District G THOMAS SCHOENBEIN - District H Absent – Councilmember Bianca Valerio Also present at the Council table was Amanda Mueller, City Secretary. INVOCATION – Chaplain Donald Mayfield, Pasadena Police Department PLEDGES OF ALLEGIANCE – Councilmember Pat Van Houte COMMUNITY INTEREST COMMENTS IN ACCORDANCE WITH CHAPTER 551.0415 OF THE GOVERNMENT CODE Councilmember Van Houte – Stated that Pasadena seems to have come through the recent storms better than a lot of areas around Houston, but there are places that received damage. Gave information on resources for citizens that had damages and need help. Councilmember Estrada – Wished everyone a good evening. Appreciates everyone coming out to the meeting. Councilmember Dow – Recognized Pasadena Little League in the audience. Agreed with Councilmember Van Houte’s comments, and urged everyone to utilize the resources that are available. Stated that citizens can call their councilmember or the Mayor’s Action Line for assistance. Councilmember Ybarra – Noted that it is the week for a lot of PISD graduations. Commented that he wishes all of the seniors good luck and to go out there and chase their dreams. Also recognized Pasadena Little League in the audience. Commended Councilmember Guerrero for all of his help with sponsorships for the kids who wanted to play this season. Thanked Police Chief Wright for his help throughout the City with some quality-of-life issues. Stated that anytime he contacts the PD they go out and take care of the issues. Councilmember Schoenbein – Wished everyone a good evening. Recognized former Councilmember Bruce Leamon in the audience. Commented there was quite a group from Pasadena Little League at the meeting. Joked there may be a baseball game before the end of the meeting. Thanked Councilmember Guerrero for helping to build relationships through helping the Little League have a great season. Stated he wanted to recognize the Strawberry Festival team for hosting a wonderful event. Commented on City of Pasadena – Council Meeting 2 Minutes: 05-21-24 6:00 p.m. storms that hit during the event. Remarked that the Police Department and the Volunteer Fire Department stepped into action and led to make sure that no injuries occurred; very thankful for them. Congratulated Officer Fred Humphrey and Abel Garica on their retirement and years of service to the City. Councilmember Villarreal – Commented that he wanted to recognize all the future MLB players that were present at the meeting. Thanked everyone for attending the meeting. Councilmember Guerrero – Commented that he wanted to echo the sentiments of Councilmember Ybarra in congratulating all the graduating seniors. Stated he wants to highlight some of the work being done in the City. Remarked that he has had residents contact him about some recently painted fire hydrant, commenting that they like the bright red color they have been painted. Noted that the Strawberry Festival was a great event even with the storms. Thanked the police officers who helped manage the situation and establish an action plan when the storm hit. Recognized the Pasadena Little League in the audience. Hopes everyone goes out and shows them support at the games. Thanked Coach Cantu for his support with the players. Commented that he wanted to recognize Councilmembers Villarreal, Ybarra, Dow and Schoenbein as well as Officer David Garza and Steve Halverson for their contribution in sponsoring the kids. Asked the Little League players to always remember to do their best and keep working hard. CITIZENS WISHING TO ADDRESS COUNCIL Robert Jeter III – Discussed issues such as alleged tampering of campaign signs, illegal placement of candidate signs and phone calls he received concerning a voter guide that he had sent out prior to the last election. Stated that now would be a good time for the City Attorney to specify whether the police department intends to investigate information he previously turned over to a City prosecutor. Julius Sampson – Stated that he was at the meeting to discuss the power outage issues in his neighborhood every time there is a windstorm. Suggested that the City hire a company to come in and trim the tree limbs that are close to the powerlines. Nick Cantu – Coach and Board Member, Pasadena Little League. Recognized other board members and coaches in the audience. Commented they try to put in their time for the kids of the City of Pasadena. Explained how he came into contact with Officer Garza and conversations they had concerning the low number of kids signing up for Little League due to the registration fee. Stated that Officer Garza then contacted Councilmember Guerrero and they began to reach out to several sponsors to donate the fees for the kids to play this season. Thanked everyone for all they have done. Commented they are a beacon of light in the community. Thanked Mayor Wagner for his participation and throwing the first pitch. Stated that having the Mayor and Councilmembers showing up and being there for the Little League shows the kids that they matter. ORDINANCE 2024-106 - Authorizing and approving the purchase by the City of Pasadena, Texas, of five (5) 2024 Chevrolet Silverado Crew Cab Trucks, seven (7) 2024 Chevrolet Silverado Regular Cabs, five (5) 2024 Chevrolet 3500 DRW Crew Flatbed Trucks and three (3) 2024 Chevrolet 3500 DRW Crew Animal Control Body Trucks from Lake Country Chevrolet utilizing the TIPS Cooperative Contract #210907; in the amount of $1,073,312.37. Councilmember Schoenbein moved, seconded by Councilmember Guerrero