However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. 3 Passaic City Council January 22, 2019 Minutes HEARING OF CITIZENS Renee Griggs, 23 Aspen Place apt 3C • She thanks mayor and city council for attending events. • At 3:55 pm on Monday she and young men in neighborhood witnessed the professionalism that Police Chief Guzman showed in his handling a situation where a male was attacking a person in Passaic. • She was proud to witness the professional actions of Police Chief Guzman and police officers. Rosa Navaj, 108 Gregory Avenue • TNA meeting on Friday to finalize ordinance • Complains that drivers need to sow down to avoid hitting animals • Thanks Mr. Maslo for taking time to work with the group to make the ordinance happen Evelyn T. Robinson, 222 6th Street • Praises the young men’s performance • Is president of the realty village community association • Cross-walk markings on 6th and Passaic streets; no clear indication for cars so difficult for pedestrians and children to cross to 5th street, is afraid that someone will get hurt Juan Carlos Cinto, 140 Van Houten • He lauds MLK dance presentation. • He talks about speeding issues at Van Houten Avenue; police presence St Mary’s hospital is effective; he suggests similar police presence for Van Houten Avenue or change to lower speed limit. • Cars speed on Summer Street and School Street near #7 school since there are no lights or stop signs for ¼ mile log without lights or stop signs. • At Bergen and 3rd Street the street light is out. • At corner of Passaic and State street light is out. • Regarding a viral video about handling of high school situation, he feels that some younger police officers may not be as experienced as older officers in handling situations when under pressure; he suggests sensitivity classes to understand situations before they occur. CITY OF PASSAIC RESOLUTION NO. 19-01-025 RESOLUTION APPROVING EMERGENCY ROOF REPAIR AT POLICE-SUB-STATION – 41 MYRTLE AVENUE, PASSAIC, NJ WHEREAS, on Wednesday, January 9,2019, there was extensive damage to the roof at the Police Sub-station - 41 Myrtle Avenue ; and WHEREAS, it was the determination of the Police Chief, Luis Guzman, that the situation posed a serious potential for a health and safety hazard; and WHEREAS, a private contractor had to be hired to repair the roof; and WHEREAS, emergency purchases and contracts may be negotiated and awarded without public advertising for bids pursuant to N.J.S.A. 40A:ll-6; and 12 Passaic City Council January 22, 2019 Minutes WHEREAS, the cost for this repair is $23,000.00* NOW THERE BE IT RESOLVED by the City Council of the City of Passaic that payment to Laumar Roofing of Passaic, NJ is hereby authorized. CITY OF PASSAIC RESOLUTION #19-01-026 RESOLUTION AUTHORIZING DISTRICT OFFICE LEASE AGREEMENT WITH CONGRESSMAN BILL PASCRELL, JR. WHEREAS, the City of Passaic seeks to enter into a new Lease Agreement with Congressman William Pascrell Jr. for congressional office space currently occupied by the Congressman in Passaic City Hall; and WHEREAS, Congressman William Pascrell Jr. requests that the City execute the proposed District Office Lease Agreement and Lease Addendum attached hereto, which shall be in effect from January 10, 2019 through January 3, 2021, and no rent shall be paid to the City of Passaic; and WHEREAS, the City of Passaic is permitted to lease this property to the Congressman for no rent pursuant to N.J.S.A. 40A:12-14. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized to enter into the attached Lease Agreement and Lease Addendum by and between the City and Congressman William Pascrell Jr. for use of an office in City Hall for congressional office space for the period of January 10, 2019 through January 3, 2021; and BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute the District Office Lease Agreement and Lease Addendum attached hereto. CITY OF PASSAIC RESOLUTION#_19-01-027_ RESOLUTION AUTHORIZING ANNUAL TAX SALE WHEREAS, Chapter 99 of the Public Laws of 1997 of the State 13 Passaic City Council January 22, 2019 Minutes of New Jersey (P.L.1997, c.99) was enacted on May 12, 1997; and WHEREAS, P.L. 1997, c.99 permits municipalities to hold a “tax lien sale” for arrearages in real property taxes and other liens or charges, after the eleventh day of the eleventh month