City of Passaic New Jersey Passaic City Council SPECIAL COUNCIL MEETING January 17, 2019 SPECIAL PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS HELD ON WEDNESDAY, JANUARY 17, 2019 AT 7:20 P.M. IN THE PASSAIC HIGH SCHOOL AUDITORIUM Amada D. Curling, City Clerk read the following notice into record: IN ACCORDANCE WITH CHAPTER 231 PUBLIC LAWS OF 1975, ADEQUATE NOTICE OF THIS MEETING WAS PUBLISHED IN THE HERALD NEWS ON JANUARY 15, 2019; SAID NOTICE WAS POSTED ON THE CITY HALL BULLETIN BOARD BY THE OFFICE OF THE CITY CLERK. PURSUANT TO THE OPEN PUBLIC MEETINGS ACT, BE ADVISED THAT THE CITY COUNCIL OF THE CITY OF PASSAIC HAS SCHEDULED A SPECIAL MEETING ON JANUARY 17, 2019 AT 7:20 P.M, IN THE PASSAIC HIGH SCHOOL AUDITORIUM LOCATED AT 170 PAULISON AVE. PASSAIC, NEW JERSEY FOR THE FOLLOWING MATTER; SWEARING-IN CEREMONY OF THE HONORABLE COUNCILMAN SALIM Y. PATEL FORMAL ACTION MAY BE TAKEN ON CALL OF THE ROLL THE FOLLOWING COUNCIL MEMBERS RESPONDED: ROLL CALL AYES: Garcia, Love, Melo, Munk, Patel, Schaer, Schwartz ABSENT: ALSO PRESENT: Hon. Hector C. Lora, Mayor, Ricardo Fernandez, Business Administrator, William Maslow, City Attorney Gary S. Schaer, Council President, in the chair Presentation of Colors by the Passaic Police Department, Passaic County Sheriff Department and Passaic High School NJROTC Invocation was rendered by Mr. Yagnesh, Mistry, BAPS Swaminarayan, Pujari; followed by the Pledge of Allegiance by Passaic High School Club India. Singing of the National Anthem by: Ms. Latasha Casterlow-Lalla Retirement of Colors Remarks were made by Hon. Hector C. Lora, Mayor 1 ------------------------------------------------------ At this point in the meeting Amada D. Curling, City Clerk read: The Statement of Determination of the Special Municipal Election held on November 6, 2018. Remarks were made by Hon. Gary S. Schaer, Assemblyman of the 36th District Remarks were made by Hon. Gurbir S. Grewal, New Jersey Attorney General At this point in the meeting the Oath of Office was administered to Councilman Salim Y. Patel by the Hon. Gurbir S. Grewal, New Jersey Attorney General Remarks were made by Hon. Salim Y. Patel, City Councilman Followed by Hon. City Council members Remarks were made by Hon. Hector C. Lora, Mayor Remarks were made by Hon. Gary S. Schaer, City Council President Benediction was rendered by Imam Quatanani Remarks by Nawal Kahf, Wafa House President/Co-Founder At this point in the meeting, Council President Schaer called for a twenty minute recess at 8:35 p.m. On a motion by Council Member Garcia and seconded by Council Member Melo the public meeting was opened. All members voting “Ayes” as the roll was called. ROLL CALL AYES: Munk, Melo, Schwartz, Garcia, CP Schaer ABSENT: Love, Patel Councilman Patel took his seat on the dais. 2 HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. After ample opportunity given and no one responding on a motion by Council Member Garcia and seconded by Council Member Schwartz the public portion of the meeting was adjourned ROLL CALL AYES: Garcia, Melo, Munk, Patel, CP Schaer, Schwartz ABSENT: Love ADJOURNMENT There being no further business to come before the Council on a motion by Council Member Garcia and seconded by Council Member Melo the meeting was adjourned at 9:01 p.m. ROLL CALL AYES: Garcia, Melo, Munk, Patel, CP Schaer, Schwartz ABSENT: Love ATTEST: APPROVED: Amada D.