that Ordinance 2024-106 be passed on first reading only. MOTION CARRIED, UNANIMOUS. ORDINANCE 2024-107 - Authorizing the renewal/extension of the contract between the City of Pasadena, Texas, and Cotton Logistics, LLC for emergency food services for the City of Pasadena. Councilmember Schoenbein moved, seconded by Councilmember Guerrero that Ordinance 2024-107 be passed on first reading only. MOTION CARRIED, UNANIMOUS. ORDINANCE 2024-108 - Authorizing and approving a contract for the use by the City of Pasadena, Texas, of fleet fuel credit card program, through the Sourcewell Co-operative Contract #080620, with WEX Bank. Councilmember Schoenbein moved, seconded by Councilmember Guerrero that Ordinance 2024-108 be passed on first reading only. MOTION CARRIED, UNANIMOUS. ORDINANCE 2024-109 - An Ordinance amending Ordinance 2020-023, which authorized an agreement between Harris County and the City of Pasadena, Texas, for the drainage improvements for Armand Bayou Upper Reaches project and adding $1,580,687.59 as part of Hurricane Harvey Round 1 Community Development Block Grant – Disaster Recovery (CDBG-DR) funding. Councilmember Schoenbein moved, seconded by Councilmember Guerrero that Ordinance 2024-109 be passed on first reading only. MOTION CARRIED, UNANIMOUS. ORDINANCE 2024-110 - Approving a pipeline crossing agreement by and between the City of Pasadena, Texas, as licensee, and the Union Pacific Railroad (UPRR) Company as licensor, for use of the company’s right-of-way, at mile post 1.97 on the Bayport Industrial lead at or near Pasadena, Harris County, Texas, for an underground pipeline conveying potable water; and appropriating a license fee of $7,000.00 from the water distribution professional services account for this purpose. Councilmember Schoenbein moved, seconded by Councilmember Guerrero that Ordinance 2024-110 be passed on first reading only. MOTION CARRIED, UNANIMOUS. City of Pasadena – Council Meeting 10 Minutes: 05-21-24 6:00 p.m. EMERGENCY READINGS ISSUANCE OF OBLIGATIONS RESOLUTIONS **NOTE** At this time Mayor Wagner noted that the equipment referenced in Resolution 2024-097 is a Bobcat excavator. RESOLUTION 2024-092 - Authorizing the Pasadena Parks and Recreation Department to apply for a $15,000.00 HEB Community Investment grant for the 4th Fest, Music and Movie in the Park and Christmas Tree Lighting events. Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-092 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-093 - A Resolution on behalf of the Pasadena Police Department to apply for the State of Texas, Motor Vehicle Crime Prevention Authority (MVCPA) grant program in the amount of $83,940.00. Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-093 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-094 - A Resolution by the City Council of the City of Pasadena, Texas, approving an amendment to the FY 2024 Budget, Resolution 2023-153 and Resolution 2023-273, for the Pasadena Crime Control and Prevention District as approved by the Board Members on May 8th, 2024 and illustrated in Exhibit “A”. Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-094 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-095 - A Resolution nominating Chevron Phillips Chemical Company LLC to the Office of the Governor Economic Development and Tourism (EDT) through the Texas Economic Development Bank (Bank) as an Enterprise Project. Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-095 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-096 - A Resolution of the City Council of the City of Pasadena, Texas, supporting a No Wake Zone in and around the Clear Lake area on June 21, 2024 during the Texas Outlaw Challenge. Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-096 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-097 - A Resolution accepting for and on behalf of the City of Pasadena, Texas, seized equipment from Harris County identified as No. 23014038. City of Pasadena – Council Meeting 11 Minutes: 05-21-24 6:00 p.m. Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-097 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-098 - A Resolution accepting for and on behalf of the City of Pasadena, Texas, Special Warranty Deeds from the Houston Parks Board for eighteen (18) properties along Vince and Little Vince Bayou. Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-098 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-099 - A Resolution authorizing the Mayor to execute and the City Secretary to attest the General and No Litigation Certificate of the City of Pasadena relating to issuance of tax-exempt bonds by Southeast Texas Housing Finance Corporation, for multi-family projects not located within the City of Pasadena corporate limits, but within the jurisdiction of Southeast Texas Housing Finance Corporation (Village at Baytown). Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-099 be passed, approved and adopted. MOTION CARRIED UNANIMOUS. RESOLUTION 2024-100 - A Resolution authorizing the Mayor to execute and the City Secretary to attest the General and No Litigation Certificate of the City of Pasadena relating to issuance of tax-exempt bonds by Southeast Texas Housing Finance Corporation, for multi-family projects not located within the City of Pasadena corporate limits, but within the jurisdiction of Southeast Texas Housing Finance Corporation (Bay Terrace Apartments). Councilmember Dow moved, seconded by Councilmember Guerrero that Resolution 2024-100 be passed, approved and adopted. MOTION CARRIED UNANIMOUS.