of the fiscal year upon passage of a Resolution Permitting the same, by the Governing Body; and NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Passaic, Passaic County, New Jersey, as follows: 1. In accordance with P.L. 1997, c.99 (N.J.S.A. 54:5-19) the City of Passaic, hereby directs that for unpaid real property taxes or other municipal liens or charges, or any part thereof in arrears as of the eleventh day of the eleventh month of the current year, the Tax Collector shall, subject to the provisions of N.J.S.A. 54:5-19, enforce the lien by selling a tax sale certificate on the delinquent property taxes, pursuant to law, provided that the sale in conducted no later than December 31, of the current year. 2. Such sale shall include only such unpaid taxes or other municipal liens or charges as were in arrears in the current year. CITY OF PASSAIC RESOLUTION #19-01-028 RESOLUTION AUTHORIZING THE CITY OF PASSAIC TO ENTER INTO 2019 SHARED SERVICES AGREEMENT WITH THE HOUSING AUTHORITY OF THE CITY OF PASSAIC FOR HOUSING POLICE SERVICES WHEREAS, the City of Passaic and the Housing Authority of the City of Passaic wish to enter into a Shared Services Agreement for the provision of housing police services by the City of Passaic to the Housing Authority; and WHEREAS, the attached Shared Services Agreement provides, amongst other things, that the City of Passaic will provide housing police services associated with the Housing Authority’s security programs for the period of January 1, 2019 through December 31, 2019 in exchange for the sum of Two Hundred and Eighty Thousand dollars ($280,000.00), with an option for a one-year extension at the same rate; and WHEREAS, the Housing Authority has already adopted a Resolution authorizing it to enter into the attached Shared Services Agreement under the terms and conditions set forth therein. 14 Passaic City Council January 22, 2019 Minutes NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized to enter into the attached Shared Services Agreement with the Housing Authority for housing police services; and BE IT FURTHER RESOLVED that the Mayor and City Clerk shall execute the Shared Services Agreement attached hereto; and BE IT FURTHER RESOLVED that copies of this Resolution and a copy of the executed Shared Services Agreement shall be forwarded to the Housing Authority to commence the Shared Services Agreement; and BE IT FURTHER RESOLVED that a copy of this Resolution and a copy of the executed Amended Shared Services Agreement shall be forwarded to the Division of Local Government Services pursuant to N.J.S.A. 40A:65-4. CITY OF PASSAIC RESOLUTION # 19-01-029 RESOLUTION AUTHORIZING 2019 AGREEMENT FOR CARNIVAL SERVICES WITH MCDANIEL BROTHERS, INC. WHEREAS, the City of Passaic desires to hold carnivals with amusements, concessions and rides in, Passaic, New Jersey as set forth below: • Annual Fourth of July Fireworks Celebration from July 4, 2019 to July 7, 2019 in Pulaski Park; • School #11 Carnival from August 1, 2019 to August 4, 2019 at School #11 • Third War Park Fair from August 30, 2019 to September 2, 2019 in Third Ward Veterans Memorial Park; and WHEREAS, N.J.S.A. 40A:ll-3 provides that a contract for professional services may be awarded without public advertising when the cost of same does not exceed the total sum of $17,500; and WHEREAS, the City of Passaic desires to enter into the attached contract with McDaniel Brothers, Inc., Lodi, New Jersey to provide amusements, concessions and rides and related services for the carnival, subject to the terms and conditions set forth therein; and WHEREAS, the amusements, concession, and rides services shall be provided at no cost to the City of Passaic and revenues shall be shared by the parties as set forth in the attached contract. 15 Passaic City Council January 22, 2019 Minutes NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized to enter into a contract with McDaniel Brothers, Inc., Lodi, New Jersey to provide amusements, concessions and rides and related services at the carnivals set forth above, subject to the terms and conditions set forth in the attached contract; and BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized and directed to execute such contract as well as any other documents necessary to effectuate the purpose of this Resolution.
